HOFFER, Trustee, of the Estate .of Emmett Shelley, Deceased, thraughhis attarney, Wm. A. Kramer, 2nd, respectfully represents; 1. That Emmett Shelley, .of the Baraugh of Carlisle, Cumberland Caunty ,Pennsylvania, died on March. 27, 1978, having first made his Last Will and Testament dated August 19, 1977, a capy .of which is attached hereto and marked Exhibit "A". 2. That .the said Last Will and Testament was duly prabated on April 11, 1978, in the Qffice of the Register .of Wills in and for Cumberland Caunty. in Will Baok 78, Page 485 . 3. That said Last Will and Testament provides inter alia, as follows; All my real estate situate at 34 South East Street , Carlisle, Pennsylvania, toge.ther with all buildings therean and all rights and easements appurtenant thereta, I give and devise ta myTrustee,George E. Hoffer, NEVERTHELESS, far the uses and purposes established in my "Second TrustAgreeJTIent~ dated August 19, 1977. 4. That the aforesaid Second Trust Agreement between Emmett Shelley, deceased, and your Petitioner, pravides for the management .of the praperty located at 34 South East Street, Carlisle, Pennsylvania, during such time as Russell and Nellie Hummer, or either .of them, shall desire ta rent an apartment therein, as reference thereunta will more. fully shaw. That the said Nellie Hummer continues to rent the aforesaid apartment.. 6. That upon termination of the Second Trust Agreement, your Petitioner is to distribute th~ balance then remaining pursuant to Trust Agreement dated July 28, 1975, as reference thereunto will more fully show. A copy of said Trust Agreement is attached hereto and marked Exhibit "C". 7. That by the aforesaid Trust Agreement dated July 28, 1975, Emmett Shelley, deceased, appointed the Farmers Trust Company, Carlisle , Pennsylvania, Trus.tee. 8. That said Trust Agreement dated July 28, 1975, pro- vides, inter alia, in paragraph 7(a) that "the beneficiaries of the Trust shall be the Settlor's daughter, Mary Jane Malloy, and Settlor's two grandchildren, or their issue, per stirpes." 9. That said Trust Agreement dated July 28, 1975, further provides that upon the death of Mary Jane Malloy, her interest in said Trust shall terminate. 10. That said Mary Jane Malloy died October 22, 1975. 11. That the Settlor's grandchildren are David Malloy, born October I}, 1948, and Shelley S. Malloy, born October 16, 1953, single persons. 12. That pursuant to the Trust Agreement dated July 28, 1975, all parties in interest are David Malloy and Shelley S. Malloy, or their issue. 13. That the issue of David Malloy and Shelley S, Malloy have a contingent interest in the income and principal of the Trust Agreement dated July 28, 1975, and are unrepresented in these proceedings. 14.
