STARNER, of Dickinson Township ~.:2 .',,0 (R.',~. #2, -. 1.- Box Ill, Gardners) Pennsylvania, being of sound and dispo&}!;l.if mind, memory and understanding, do hereby make, publish'a~d deClare this as and for my Last Will and Testament hereby revoking and ~.\dng void any and all wills by me at any time heretofore made. 1. I direct my hereinafter named Executrix to pay all of my just debts and funeral expenses as soon after my death as may be found convenient to do so. 2. All the rest, residue and remainder of my estate, real, personal and mixed and wheresoever the same may be situate, I give, devise and bequeath to my wife, Ruth P. Starner, her heirs and ass igns to the exclusion of my children born and unborn, provided my said wife, Ruth P. Starner, shall survive me by a period of ninety (90) days. 3. Should my said wife, Ruth P. Starner, predecease me or fail to survive me by the aforesaid perIOd of ninety (90) days, then in such event all the rest, residue and remainder of my estate, real, personal and mixed, and wheresoever the same may be situate, I give, devise and bequeath as follows: A. All guns and hunting equipment and fishing equipment which I may own at the time of my death I give and bequeath in equal shares to my three sons, Kenneth A. Starner and Kevin N; Starner and Keane D. Starner, provided each of them shall survive me by a period of ninety (90) days but should any of them fail to so survive me then the share such deceased son would have received shall lapse and said items shall be distributed to my son or sons so surviving me. B. Should my daughter Kim L. Starner survive me by a period of ninety (90) days and should she be unmarried, in such event I direct Page I of 3 Pages 1 ~ ~ ~ , ~ that the house and lot of ground which she occupies with me as our personal residence together with the household goods and furnishings therein contained, shall be retained by her use so long as she shall remaIn unmarried and desire to occupy said premises. During such occupancy she shall be responsible for keeping the same in reasonable repair and carrying fire insurance with extended coverage with reason- able limits of liability and paying all real estate taxes and other expenses incidental to her occupancy. Upon her marriage or decision to cease occupying said premises, her right to use and occupy same shall term- inate and said premises and the household furnishings shall be added to the balance of my estate and be distributed as therein set forth in sub- paragraph "c ". C. The balance thereof shall be divided equally among such of my four children, their heirs and assigns as shall survive me by a period of ninety (90) days, but should any of them fail to survive me by a period of ninety (90) days the share such deceased child would have received shall pass to his or her issue surviving me by a period of nirety (90) days, per stirpes, and if there be no such issue the same shall lapse and be added to the remaining share or shares, per stirpes. My four children are the following: Kenneth A. Starner, Kevin N. Starner, Keane D. Starner and Kim L. Starner. 5. I hereby nominate, constitute and appoint my said wife, Ruth P. Starner as Executrix of this my Last Will and Testament but should she predecease me or fail to qualify, then in such event I nominate, consti- tute and appoint my four children, or any of them, they being Kenneth' A. Starner, Kevin N. Starner, Keane D. Starner and Kim L. Starner as Co- Executors of this my Last Will and Testament and I further direct that neither my said wife nor any child of mine shall be required to post any bond to secure the faithful performance of his or her duties in the Common- wealth of Pennsylvania or in any other jurisdiction.
