PHIPPS, of 41 Hemlock Circle, Green Ridge Village, Newville, Cumberland County, Pennsylvania, declare this to be my Last Will and revoke any wills previously made by me. 1. I direct that any and all inheritance, estate and transfer taxes imposed upon my estate passing under my will or otherwise, shall be paid out of the principal of my residuary estate. II. If the time comes when I can no longer take part in decisions for my own future, let this statement stand as the testament of my wishes: If there is no reasonable expectation of my recovery from physical or mental disability, I request that I be allowed to die and not be kept alive by artificial means or heroic measures. Death is as much a reality as birth, growth, maturity and old age - it is the one certainty. I do not fear death as much as I fear the indignity of deterioration, dependence and hopeless pain. I ask that medication be mercifully administered to me for terminal suffering even if it hastens the moment of death. This request is made after careful consideration. I direct that my body shall be turned over to the Humanity Gifts Center of the Pennsylvania Medical Society, in accordance with instructions I have previously LLv ~ ~ made with said Center as a donor under the Pennsylvania Uniform Anatomical Gift Act, for the purpose of medical and anatomical research. III. I give and bequeath the sum of One Thousand and nolI 00 ($1,000) Dollars to the Harrisburg Unitarian Church. IV. I bequeath $10,000 to the Unitarian Universalists (Church) of Cumberland Valley, P.o. Box 207, Boiling Springs, PA, 17007. V. I bequeath $100 to each of the following: Carlisle Area League of Women Voters AAUW Carlisle Chapter Carlisle Civic Club Carlisle Garden Club Friends of Legal Services of Carlisle Nature Conservancy of Pennsylvania United Way of Greater Carlisle Area Planned Parenthood of Pennsylvania VI. I bequeath $200 to each of the following: YWCA of Carlisle Friends of Bosler Free Library S.H.A.R.E. Food Bank Domestic Violence Services VII. I bequeath my household goods, wearing apparel, jewelry, and similar tangible personal property and effects (excluding cash, stocks, bonds and automobile) in equal shares to my children, Louise Phipps Clark, Claude Olton Phipps and Peter Alan Phipps, or to such of them as shall survive me with distribution to be made by my personal representative in accordance with the following instructions: ~ ~ 1) My personal representative shall inventory my personalty not otherwise donated and divide my personalty into four categories being jewelry, silver (including flatware and service), china and glassware, and household effects. My children shall then take turns selecting items from each category with the oldest to have the first selection of category, and the selection of the first item within that category. On each successive round of selections within a category, the next oldest will be the first selector and the next older shall also be the selector of the next category after each ~ r; category is exhausted. (Order of selection: 1 2 3, 2 3 1, 3 1 2, 1 2 3). My personal representative shall resolve all conflicts and disputes which may rise in regard to the selection of personalty in his or her absolute discretion. 2) Those items of personalty which are not distributed pursuant to the provisions hereinabove shall be either distributed to the thrift shop or gift shop at Green Ridge by my personal representative or sold with the proceeds added to the residue of my estate. VIII. I give and bequeath one-half (1/2%) of one percent of the gross estate to each of my grandchildren as follows: Malcolm Douglas Alexander Paul DuBois Alexander Emily Michelle Alexander Hughes Emma Nicole Hughes Austin Ryan Philleo Katelyn Mari Philleo Victor A. IX. The balance of the residue, I give and bequeath to my three children in equal shares. It is my intent to treat my children equally. In the event any of my children do not survive me, that share I give and bequeath to the children of that child which includes stepchildren. X. I hereby direct my executor to establish a trust in the amount of $10,000 to provide care for my pet dog, Gus. On the death of Gus, the balance in the trust goes to the caretaker. I appoint Claude Olton Phipps as trustee and I appoint Peter Alan Phipps as a contingent trustee. XI. In the event that any of my property shall pass to a minor, I appoint the parents of the minor to be guardian of any such property with respect to which I am authorized to appoint a guardian. XII. My personal representative, and guardian, shall have the following powers in addition to those vested in them by law and by other provisions of my will, applicable to all property, whether principal or income, and effective until actual distribution of all property A. To retain any or all of the assets of my estate, real or personal, including any shares of stock or other securities I may own of the corporate fiduciary or its successor, or the holding company controlling the corporate fiduciary or its successor, ~ ~ J r D without regard to any principal of diversification or risk. To invest in all forms of property (including stock or other securities of the corporate fiduciary or its successor, or of a holding company controlling the corporate fiduciary or its successor, and common trust and mortgage investment funds whether maintained by my corporate fiduciary or its successor or other), without restriction to investments authorized for Pennsylvania fiduciaries, as they deem proper, without regard to any principal of diversification or risk. B. To sell at public or private sale, to exchange, or to lease for any period of time, any real or personal property and to give options for sales, exchanges or leases, for such prices and upon such terms or conditions as they deem proper. C. To allocate receipts and expenses to principal or income partly to each as they from time to time think proper. XIII. I appoint Claude Olton Phipps executor of this my Last Will. In the event he fails to qualify or ceases to act, then I appoint Peter Alan Phipps. XIV. I direct that my personal representative shall not be required to give bond for the faithful performance of his duties in any jurisdiction.
