OF
DOROTHY MORGAN SUMMERS
I, DOROTHY HORGAN SUMMERS, declare this to be my Last will and
Testament and hereby revoke all prior wills and codicils made by
me.
FIRST: My Executrix shall pay from the residue of my estate
all my debts, funeral and administration expenses and all estate,
inheritance, succession and transfer taxes imposed by the United
states or any state, territory or possession which shall become
payable by reason of my death. It shall not be necessary to file
any claims therefor, nor to have them allowed by any court.
SECOND: I give such of my tangible personal property as is
set forth in a separate, dated and unsigned letter of instruction,
which I shall place with my will, to the persons therein
designated. If I have not left a letter of instruction or for
those articles of property not distributed under this letter of
instruction, I direct that such items be distributed to my children
and children of my deceased son, GEORGE STEPHEN SUMMERS, living at
the time of my death as they may select in as nearly equal shares
as is practical. If there is any disagreement as to distribution,
I direct my Executrix to make such distribution. The decision of
my Executrix shall be final and binding. I direct my Executrix to
sell, or otherwise dispose of in her discretion, any such property

not specifically distributed by my letter of instruction or
selected by my beneficiaries and to add the net proceeds from their
sale to the residue of my estate.
THIRD: I give and devise the residue of my estate, real,
personal and mixed, of whatever kind and nature, and wherever
situate at the time of my death as follows:
A. Twenty-five (25%) percent to my daughter, NANCY
SOMMERS. If she should predecease me, this share shall be
divided equally among my grandchildren. If a grandchild has
not attained the age of twenty-five (25) at the time of my
death, his or her share shall be held IN TRUST, and
administered in accordance with the provisions of Item FOURTH
herein.
B. Twenty-five (25%) percent to my daughter, ELIZABETH
SUMMERS FEESER. If she should predecease me, this share shall
be divided equally among my grandchildren. If a grandchild
has not attained the age of twenty-five (25) at the time of

herein.
c. Twenty-five (25%) percent to my daughter,
CHRISTINE SUMMERS HOULTON, per stirpes.

D. Twelve and one-half (12 1/2%) percent each to
the children of my deceased son, GEORGE STEPHEN SUKMERS -
they being FRANKLIN VINYARD SUMMERS II and LILY MAE
SUMHERS. If they have not attained the age of twenty-
five (25) at the time of my death, his or her share shall
be held IN TRUST and administered in accordance with the
provisions of Item FOURTH herein.
FOURTH: Any shares that I have directed to be administered
under this Item shall be held IN TRUST, with each share separately
accounted for, for the following purposes:

of each grandchild, so much of the income and principal
as Trustee, in her sole and absolute discretion, deems
advisable for the health, maintenance, support and
education (including vocational and college education,
both graduate and undergraduate) of each grandchild after
taking into consideration his or her other readily
available assets and sources of income. The Trustee may
apply the net income, accumulated income and principal
of each grandchild's trust share for the health,
maintenance, support and education of each grandchild
should he or she by reason of age, illness or any other

cause, in the opinion of the Trustee, be incapable of
disbursing it.
B. The following additional directions are provided:
(a) A grandchild who has attained the
age of twenty-one (21) years, may request and
receive up to one-half (1/2) of the net income
of such grandchild's trust share.

twenty-five (25), such grandchild may request
and receive from the Trustee absolutely the
then-remaining principal and accumulated

remaining principal and accumulated income of

property in trust under the terms of this will
shall be added to and thereafter be treated as
a part of that trust.
FIFTH: I nominate, constitute and appoint NANCY SUMMERS
Executrix of this my Last will and Testament, to serve without bond
or security, and to make distribution of my estate in cash or in
kind, or partly in cash and partly in kind, and in such manner as
she may determine. I authorize, empower and direct her to sell and
convey, by good and sufficient deed, in fee simple estate, any and
all of my real estate, at public or private sale, for such price
or prices, upon such terms and conditions, as in her judgment is
best for my estate, and to that end to sign, seal, execute,
acknowledge and deliver all deeds or other instruments necessary
therefor, as effectively as I could do if I were personally
present.
In the event such person does not survive me, or refuses to
act as Executrix or does not complete the duties of Executrix, then
I nominate, constitute and appoint ELIZABETH SUMMERS FEESER as the
alternate Executrix, to serve without bond or security. My

of the pO'\vers conferred upon trustees by law, and all of the
discretionary powers granted herein. The Trustee and any successor
trustee shall be entitled to compensation for services from time
to time during the period in which they are performed.
If my daughter, NANCY SUMMERS, refuses or is unable to act as
Trustee, predeceases me or dies before the termination of any
trusts herein created, I nominate, constitute and appoint my
daughter, ELIZABETH SUMMERS FEESER, as my successor Trustee. My
successor Trustee shall have all of the powers, privileges, duties
and immunities as provided herein.
SEVENTH: No beneficiary shall have the power to anticipate,
encumber or transfer his or her interest in my estate or any trust
created herein in any manner other than by the valid exercise of
a Power of Appointment. No part of any trust or my estate shall
be liable for or charged with any debts, contracts, liabilities or
torts of a beneficiary or subject to seizure or other process by

OF
DOROTHY MORGAN SUMMERS
EIGHTH: In addition to such other powers and duties as may

shall be vested with the following specific powers and discretion,
in addition to the powers as may be conferred generally from time
to time upon trustees by law:
A. To invest, reinvest and keep the trust assets
invested in such real and personal estate as a prudent man of
intelligence and discretion would do for himself, for
investment and not for speculation, giving due regard to the
safety of the principal and the adequacy of the income,
without being limited to the so-called "legal investment" in
the Commonwealth of pennsylvania
B. To sell or otherwise dispose of any property, real
or personal, at any time held hereunder, for cash or upon
credit, in such manner and on such terms and conditions as the
Trustee may deem best, and no person dealing with the Trustee

C. To borrow or loan money for any purpose in connection
with the administration of this trust upon such terms and with
such security as the Trustee may determine.
7
LAST WILL AND TESTAMENT
OF
DOROTHY MORGAN SUMMERS
D. To make any distribution hereunder in cash, in kind,

a single fund, and to maintain such records as may be
necessary to properly administer said fund and the trust
created herein.
F. To make any distribution hereunder for the benefit
of minor beneficiaries directly to the beneficiary thereof,
to the natural guardian of such beneficiary, to his or her
legal guardian, or to the person who has custody of such
beneficiary, or to apply any such distribution directly for
the benefit of any such beneficiary. The Trustee shall not
in any way be liable to see to the proper use or application
of any such amount paid, whether directly to a beneficiary or
otherwise.
G. To receive such other property, including policies
of insurance, or the proceeds thereof, upon the life of the
Testator or any other person and to administer such property
or policies and the proceeds thereof in accordance with the
terms of this will.
H. To dispose of all income producing property upon
whatever terms or conditions the Trustee deems advisable.
8

OF
DOROTHY MORGAN SUMMERS

upon such terms and conditions as the Trustee may deem best,
and to execute and deliver all instruments and to do all acts
which the Trustee may deem necessary or proper to carry out
the purposes of this trust.
