RIFE, SR., late of the Township of Silver Spring, County of Cumberland and Commonwealth of Pennsylvania, died January 21, 1978, leaving his Last Will and Testament dated September 27, 1971, which was admitted to probate inthe Office of the Register of Wills in and for Cumberland County, Pennsylvania, on January 31, 1978, docketed to No. 50 of 1978 Term; and WHEREAS, Letters Testamentary were on February 1, 1978 granted to the Executors named in the Will, namely, Earl W. Rife and Raymond W. Rife, Jr; and WHEREAS, the granting of Letters was advertised as required by law, in the Cumberland Law Journal, beginning on February la, 1978 and in the West Shore Times, beginning February 16, 1978; and WHEREAS, in his said Will, the decedent provided, inter alia, as follows: "THIRD: Residuary Bequest: I give, devise and bequeath all the rest, residue and remainder of my estate unto the Trustees, under an Agreement dated the 27th day of September, A. D., 1971, wherein my wife and I are Settlors, to be added to and become a part of the aforesaid Trust. FOURTH: Appointment of Executor: I hereby nominate constitute and appoint my sons, EARL W. RIFE and RAYMOND W. RIFE, JR., or the survivor thereof, as Co-executors or Executor, as the case may be, of this my Last Will and Testament. . . . " WHEREAS, in the aforementioned Trust Agreement, the decedent provided, inter alia, as follows: B. Upon the death of the survivor the Trustees are authorized and directed to pay all the just debts and funeral expenses, including a suitable marker at the grave, out of the said trust es1a te of thE su"vivor, and further to pay all inheritance and estate taxes and settlement charges out of the said trust estate of the survivor. Twenty-two and one-half percent (22-1/2%) to Pauline E. Schneider, daughter of the Settlors, or if she be deceased, to her issue in equal shares per stirpes. 2. Twenty-two and one-half percent (22-1/2%) to Earl W. Rife, son of the Settlors, or if he be deceased, to his issue in equal shares per stirpes. 3. Twenty-two and one-half percent (22-1/2%) to June L. Badorf, daughter of the Settlors, or if she be deceased, to her issue in equal shares per stirpes. 4. Twenty-two and one-half percent (22-1/2%) to Raymond W. Rife, Jr., son of the Settlors, or if he be deceased, to his issue in equal shares per stirpes. 5. Four percent (4%) to Messiah College, Grantham, Pennsylvania, to be used for such purposes as the Board of Trustees of said College shall direct. 6. Four percent (4%) to the Brethren in Christ Board of Missions, whose present address is 48-1/2 South Market Street, Elizabethtown, Pennsylvania. 7. Two percent (2%) to the Mechanicsburg Brethren in Christ Church, to be used for such purposes as the governing board of said church shall direct. . . . " WHEREAS, the decedent was survived by all of the above-named beneficiaries, all of whom are of full age and sui juris; and WHEREAS, creditors may file claims against the estate at any time until February 16, 1979; and WHEREAS, the parties in interest are desirous that settlement shall be made thereof without filing an Account with the Court of Common Pleas of Cumberland County, Pennsylvania, and hereby specifically waive their rights to an income accounting by the Trustees of the Trust created September 27, 1971 and do specifically agree and cons ent to the Inventory attached hereto and marked Exhibit "A" as a correct statement of the assets and the values thereof which were owned by the Settlor 8t the date t:, of his death and have also found correct the First and Final Account of the Executors, attached hereto and marked Exhibit "B". - 2 - W ENGBIl ANI> BYLER ATT01NlJn AT LAW' ~ ^NCAJT!'It, PINHSYLVAJIIIA NOW, THEREFORE, KNOWN ALL MEN BY THESE PRESENTS. that we, the undersigned, being the parties in interest in the Estate of RAYMOND W.
