IN THE ORPHANS' COURT DIVISION NO. ol i- 7 j'- C? 0 I FAHILY AGREEHENT THIS AGREEHENT, made the ~1-r( day of March, 1979, by and among, FRANCES A. CAVALLARO, Administratrix of the Estate of ~.. ~.." Daniel S. Cavallaro, deceased, MARY J. MUSMANNO, LISA CAVALLARO, DONNA CAVALLARO ..and FRANCES A. CAVALLARO, the sole surviving heirs of Daniel S. Cavallaro, deceased. WHEREAS, Daniel S. Cavallaro died April 12, 1978, intestate, a resident of the Borough of New Cumberland, Cumberland County, Pennsylvania; and WHEREAS, he left surv~v~ng as his sole heirs at law his wife, FRANCES A. CAVALLARO, and his three children, MARY J. HUSMANNO, LISA CAVALLARO and DONNA CAVALLARO; and WHEREAS, Letters of Administration were granted to FRANCES A. CAVALLARO on April 19, 1978, by the Orphans' Division of the Court of Common Pleas of Cumberland County; and WHEREAS, the Administratrix has filed on or about January 20, 1979, the Inventory and Appraisment of all the real and personal property and also all of the Commonwealth of Pennsylvania Inheritance Tax forms; and WHEREAS, all of .the heirs:?t law:of~::,the decedent are desirous of providing a different method of distribution of the lJ~JK iOS i,ICE 119 ~ '''i -. ..J~ -"f" aforementioned Estate than is provided for under the Intestate Provision of the Probate, Estate and Fiduciary Code of the Commonwealth of Pennsylvania; NOW, THEREFORE, in consideration of the mutual covenant of the parties hereto intending to be legally bound hereunder and fully aware of their rights as provided for by the aforementioned Act, do hereby agree as follows: 1. The total amount of the gross estate of the decedent was Forty-Seven Thousand Two Hundred Fifty-Eight Dollars and Thirty- One Cents ($47,258.31), and the total deductions necessary to administer the estate and liquidate the real estate and personalty was Six Thousand Six Hundred Nine Dollars and Sixty-Seven Cents ($6,609.67). These figures were reflected in the inheritance tax forms fiied with the Commonwealth 0:': I'ermsylvania a;~d the Register of Wills af~ice in and for Cumber1a~d County. 2. From the net amount of Forty Thousand Six Hundred Forty-Eight Dollars and Sixty~Four Cents ($40,648.64), there remained to be paid prior to distribution, the Pennsylvania Inheritance Tax together with interest and possible penalties due to the late receipts from the Estate of Harry Hippensteel in the amount of $ 2,591.15 , thus leaving a net balance for distribution of approximately Thirty Eight Thousand Fifty-Seven Dollars and Forty-Nine Cents ($38,057.49). 3. ~e daughters of t~e decedent, MA.RY J. }illSl1ANNO, LISA CAVALLARO and DONNA CAVALLAR0, all being of age, do hereby release, quit claim, relinquish and give up all of their right, -2- O,,:Jr. i~G r,\GE 120 ;. -'00 ... X". ;:- title and interest in and to their shares of the aforementioned net balance for distribution and absolutely and-unequivocally assign, set over and authorize the payment of their shares in full to their mother, FRANCES A. CAVPLLARO, the other legal heir at lav1. 4. The Administratrix of the Estate and her attorney are hereby authorized and directed by the parties hereto to distribute the total net balance to FRANCES A. CAVALLARO and accept from her a release which will legally constitute sufficient acknowledgment of the complete settlement of the entire estate without audit and Order of Distribution by the Court. 5. All parties hereto acknowledge having received copies of all of the Inventory of the Assets, a Statement of Debts and Deductions and a copy of this Family Agreement.
