WHEREAS, CRAIG J. RAHN and SANDRA J. RAHN of 478 Arlington Road, Camp Hill,
Pennsylvania, is about to execute contemporaneously herewith, a contract, with FORTNEY
CONSTRUCTION, INC. of 6541 Leo Drive, Harrisburg, Pennsylvania, for the erection of a building
upon premises commonly known as 478 Arlington Road, Borough Camp Hill, Cumberland County,
Pennsylvania, as set forth in the deed dated October 3, 1997, recorded at Deed Book 165, Page 878, in the
Reeorder's Office for Cumberland County, Pennsylvania, as more specifically described in Exhibit "A"
which is incorporated herein and attached hereto.
NOW, May 5, 2005, at the time of and immediately before the execution of the principal contract,
and before any authority has been given by the said Owner to the said Contractor to commence work on
the said building, or purchase materials for the same in consideration of the making of the said contract
with Contractor and the further consideration of One Dollar ($1.00), to Contractor paid by Owner, it is
agreed that no lien shall be filed against the building by the Contractor, or any subcontractor, nor by any
ofthe materialmen or workmen or any other person for any labor, or materials purchased, or extra labor
or materials purchased for the erection of said building, the right to file such liens being expressly waived.
WITNESS, our hands and seals the day and year aforesaid.

Exhibit A
All that certain part or parcel of ground situate in the Borough of
Camp Hill, Cumberland County, Pennsylvilnia., more specifically
bounded and described as follows:
Beginning at a point on the southern right~of-way of Avon Road and
at the existing common property corner of lands now of Grantor and
lands of Grantee; thence from said point South 23 degrees
00 minutes 00 seconds East, a distance of 76.00 feet to an iron
pin1 thence South 67 degrees, 00 minutes, 00 seconds West, a.
distance of 20.00 feet to a point; thence North 23 degrees,
00 minutes. co seconds West, a distance of 16.00 feet; thence along
the southern right-of-way of Avon Road North 67 degrees,
00 minutes, 00 seconds East, a distance of 20.00 feet to the point
and place of beginning.
