STIPULATION AGAINST LIENS
WHEREAS, JAMES M. STRONG, VI and CARRIE LEE STRONG, husband and
wife ("Owners"), the Owners of the real estate described herein have authorized HARKINS
CONSTRUCTION, INC. ("Contractor"), whose principal place of business is located at

said real estate situate at Lot No. 165, Phase X, Canterbury Estates, known as 2176 Canterbury
Drive, Mechanicsburg, Upper Allen Township, Cumberland County, Pennsylvania as more
particularly bounded and described on Exhibit "A", attached hereto and made a part hereof; and
NOW, THEREFORE, this /1 day o~, 2005, before any authority had been
given by Owners to Contractor to commence work ~;7~'rid facilities or purchase materials for
same, in consideration of making of the above-described Contract between Owners and
Contractor, and in further consideration of One ($1,00) Dollar paid to Contractor by Owners, the
receipt whereof is hereby acknowledged and intending to be legally bound hereby, it is agreed
that no liens or claims shall be filed or maintained against the Owners' facilities and the land
described herein or any interest of Owners therein by the Contractor or any of its subcontractors,
or by any of the materialmen or workmen, or any other person acting through or under them, for
or on account of any labor or materials purchased, or extra labor or materials purchased for,
towards, in or abut the erection, construction, design and improvement of said facilities, under
said contract or otherwise, the right to have, file and maintain such liens or claims against the
facilities and the land described herein, being hereby expressly waived by the Contractor for
itself, its subcontractors, all materialmen, or workmen and other acting through or under them.
IN WITNESS WHEREOF, each of the parties, by their duly authorized representatives,

EXHIBIT "A"
ALL that certain piece, parcel or lot ofland situate in Upper Allen Township, Cumberland
County, Pennsylvania, and bounded and described as follows:
BEGINNING at a point on the Northern right-of-way line of Canterbury Drive (50.00 feet wide),
said point being located at the Southeastern corner of Lot No, 166; then along the Eastern
boundary line of Lot No. 166, North 51 degrees 14 minutes 14 seconds East, and passing through
a 50.00 foot wide building restriction area, and through a 100.00 foot wide Utility Easement, for
a distance of234.27 feet, to a point in line with lands now or formerly of Timothy p, Percarpio;
then along said lands of Percarpio, and along the center line of said 100.00 foot wide Utility
Easement, South 69 degrees 42 minutes 00 seconds East, for a distance of 214.06 feet, to a point
on the Western right-of-way line of Gettysburg Pike (T-621) (36,00 foot wide -legal right-of-
way); then along said right-of-way line of Gettysburg Pike, South 25 degrees 45 minutes 00
seconds West, and through said 50,00 foot wide building restriction area, and through a 100.00
foot wide Utility Easement, for a distance of 78.82 feet, to a point on the arc of a circle, curving
to the right, having a radius of 970,00 feet, and an arc length of 39.34 feet, following a chord
bearing of South 26 degrees 54 minutes 43 seconds West, a chord distance of 39.34 feet to a
point at the Northeastern corner of Lot No, 164; then along the Northern boundary line of Lot
No. 164, South 80 degrees 47 minutes 04 seconds West, for a distance of298,95 feet, to a point
on the right-of-way of Canterbury Drive (50,00 feet wide); then along said right-of-way line on
the arc of a circle curving to the left, having a radius of 175,00 feet, and an arc length of 90,25
feet, following a chord bearing of North 23 degrees 39 minutes 21 seconds West, a chord
distance of 89.25 feet to a point and the place of BEGINNING.
THIS piece, parcel or lot of land consists of approximately 62,540 square feet of land, and is
known and numbered as Lot No. 165 on the Final Re-Subdivision Plan for Canterbury Estates,
Phases IX and X, which is recorded in Cumberland County in Plan Book 83, Page 91.
UNDER AND SUBJECT TO:
(a) Any and all easements, licenses, exceptions, reservations, covenants, agreements,
conveyances and restrictions which affect the premises and are visible by inspection of
the premises.
(b) Any and all easements, licenses, exceptions, reservations, covenants, agreements,
conveyances and restrictions contained in any and all prior agreements, leases, deeds,
grants and conveyances affecting the premises.
(c) The Declaration of Covenants and Restrictions which is recorded in the Office of the
Recorder of Deeds for Cumberland County in Record Book 679, Page 1916, as may be
applicable to the premises.
BEING the same premises which The McNaughton Company, a Pennsylvania corporation by its
Deed dated April 14, 2005 and recorded in the Office of the Recorder of Deed in and for
Cumberland County, Pennsylvania in Deed Book , Page , granted and
conveyed unto James M. Strong, VI and Carrie Lee Strong, husband and wife,
