TO THE HONORABLE JUDGES OF SAID COURT:
Petitioners Robert T. Miserendino and Patricia K. Miserendino (collectively referred to as
"Petitioners"), husband and wife, file this Petition for Settlement of a Small Estate under the
provisions of Section 3102 of the Probate, Estates and Fiduciaries Code and in support thereof
aver as follows:
I. Petitioners are competent adults residing at 138 Unit C, Enclave Circle,
Bolingbrook, Illinois, 60440. The Petitioners are the natural and biological parents ofthe
decedent, Lesley Ann Miserendino ("Decedent").
2. The Decedent died on February 19, 2005, at the age of25. At the time of her
death, the Decedent was a citizen of the United States of America, a resident of the
Commonwealth of Pennsylvania and was domiciled at 14 Ginger Drive, Mechanicsburg,
Cumberland County, Pennsylvania. An original Death Certificate is attached hereto and made a
part hereof as Exhibit A.
3. The Decedent died intestate.
4. The Decedent had no probate estate when she died other than two bank accounts
at Citizens Bank: (I) a checking account (No. 620012-454-3) with a balance of $5,584.95 and
(2) a savings account (No. 6244-728608) with a balance of$1,650.97. The most recent account

statements for the foregoing accounts are attached hereto and made a part hereof as Exhibit B.
There were no other assets owned by Decedent.
5. The heirs and next of kin and their relationship to the Decedent are as follows:

6. Petitioners aver that there are no creditors of the Decedent and there are no unpaid
claims known to the Petitioners. Decedent's funeral and entombment expenses were paid by
Petitioners in amounts exceeding decedent's assets described above; copies of the funeral and
entombment bills are attached hereto and made a part hereof as Exhibit C. Because deductible
expenses exceed the value of estate assets, no Pennsylvania Inheritance Tax will be due;
however, a courtesy tax return will be filed as required. 2004 Federal and State Income Tax
Returns were filed on behalf of the Decedent and no income tax was due. There is no expected
tax due for the 2005 Federal or State Income Tax Return.
WHEREFORE, Petitioners respectfully request that an order be made authorizing
distribution of the total balance remaining in Citizens Bank account numbers 620012-454-3 and
6244-728608 to the Petitioners pursuant to Section 3102 of the Probate, Estates and Fiduciaries
Code.
