Ocker, Jr. and BarbaraJ. Ocker, Adminis- trators of the Estate of Donald Norman Ocker, respectfully represent: 1. That they are the Administrators of the Estate of Donald Norman Ocker, Deceased, late of South Middleton Township, having been issued Letters of Administration by the Register of Wins of Cumberland County, Pennsylvania on January 13, 1978. 2. That the Decedent died as a result of injuries sustained in an automobile accident which occurred,July 10, 1977. 3. That th,iscase was pretried before your Honorable Court, at which time the facts and circumstances oT said accident were provided to the Court. 4. That at the time of his. death, the Decedent was twenty-one (21) years of age, unmarried, employed, and living with his parents at their home. The Decedent di dnot suffer consci ouspain prior to hi sdeath. 5. That as a result o~ the death of the Decedent, the estate in- curred funeral, burial and administrative costs in the total sum of Three Thousand One Hundred Forty-One Dollars and 97/100 ($3,.141.97). 7. Tha t counsel for. Petiti oners has' negoti ated a settl ement of both the wrongful .deathand survival actions for,the total sum'of.Twenty Six Thou- sand Six Hundred Sixty-Six Dollars and 67/100 ($26,666.67); 8. That Petitioners request the'Court to approve the settlement set forth herein and to further allocate, said amount of settlement as follows: Wrongful Death Action .Survival Action TOTAL SETTLEMENT $ 3,141.97 23,524.7Q $26,666.67. 9. That Petitioners and their counsel have agreed upon the payment of a counsel fee in the survival action in the amount of Eight Thousand Three Hun- dred Doll a rs ($8,300.00). Expenses of 1 iti ga ti on in excess of docket costs total Two Hundred Fifty-Nine Dollars and 20/.100 ($259.20), and Petitioners request ~ourt approval to pay these fees and expenses and deduct them from the . amount allocated to the survival action. 10. That Petitioners further request the Court to authorize them to execute any and all releases necessary in order to settle and discontinue the actions refer.redto herein. 11.
