FIRST: I direct that all my just debts and funeral expenses be paid by my Execut or's hereinafter named, as soon after my decease as may be convenient. SECOND: Igive, devise and bequeath such estate that it has pleased God to entrust to me as fOllows, viz: Inheritance and succession taxes and expenses of administration, shall be paid as soon as may be convenient after my decease and interment shall be in the family burial plot in st. John's Cemetary and the grave marked by a head- Stone similer to the others thereon. THIRD:AII the rest, residue and remainder of my estate, real personal or mixed of whatsoever kind and wheresoever situate, which I now or will hereafter hold in Law and Equity and every part and parcel thereOf, I give devise and bequeath unto my beloved wife, Ella Virginia Harper, to hold or dispose of as she may desire, should she survive me. FOURTH: Should my said wife, Ella or any legatee or devisee shall die simttaneously with me or under such circumstances as to render it difficult or impossible to determine who predeceased the other, I hereby declare that I shall be deemed to have survived my said wife and such legatee or divisee and that this "WILL" and all of its provisions shall be construed upon that assumption and basis. FIFTH: Should my said wife Ella and I become deceased at a time simultaneous or should my said wife fail to survive me, then we have both agreed that the following conditions shall exist after we both have become deceased. SIXTH: Should any of our children owe money to us because of advancements or a direct lean, ~the amount of his or her indebtedness shall be subtracted from his or her share of my estate, interest free and should any of said children have not attained the age of thirty years, his or her share of my estate that I have hereon bequeathed unto them shall be invested at best possible interest by the executors until attaining such age with prior advancements only for the completion of higher education. SEVENTH: Unto our Son, William Ford Harper, I bequeath my antique Leman rifle and the DiXie flint lecK rifle. Unto our Daughter Bonnie Anne Harper Kris, I bequeath our Warwick pitcher with matching mugs, and our marble topped table. 229 Unto our Daughter Virginia Lee Harper, I bequeath her mothers diamond and opal rings. SEVENTH: any Q'cl"ler items of personal property in which the surviving children express an interest shall be divided as follows; such items shall be divided into lots, items in each lot equalling the number of surviving children and items in Ibf each lot to be mutually agreeable equal value. Precedence of selection in each lot shall be determined by all the assembled surviving children drawing for high card from a new preVbusly unopened straight card deck with the jokers removed and with a new shuffle and draw for each succeeding lot. EIGHTH: All the rest of my estate. real, personal or mixed shall be sold at a public or private sale and the proceeds after all expenses are paid, shall be divided equally between our said children that survive us and should any of said children fail to survive my said wife and I, then the share of my estate that I have. bequeathed unto such persons shall be given unto such perso~children, share and share alike, and in default of such child or children the said principal sum shall fall into and become a part of my residuary estate to be divied as heretofore stated. NINETH: I nominate, constitute and appoint my wife, Ella Virginia Harper, executrix of this my LAST "WILL" AND TESTAMENT with full power in her discretion to do any and all things necessary for the complete administration of my estate, with full power to sell at public or private sale and without Order of Court all real and personal property belonging to my estate, and to compound, compromise or otherwise to settle or adjust any and all claims, charges, debts and demands whatsoever against or in favor of my estate as fully as I could do if livin~. TENTH: Should my said wife, Ella Virginia, become deceased simultaneously with me or should she predecease me or die within the period of six months after my death, then I nominate, constitute and appoint our Son, William Ford Harper executor of this my LAST "WILL" AND TESTAMENT, with the same powers that I have given unto my said wife, Ella Virginia would have had, had she been executrix.
