Pechart, is an adult individual who currently resides at 82 Linda Drive, Lot 53, Mechanicsburg, CUlllberland County, Pennsylvania 17050. 2. The Plaintiff, Kennefu L. Pechart, Sr., is an adult individual who currently resides at 82 Linda Drive, Lot 53, Mechanicsburg, Cumberland County, Pennsylvania 17050. 3. The Defendant, Josue Rocky Saez, is an adult individual who currently resides at 901 Fishing Creek Road, Harrisburg, Dauphin County, Pennsylvania. 4. Pechart, Jr. ] 56 Amy Drive Carlisle, P A 17013 200 I-early 2005 The natural mofuer of ilie child is Denise Lena Pechart, deceased, natural daughter of Plaintiffs, Brenda K. Pechart and Kenneili L. Pechart, Sr. The natural fafuer of the child is Josue Rocky Saez, Defendant, currently residing at 901 Fishing Creek Road, Dauphin County, Pennsylvania. The child was born out of wedlock. 5. The relationship of the Plaintiffs to the child is that of natural maternal grandparents. The Plaintiffs currently reside with their son, Kenneth L. Pechart, Jr. The relationship of the Defendant to the child is that of natural father. Father currently is staying with his sister, Evelyn Saez, and her husband and children at their home located at 901 Fishing Creek Road, Harrisburg, Dauphin County, Pennsylvania. 6. Plaintiffs have not participated as a party or witness, or in anofuer capacity, in other litigation concerning fue custody of fue child in this or another court. 7. Plaintiffs do not know of a person not a party to the proceedings who has physical custody of the child or claims to have physical custody or visitation rights wifu respect to fue child. 8. The best interests and permanent welfare of the child will be served by granting the relief requested because: " . (a) Plaintiffs are fue natural maternal grandparents offue child and have developed a relationship wifu her. (b) Plaintiffs desire to continue exercising grandparent roles and enjoying the love and affection ofilie child. (c) The child should be permitted to e~oy fue love, affection, and emotional support provided by her maternal grandparents. (d) Defendant has attempted to alienate the child from Plaintiffs, which is not in the child's best interest, especially in light offue recent untimely death of the child's mofuer, Plaintiffs' daughter on May 14,2005. 9. Each parent whose parental rights to fue child have not been terminated and the person who has physical custody of the child have been named as parties to iliis action. No other persons are known to have or claim a right to custody or visitation of fue child to be given notice of fue pendency of fuis action and fue right to intervene. The maternal Grandparents, Brenda and Kenneth Pechart, shall have periods of partial custody of Cheyarme Dominga Saez on alternating Saturdays from 1 :00 p.m. until 5:00 p.m., beginning July 16, 2005. The Grandparents shall ensure fuat fue Father is informed ofthe contact information and general whereabouts of the Child during periods of custody under this provision. 2. The parties acknowledge that the Child may experience adjustment difficulties in connection wifu the partial custody arrangements and agree to make changes to the duration and timing ofthe schedule as necessary to promote the Child's gradual adjustment and emotional well being. In the event serious difficulties arise in implementation of the partial custody arrangements, fue parties agree to seek the assistance of the psychologist with whom the Child is familiar. 3. This Order is entered pursuant to an agreement of the parties at a custody conciliation conference.
