Deaner, Jr., by their counsel, Goldberg Katzman, P.e., who states: 1. Plaintiff Vesta Insurance Company is a business entity licensed to issue insurance in Pennsylvania, with a business address of P,O. Box 43400, Birmingham, Alabama, 35243. 2. Plaintiff's insured, Frank E, Deaner, Jr., is an adult individual who resides at 308 Hallmark House, Hershey, Dauphin County, Pennsylvania, 17033, who maintained automobile insurance with Vesta Insurance Company at the time of the accident set forth below. 3, To aU belief and knowledge, Defendant Sabri Karaaslan is an adult individual who resides at 2406 Warren Way, Mechanicsburg, Cumberland County, Pennsylvania, 17050. , . 4. On or about March 5,2004, the Deaner vehicle was parked in the parlcing lot of the Lebanon Valley Mall in Lebanon County, Pennsylvania. 5, On this date, Defendant Karaaslan, in backing his vehicle, struck the Deaner vehicle. 6. The aforesaid incident was the result of the negligence, carelessness and recklessness of the Defendant Karaaslan in that he: a. failed to ;eep a proper look out; b, failed to bring his vehicle to a complete stop without impacting the Deaner :nsured's vehicle; c, failed to keep his vehicle under proper and adequate control; and d, violated provisions of the Pennsylvania Motor Vehicle Code. 7. Defendant Karaaslan's negligence were the sole and proximate cause of property damage in the amount of $2,546.46 to the vehicle of Frank E. Deaner, Jr, 8. Deaner made a claim for this automobile property damage to Plaintiff Vesta resulting in a payment of the claim which gives rise to Vesta's right to pursue this action in subrogation. WHEREFORE, Plaintiff Vesta Insurance Company respectfully requests that this Honorable Court enter a judf:,>ment af:,>-ainst Defendant Karaaslan in the amount of $2,546.46, with interest and costs of suit.
