taxes and administrative costs to himself and his sister, Celia Estella Higgins, as the intestate heirs

PETITION FOR ISSUANCE OF ANCILLARY LETTERS OF ADMINISTRATION
AFTER EXPIRATION OF 21 YEARS
TO THE HONORABLE, THE JUDGE OF SAID COURT:
I. Your Petitioner, Robert Lee Higgins, resides at 129 University Drive, Sidney,
Ohio 45365.
2. Arthur John Higgins, 50, died June 15, 1958, leaving a Will dated May 7,
1958. Letters Testamentary were issued to Mary Jane Higgins, his wife, by the Probate Court 0
Summit County, Ohio on August 8, 1958, and who served until her death. Letters 0
Administration were issued to Robert L. Higgins on October 9, 1958. Attached hereto and marked
as Exhibit "A" are exemplified copies of the Last Will and Testament, Application for Probate 0
Will, and Application for Letters Testamentary.
3. Mary Jane Higgins, 43, died September 4, 1959, intestate. Letters 0
Administration were granted to Robert L. Higgins, her son, by the Probate Court of Summit
County, Ohio on October 9, 1959. Attached hereto and marked as. Exhibit "B" is an exemplifie
c.nnv nf thp Application for Letters of Administration.

4. At the time of their death, Mary Jane Higgins and Arthur John Higgins, were
survived by their three children; Robert Lee Higgins, age 21, Celia Estella Higgins, age 19 and
Lawrence Allan Higgins, age 9. Lawrence Allen Higgins died on May 3, 1965, at the age of 14
years. Robert Lee Higgins and his sister, Celia Estella Higgins, are the only surviving heirs 0
May Jane Higgins.
5. Celia Estella Higgins, n/kIa Celia E. Rossano, resides at 284 Vesper Road,
Mogadore, Ohio, 44260.
6. An Application for Determination of Inheritance Tax was filed III Summit
County, Ohio, on January 27, 1959, on behalf of the Estate of Arthur John Higgins.
7. A Determination was filed on February 26, 1959, and the proper tax paid to the
state of Ohio.
8. On Schedule A of the Application with Itemized Statement for Determination 0
Inheritance Tax, the estate reported various real estate owned by Mary Jane Higgins and Arthur
John Higgins. A parcel of land situated in Southampton Township, Cumberland County, with a
value of $400.00 was listed on Schedule A and was crossed off by the tax authorities, as the
property is located outside the state of Ohio. Attached hereto and marked as Exhibit "c" is a copy
of the Application and Determination ofInheritance Taxes.
9. Mary Jane Higgins and Arthur John Higgins did not own any other property
located in the Commonwealth of Pennsylvania.
10. It has recently come to the attention of Robert Lee Higgins that the BY, acre
tract ofland in Southampton Township, Cumberland County, did not go through probate

proceedings and a non-resident Pennsylvania Inheritance Tax retum was never filed or th
applicable tax paid.
II. A deed dated October 28, 1954, recorded at Deed Book P, Vol. 16, Page 355, in
the Office of the Recorder of Deeds in and for Cumberland County, Pennsylvania, reflects the
transfer of ownership of the aforementioned parcel of land in Southampton Township to A. J.
Higgins, otherwise known as Arthur John Higgins. A copy of said deed in attached hereto and
marked as Exhibit "D".
WHEREFORE, your Petitioner prays your Honorable Court to issue ancillary
Letters of Administration for the Estate of Arthur John Higgins and Mary Jane Higgins so that he
may administer the 13 Y, acre parcel of land, pay the applicable inheritance taxes and distribute
remaining funds, if any, after the payment of inheritance taxes and administrative costs to himsel
and his sister, Celia Estella Higgins, as the intestate heirs of their mother, Mary Jane Higgins.
