Rhoades, hereinafter called the Owner, is about to execute contemporaneously with Henry's Construction of 35 Irish Gap Road, Newville, PA 17241, hereinafter called the Contractor, a contract for the erection or construction of a SINGLE F AMIL Y DWELLING upon the lot of ground known as Lot #4, Plan Book 90, Page 60, being known and numbered 11 Irish Gap Road, Newville, PA 17241, Penn Township, Cumberland County, Pennsylvania, described in Exhibit "A" hereof, of which Jeffrey A. Rhoades and Benicia L. Rhoades are the title holder of record, as more particularly described in Deed from Robert D. Henry, III and Kelly R. Henry to Jeffrey A. Rhoades and Benicia L. Rhoades being dated and recorded even date herewith in the Office of the Recorder of Deeds in and for Cumberland County, PA; and JaobJ, May 19, 2005, at the time of and immediately before the execution of the principal contract, and before any authority has been given by the Owner to the Contractor to commence work on said building or improvement, to purchase materials for the same, it is hereby stipulated and agreed by and between said parties as part of said contract and for the consideration therein set forth, nether the undersigned Contractor, any Sub-contractor or material man, nor any other person furnishing labor or materials to the said Contractor under the contract entered into between said parties shall file a lien for work done or material furnished to said building, improvements or any part thereof. m:bi~ stipulation is made and intended to be filed with the Prothonotary within 10 days after date in accordance with the requirements of the Act of August 24, 1963, P.L. 497, as amended, Jln Witne~~ Whereof, the said parties have hereunto set their hands and seal the day and year aforesaid. Exhibit "A" All that certain lot or piece of ground situate in Penn Township, Cumberland County, Pennsylvania, bounded and described in accordance with a minor subdivision plan for Robert Henry, III, by Larry v. Neidlinger, P>L>S., dated October 14, 2004, revised January 23, 2005, and recorded in Cumberland County Plan Book 90, Page 60, as follows: BEGINNING at an existing spike in the center of Irish Gap Road (T-610) at corner of lands of Alphe Berube as shown on Plan Book 62, Page 130; thence by the center line of the said Irish Gap Road, North 32 degrees 26 minutes 2 seconds West 145.60 feet to a nail at corner of Lot 3 on the hereinbefore mentioned Plan of Lots; thence by the said Lot 3, North 57 degrees 33 minutes 58 seconds East 334.13 feet to an iron pin set on line of lands of Nikki Brooks; thence by land of Nikki Brooks, South 36 degrees 49 minutes 25 seconds East 52.53 feet to an existing iron pin; thence by the same, South 1 degrees 42 minutes 59 seconds West 176.98 feet to an existing iron pin at corner of lands of the said Alphe Berube; thence by said lands of Alphe Berube, South 71 degrees 11 minutes 31 seconds West 166.19 feet to an existing iron pin; thence by the same, South 67 degrees 32 minutes 50 seconds West 80.30 feet to an existing spike, the Place of BEGINNING. BEING Lot 4 on said Plan of Lots and containing 1.2236 acres more or less. Known as and numbered 11 Irish Gap Road, Newville, PA, 17241. BEING part of Tract #2 of land which Wilbur H. Clifton and Elaine S. Clifton, by Deed dated 2/23/05 and recorded in the Office of the Recorder of Deeds in and for Cumberland County, PA, in Deed Book 267, Page 3234, granted and conveyed unto Robert D. Henry, III and Kelly R. Henry. AND BEING the same premises which Robert D. Henry, III and Kelly R. Henry, by Deed dated and recorded even date herewith, granted and conveyed unto Jeffrey a.
