L 1 ibensperger is a minor having been born on May 10, 1992. Cavet M. 20 White Oak Tree Road, York Springs, Adams County, Pennsylvania. d her husband, Edwin Leibensperger, are the natural parents of Cavet Leibensperger resides at 3. M. Leibensperger. 4. By deed d ted September 4, 1998 and recorded September 10, 1998 in the Office of the Recorder of Deeds 0 Cumberland County in Deed Book 185, Page 137, a copy of which is attached hereto and inco orated herein by reference as Exhibit "A", Michael F. Baron and Mary A. Baron, the parents 0 Petitioner and grandparents of Cavet M. Leibensperger, conveyed to Petitioner and Cavet M. ibensperger the real estate situate in Upper Allen Township, Cumberland County, Pennsylvania, own as 75 Nittany Drive, Mechanicsburg, Pennsylvania. 5. ent of Sale dated April 13, 2005, Petitioner executed an agreement of sale to sell the above-describe real estate for the sale price of $134,900.00. A copy of said Agreement of Sale is attached hereto and incorporated herein by reference as Exhibit "B". 6. Said sale as negotiated through a licensed real estate agent who had listed and advertised the real estate r sale after performing a market analysis to estimate the fair market value of the property. Petition r consulted with the real estate agent prior to listing the property for sale and prior to executing th Agreement of Sale and believes the contract to be for full and fair value. An affidavit of the real state agent asserting that the sale is for a reasonable and fair price is attached hereto and inco orated herein as Exhbit "C." 7. t purchaser of the real estate is a third party unrelated to Petitioner, Petitioner's husband, or avet M. Leibensperger. 8. The Agre ment of Sale requires final settlement and conveyance of title to be made on or before May 31, 20 5. Final settlement has been scheduled for May 31, 2005. 9. No proc edings for guardianship of Cavet M. Leibensperger have been filed in any county in the Commonw alth of Pennsylvania or in any other jurisdiction. 10. Petitione desires to be appointed Guardian of the Estate of Cavet M. Leibensperger for the purpose of con eying his interest in the above-described real estate and for the further purpose of receiving hi one-half interest in the proceeds of sale and depositing the same in a segregated bank account for his benefit. 11. Petitione anticipates that Cavet M. Leibensperger's one-half interest in the net proceeds of sale will be n excess of $25,000.00. 12. Section 111(b) of the Probate, Estates, and Fiduciaries Code, 20 Pa. C.S.A. g5111(b) permits the ap ointment of a guardian of the estate for a minor by the Orphans' Court in the county in which the sset of the minor is located. 13. The real state is located in Cumberland County, Pennsylvania, thereby establishing jurisdiction for the Orp ans' Court of Cumberland County. 14. Sections 154 and 5155 of the Probate, Estates, and Fiduciaries Code, 20 Pa. C.S.A. gg5154 and 5155 autho 'zes the Orphans' Court to enter an order authorizing the sale of real estate at public or private sale henever it finds it to be in the best interests of the minor. 15. Petitione believes and asserts that the sale of the real estate is in the best interests of the minor because it wil produce proceeds of sale in excess of $50,000.00 which may be placed in a segregated bank acc unt and used for Cavet M. Leibensperger's future educational or other needs. 16. Petitione proposes that one-half of the net proceeds of sale be made payable to "Mary Ilene Leibenspe ger, Guardian of the Estate of Cavet M. Leibensperger per Order of May , 2005" and that a certifi d copy of said Order be served upon the disbursing agent for the sale of the real estate transactio 17. Petition understands and believes that Mark C. Duffie, Esquire, 301 Market Street, Lemoyne, Pennsylvania will be the disbursing agent for the real estate transaction. 18. Petitio er further proposes that a certified copy of said Order accompany the depositing of the chec requiring that the funds be deposited with a federally insured financial institution and that said account be restricted so that no funds may be withdrawn from the account without Court approval ntil such time as Cavet M. Leibensperger attains 18 years of age, with the exception that Petitione may withdraw funds necessary in the year 2006, not to exceed $10,000.00 for the purpose of payin federal and state income taxes owed by Cavet M. Leibensperger by virtue of the sale of real estate. 19. ibensperger, father of Cavet M. Leibensperger has reviewed a draft copy of the within Petition, sign d a Consent to the appointment of Mary Ilene Leibensperger as Guardian of the Estate of Cavet . Leibensperger, and sent by facsimile machine a copy of the Consent as confirmation of his a ment with the contents of the within Petition. The facsimile copy of the Consent is attached here o. 20. Section 122(d) of the Probate, Estates, and Fiduciaries Code, 20 Pa. C.S.A. g51122(d) authorizes th Orphans' Court to dispense with the requirement of a bond when it finds that no bond is necess . The official comments of 1949 suggest that this section was included to encourage practices whi h provide safeguards to protect the funds of the minor. 21. Petitione believes and asserts that the conditions on the granting of the Guardianship suggested herein should provide adequate safeguards for the minor so as to excuse the requirement for the osting of bond. WHEREFORE Petitioner respectfully requests that your Honorable Court enter an Order appointing Mary Ilene ibensperger Guardian of the Estate of Cavet M. Leibensperger, a minor; and authorizing Mary II ne Leibensperger to execute and deliver as Guardian of the Estate of Cavet M. Leibensperger a de d conveying the real estate known as 75 Nittany Drive, Mechanicsburg, Pennsylvania for the c nsideration of $134,900.00, thereby conveying full title of Cavet M. Leibensperger in the s e pursuant to Section 5154 of the Probate, Estates, and Fiduciaries Code, 20 Pa. C.S.A. g5154, fu er conditioning said guardianship on the following: 1. The disb rsing agent for the real estate shall issue a check for one-half of the net proceeds of sale paya e to "Mary Ilene Leibensperger, Guardian of the Estate of Cavet M. Leibensperger per Orde of May ,2005." 2. Mary lie e Leibensperger shall deposit said net proceeds in a savings account with a federally insured fin cial institution. Said account shall be restricted so that no funds may be withdrawn from the ac ount without Court approval until such time as Cavet M. Leibensperger attains 18 years of age, ith the exception that Petitioner may withdraw funds necessary in the year 2006, not to exceed $1 ,000.00 for the purpose of paying federal and state income taxes owed by Cavet M. Leibensperg r. A certified copy of said Order shall be delivered to the financial institution with the net p oceeds check. 3. A certifi d copy of said Order shall be served on Mark C.
