NOW THEREfORE, THIS AGREEMENT WITNESSETH: That the said Contractor, for and in c.onsideration of
the sum of One {$1-00) Donor to +-11m in hand paid by Owner. the receipt whereof is hereby oc::~
knowledged, and the further consideration mentioned in the agreement aforesoid~ for themselves and their
subcontractors, and all parties acting through or under them, covenant and agree that no mec:hanic's liens
or claims sholl be filed or maintained by them or any of them against the said buildings and the lot of
ground appurtenant thereto for or on account of any work done or materiols furnished by them or any of
them under said contract or otherwise, for, towards, in, or about the erection and construction of the said
buildings on the lot above described, and the said Contractor. for themselves~ their subcontractors and others
under them hereby expressly waive and relinquish the right to have, file, and maintain any mechanic's liens or
claims ogoinst the said buildings or any of them, and agree that thlS instrument, waiving the right of lien,
shaH be an independent covenant.

ALL lHAT CERTAIN tract ofland, situate in Penn Township, Cumberland County,
Pennsylvania, bounded and descn1>ed in accordance with a minor subdivision plan for Robert
Henry, Ill, by Larry V. Neidlinger, Professional Land Surveyor, dated October 14, 2004, revised
January 23, 2005, and recorded in Cumberland County Plan Book 90, Page 60, as follows:
BEGINNING at a nail in the center of Irish Gap Road (T -810) at the comer of Lots 3 and
4 on the hereinbefore mentioned Plan of Lots; thence by the center line of the said Irish Gap Road
(T-810), North 32 degrees 26 minutes 2 seconds West 152 feet to a point being comer of Lot 2
on said Plan; thence by said Lot 2, North 57 degrees 33 minutes 58 seconds East 266.45 feet to
an iron pin set on line oflands ofNikki Brooks; thence by said lands ofNddci Brooks, South 8
degrees 57 minutes 36 seconds East 12.39 feet to an existing iron pin ; thence by the same, North
