COMPLAINT FOR CUSTODY
1. Plaintiff is Shaun K. Lyter, an adult individual whose residence is at 264
Chicken Hollow Road, Newport, Perry County, Pennsylvania.
2. Defendant is Kathy Lynn Lyter, an adult individual whose residence is at
51 Ashford Drive, Enola, Cumberland County, Pennsylvania.
3. Plaintiff seeks custody of his child, Katlyn Sue Lyter, born September 18,
1999, currently residing at 51 Ashford Drive, Enola, Cumberland County, Pennsylvania
17025.
4. The child is presently in the custody of Defendant.
5. Since the child's birth, the child has resided at the following addresses:

6. The relationship of the Plaintiff to the children is that of natural father.
7. The relationship of the Defendant to the children is that of natural mother.
8. The Plaintiff has not participated as a party or in any other capacity, in
other litigation concerning the custody of the child in this or any other Court.
9. Plaintiff has no information of a custody proceeding concerning the child
pending in a Court of this Commonwealth.
10. The Plaintiff as been paying child support pursuant to Cumberland County
Order docketed at 00836S2001, PACSES, Case Number 001103905.
11. The best interest and permanent welfare of the child will be served by
granting the relief requested because the Plaintiff and the child have developed a bond
and the mother has not only been uncooperative with the development of that bond but
has improperly restricted the custody/visitation between parent and child to supervised
settings.
12. Each parent whose parental rights to the child have not been terminated
and the person who has physical custody of the child have been named as parties to
this action. No other persons are known to have or claim to have any right to custody or
visitation of the child other than the parties to this action.
WHEREFORE, Plaintiff requests your Honorable Court grant the Plaintiff request
for shared legal custody and liberal and partial physical custody/visitation of the child.

AND NOW, this /0(' day of July, 2005, upon consideration of the attached
Custody Conciliation Report, it is ordered and directed as follows:
1. The Father, Shaun K. Lyter, and the Mother, Kathy Lynn Lyter, shall enjoy
shared legal custody of Katlyn Sue Lyter, born September 18, 1999.
2. The Mother shall enjoy primary physical custody of the minor child.
3. The Father shall enjoy periods of partial temporary custody of the minor child as
follows:
A. On alternating weekends commencing the weekend of July 8. For the first
three weekends, Father shall enjoy one overnight on alternating weekends with the
overnight to be arranged between the parties. Assuming everything goes well, this
schedule shall expand to two overnights on alternating weekends from Friday
evening at approximately 5:00 until Sunday evening until approximately 6:00. The
parties may modify these time schedules as they agrel~.

4. Assuming the schedule outlined above goes well, it is anticipated that a more
permanent Order will be entered addressing holidays and vacation issues. The
parties can work those out themselves and enter into an Agreement prepared by
their attorneys or, in the alternative, the attorneys for the parties may contact the
Custody Conciliator directly for a telephone conference after which the Conciliator
can recommend a modified Order to the Court.

Conciliation Report, it is ordered and directed that this Court's prior Order of July 14, 2005, is

1. The father, Shaun Karl Lyter, and the mother, Kathy Sue Lyter, shall enjoy shared
custody of Katlyn Sue Lyter, born September 18, 1999.
2. The mother shall enjoy primary physical custody of minor child.
3. The father shall enjoy periods of partial physical custody of the minor child as
follows:
A. On alternating Sundays from noon until 6:00 p.m. unless the parties agn
other times. The parties shall share transportation with an exchange of cus

each other at least fifteen minutes time in case the parties are late, an(
parties are directed to communicate with each other with respect to
transportation issues.
