D. 2, Newville, Upper Mifflin Township, Cumberland County, pennsylvania, being of sound mind, memory and disposition, do hereby make, publish and declare this my Last will and Testa- ment, hereby revoking and making void all wills by me heretofore I: d .1 ma e. FIRST. I order and direct the payment of all my just debts and 'I funeral expenses as soon as conveniently may be after my decease. SECOND. I direct that my son, DAVID A. SHEELEY, shall have the right to remain on my farm in Upper Mifflin Township, consisting "of approximately sixty (60) acres, for a period of two (2) years after my decease without obligation for rent, but with the obli- gation to pay taxes and keep insurance on the buildings. At any time ,vi thin the two (2) years after my decease I give to my son, DAVID A. SHEELEY, the right to purchase the said farm from the Estate for the sum of NINE THOUSAND ($9,000.00) DOLLARS. I have arrived at the sum of $9,000.00 by taking into consideration the improvements that my said son has placed on the farm at his own expense. THIRD. I give, devise and bequeath all the rest, residue and remainder of my estate, real, personal and mixed, including the ,said farm if my said son does not exercise his right to purchase !the same, among my three children, LAURA E. FINKENBINDER, JENNIE DEE HOCKER, and DAVID A. SHEELEY, absolutely. In the event that any beneficiary of this my Last Will and Testament is a minor, I then give, devise and bequeath said minor's share to the FIRST NATIONAL BANK of Newville, pennsyl- vania, as Guardian, NEVERTHELESS, to invest and re-invest the same during the minority of the said child, with the following powers in addition to those presently given by law: A. The power to expend the income therefrom towards the health, support and maintenance and education, including a college education, for the said minor. B. The power to expend the principal, if the in- come is insufficient, within the discretion of the said Guardian, towards the health, support and maintenance and education, in- cluding a college education, for the said minor. C. The power to distribute the principal and in- come, if any remaining, to the said minor when he reaches the age of twenty-one (21) years without the necessity of a formal adjudication of the Guardian's account in the Orphans' Court, upon receipt of a good and valid release.
