DECREE AWARDING REAL ESTATE
AND HOW, ~.,..,.",.. 7 , 1979, the First and Final Account
of JENNIE M. BRMiDT and KERMIT E. GEPHART, Executors of the Estate
of GEORGE GEPHART, together with a Statement of Proposed
Distribution thereon, having been presented to this Court on
March 6, 1979, and the same having been confirmed and distribution
awarded in accordance therewith, the Court does hereby award,
decree and confirm unto JENNIE M. BRANDT, GEORGE D. GEPHART,
KERMIT E. GEPHART, and GAYLE J. DOUGLAS, their heirs and assigns,
all the right, title and interest of the said GEORGE GEPHART in
and to the following described real estate:
ALL THAT CERTAIN tract of land situate in the Township
of South Middleton, County of Cumberland and State of Pennsylvania,
having thereon erected a dwelling house known and numbered as
229 Pine Road, bounded and described according to the magnetic
bearings of 1945 as follows:
BEGINNING at a point in the center line of the Pine Road,
said point being a corner of the property of E. A. Stahl, and the
northwestern hereof; thence following the Pine Road north 61 degre s
40 minutes east 60 feet to a point in the center line of said
road, a corner of other land of the grantors herein named, and
about to be conveyed to Kermit Gephart; thence by the same south
26 degrees east 247.5 feet, more or less, to stake on line of
the original farm of the grantors herein; thence by the said farm
tract south 61 degrees 45 minutes west 110.7 feet to a stake, the'
southeast corner of the said Stahl property and the southwestern
hereof; thence by the said Stahl property north 14 degrees
30 minutes west 253.7 feet to the place and point of beginning,
containing 0.484 acres. '
This conveyance is subject to the restriction that no
building shall be erected or constructed thereon within a distance
of 60 feet from the Pine Road.
It being all of the property which Lester E. Dum and Helen
M. Dum, his wife, by their deed dated March 29, 1946, and
recorded in the Office of the Recordercr Deeds in and for the
County of Cumberland and State of Pennsylvania in Deed Book "E",
Volume 13, Page 98, granted and conveyed unto George Gephart and
Alice N. Gephart, his wife. The said Alice N. Gephart having die
March 4, 1952, title vested entirely in George Gephart as
surviving tenant by the~ntirety.
