WHEREAS, George Kaldes and Photini S. Kaldes, husband and wife, of 1219 Highlander Way,
Mechanicsburg, Cumberland County, Pennsylvania 17050, "Owner," are about to contemporaneously
herewith execute a contract with D. Terry Miller and Associates, Inc., "Contractor," whose principal
place of business is located at West Hanover, Dauphin County, Pennsylvania 17112, for the
erection/renovations upon a certain lot of land situate and known as Lot No. 58 as shown on a plan
entitled "Final Subdivision Plan for Phase II and III, Wentworth Estates" dated May 20, 2004, last
revised August 17,2004, Job Number 1001-846, prepared by LSC Design, Inc. York, PA and recorded in
the Cumberland County Office of the Recorder of Deeds in Plan Book 90, Page 17, and which is more
particularly described on Exhibit" A," attached hereto and made a part hereof.
NOW, this 17m day of May, 2005, at the time of and immediately before the execution of the
principal contract, and before any authority has been given by the said Owner to the said Contractor, to
commence work on the said building, or purchase materials for the same in consideration of the making
of the said contract with the Contractor and the further consideration of One ($1.00) Dollar and other
valuable considerations, receipt of which is hereby acknowledged, to the Contractor paid by the Owner,
it is agreed that no lien shall be filed against the building by the Contractor, or any sub-Contractor nor by
any of the material men or workmen or any other person for any labor, or materials purchased, or extra
labor or materials purchased for the erection/renovations to said building, the right to file such liens
being expressly waived.

ALL THAT CERTAIN piece or parcel ofland situate in the Township of Hampden, County of Cumberland
and Commonwealth of Pennsylvania, lying along Pellingham Circle and being approximately 350 feet west
of the easterly intersection of Heatherington Way and Pellingham Circle, bounded and described as follows,
to wit:
BEGINNING at the intersection of the northerly right-of-way line of Pel ling ham Circle (50 feet wide) with
the line of division between Lot 57 and Lot 58; extending (I) thence North 06001 '05" West, a distance of
214.13 feet; extending (2) thence South 80041'12" East, a distance of 134.80 feet; extending (3) thence
South 06001 '05" East, a distance of 178.49 feet to the northerly right-of-way line of Pellingham Circle;
extending (4) thence along said right-of-way line South 83058'55" West, a distance of 130.00 feet to the
point of BEGINNING.
CONTAINING 25,521 square feet or 0.586 acres.
BEING Lot No. 58 as shown on a plan entitled "Final Subdivision Plan for Phase II and III, Wentworth
Estates" dated May 20, 2004, last revised August 17, 2004, Job Number 1001-846, prepared by LSC
Design, Inc. York, P A and recorded in the Cumberland County Office of the Recorder of Deeds in Plan
Book 90, Page 17.
BEING THE SAME PREMISES WHICH Smith Land & Improvement Corporation, a corporation
organized and existing under the laws of the State of Delaware and Kinsley Equities II Limited
Partnership, a limited partnership organized and existing under the laws of the Commonwealth of
Pennsylvania, by Deed dated May 5, 2005 and recorded May 23, 2005 in the Office of the Recorder of
Deeds of Cumberland County, Pennsylvania,
UNDER AND SUBJECT to a Declaration of Restrictions, Covenants and Conditions for Wentworth
Estates Planned Community dated June 3, 2003, and recorded on June 9, 2003, in the Office of the
Recorder of Deeds in and for Cumberland County, in Book 698, Page 599.
FURTIIER UNDER AND SUBJECT to a Declaration Creating and Establishing Wentworth Estates
Homeowners' Association, dated June 3, 2003, and recorded June 9, 2003, in the Office of the Recorder of
Deeds in and for Cumberland County, Pennsylvania, in Book 698, Page 636.
FURTHER UNDER AND SUBJECT, NEVERTHELESS, to all restrictions, conditions, easements and
other matters appearing as of record.
