MEEKS, An Alleged Incapacitated Person Proposed Findings of Fact Pursuant to PEF Code, 20 Pa. C.S.A. § 5512.1 1. Marilyn L. Meeks is 88 years of age and is a domiciliary of the Township of Hampden, County of Cumberland, Pennsylvania; 2. Marilyn L. Meeks suffers from vascular dementia, which impairs her capacity to receive and evaluate information effectively and to make and communicate decisions concerning the management of her financial affairs or to meet essential requirements for her physical health and safety; 3. She is dependent upon others for assistance in her daily activities; 4. Marilyn L. Meeks has three children, Yvonne August, Gregory T. Meeks, Michelle Meeks; 5. A valid Power of Attorney was executed on or about July 17, 2013 by Marilyn L. Meeks naming her son, Gregory T. Meeks, or her daughter, Yvonne August, as her Agent; 6. After attempts to coordinate care and develop a care plan, her children are not able to agree on an appropriate care plan or guardian for the Estate and Person of Marilyn L. Meeks; and 7. The care plan submitted by Yvonne August on September 21, 2015 in accordance with this Court's directive fails to adequately describe how she plans to assist Marilyn L. Marilyn L. Meeks is a totally incapacitated person; 2. Considering the nature of her condition and the availability of family, friends, and other supports as well as the existence of any advance directives, this Court finds that Marilyn L. Meeks needs further assistance managing her medications, appointments, and finances; 3. This Court further finds that Marilyn L. Meeks needs a Plenary Guardian of her Person and her Estate; and 4.
