I, ELIZA E. KRAFFT, of the City of York, York County,
Pennsylvania, being of sound mind, memory and understanding, do
make, publish and declare the following as and for my last will
and testament, hereby revoking and making null and void any and all
former wills by me at any time heretofore made.
FIRST: I direct that all my just debts and funeral expenses
shall be paid by my hereinafter named executors as soon after my
death as may be found convenient.
SECOND: I give and bequeath to my nephew, Theodore H. Weigand,
Jr., two of my antique chairs, which I shall have marked for him,
to be his absolutely.
THIRD: I give and bequeath to my niece, Louise Welsh, one of
my diamond rings with the largest stone therein, to be hers absolutely.
FOURTH: I give and bequeath to my niece, Virginia 4 Gartside,
all of my chinaware, to be hers absolutely.
FIFTH: I give and bequeath to my grand-nephew, Roger H. Gart-
side, the diamond ring that belonged to my late husband, David H.
Krafft, to be his absolutely.
SIXTH: I give and bequeath to my grand-niece, Delores A.
Gartside, one antique living-room table, which I shall have
marked for her, to be hers absolutely.
SEVENTH: I give and bequeath to my great grand-niece, Christine
A. Gartside, two of my antique chairs, which I shall have marked
for her, and also my gold bracelet, to be hers absolutely.
EIGHTH:. I give and bequeath to my great grand-nephew, Michael
R. Gartside, all my good silverware, being place settings, to be his
absolutely.
NINTH: I give and bequeath to my great grand-nephew, John E.
Gartside, all of my cut glassware, to be his absolutely.

(i) I give and bequeath the sum of Two Thousand ($2,000.00)
Dollars to the following children of my late brother, William
Welsh, to be divided equally among them: Pauline Welsh, Marquerite
Welsh, Ruth Attig and Louise Welsh. If either of said
beneficiaries predeceases me, then her share of said legacy
shall be paid to her heirs-at-Iaw.
(j) I give and bequeath the sum of Five Hundred ($500.00)
Dollars to the following children of my late brother, Norman F.
Welsh, to be divided equally among them: Norman F. Welsh, Jr.
aDd Mary Jane Foust. If either of said beneficiaries predeceases
me, then I give and bequeath their share of said legacy which
he or she would have taken, if living, to his or her heirs-at-law.
(k) I give and bequeath all the rest of my said residuary
estate, absolutely, to my nephew, C. Henry Gartside, and his
wife, Virginia T. Gartside, or the survivor of them, for their
kindness and understanding during the illness of my late husband,
and their consideration for me in the late years of my life.
(1) It is my desire that the legacy hereinbefore set
forth in sub-paragraph (k), of this PARAGRAPH ELEVENTH, shall
equal at least fifty per cent (50%) of my residuary estate as
set forth in this PARAGRAPH ELEVENTH, and therefore, I specifically
direct that if the legacy set forth in said sub-paragraph (k)
shall not equal fifty per cent (50%) of my said residuary estate,

then said legacy shall first be computed so as to equal fifty
per cent (50%) of my said residuary estate, and all the
previous legacies hereinbefore set forth in this PARAGRAPH
ELEVENTH shall abate proportionately.
TWELFTH: I direct that all estate, inheritance, transfer,
legacy or succession taxes, which may be assessed or levied with
respect to my estate, or any part thereof, whether or not passing
under my will, shall be paid out of my residuary estate as an expense
of administration and without apportionment.
THIRTEENTH: I nominate, constitute and appoint my nephew,
C. Henry Gartside, his wife, Virginia T. Gartside, and The York
Bank and Trust Company, York, Pennsylvania, executors of this my
last will and testament.

pennsylvania, deceased.
Said decedent, Eliza E. Krafft, died on the 16th day of
December, 1976, testate, unmarried.
Said decedent's will dated March 23, 1965 and codicil dated
May 24, 1976, were duly admitted to probate in the Office of the
Register of Wills of cumberland County on the 20th day of January,
1977, where it remains of record.
Letters testamentary were issued on the 20th day of January,
1977 to The York Bank and Trust Company, and C. Henry Gartside.
That an Inventory and Appraisement was filed on the 13th day
of March, 1978.
That the testatrix did not marry after the execution of the
will and codicil and there were no children born to her or law-
fully adopted by her thereafter.
Notice of the granting of letters was advertised in the
cumberland Law Journal and the Evening Sentinel, according to
law.
The estate is subject to transfer and inheritance tax and
an appraisement for that purpose was filed on the 13th day of
March, 1978, and the amount of $7,552.50 was paid on account
of said tax on March 13, 1978.

MATERIAL FACTS
The Court's attention is called to the fact that the total
assets of the estate were less than those necessary to pay all the
legacies in full. Therefore, Sub-paragraph (1) of paragraph
ELEVENTH is applicable, and the Schedule of Distribution was pre-
pared in accordance with this sub-paragraph. It will also be
noted that the codicil, when referring to Paragraph TEN recites
that the ring was misplaced or lost and that a cash legacy was
to be given in lieu thereof. Said ring was found after death
and the legatee elected to keep the ring and not the cash legacy,
and the Schedule of Distribution so reflects. Therefore, under
Paragraph TENTH of the will, the diamond ring containing the
smaller stones is to be bequeathed to Mary Kay Gartside.
