Dear Bill:
The records in the Register of Wills office disclose that letters
of administration were issued not too long ago to Isabella M.
Freeman. I further note that the petition for letters of admin-
istration lists the heirs as Evelyn M. Shreffler, surviving spouse,
Isabella ]d. Freeman, daughter, and ::>Oris Handshew, daughter.
This is to advise you that I represent Charlotte Shreffler McNeely
of Los .\nge1es, California. Mrs. McNeely is a daughter of Floyd
L. Shreffler born out of wedlock. I realize that Section 2107 of
the Probate, Estates and Fiduciaries Code would, by its language,
disinherit Mrs. McNeely. lLowever, it has been held that Section
2107 of the Probate, Estates and Fiduciaries Act is unconstitutional
in that it violates the Equal Protection Clause of the Fourteenth
Amendment of the Constitution of the United States by invidiously
discriminating on the basis of illegitimacy. See Browning Estate,
28 Fiduciary Reporter 1. See also Trimble vs. Gordon, 430 U.S.
762.
It is well documented in our court in custody proceedings entered
to No. 159 September Term 1960 that Floyd L. Shreffler was the
father of Charlotte Shreffler (now by marriage Charlotte Shreffler
MoNeely). Therefore, on behalf of Charlotte Shreffler McNeely,
please consider this letter as a claim on her behalf to her
proportionate interest in the estate of Floyd L. Shreffler as
a surviving daughter.
