STIPULATION AGAINST LIENS
THIS AGREEMENT made this 20 ~" day of ~r ' 2005, by and
between ROBERT ,f> SARIANO, d/b/a SARIANO BROTHERS GENERAL
CONTRACTING, hereinafter referred to as Contractor, and ROBERT J. SARIANO and
NANCY SARIANO, hereinafter referred to as Owners, whereby the former undertook
and agreed to erect and construct a single dwelling house on that certain lot of ground
situate in the Township of West Pennsboro, County of Cumberland, Commonwealth of
Pennsylvania, a description of which is attached hereto and more commonly known as
184 Goodyear Road, Carlisle, PA 17013.
NOW THEREFORE, THIS AGREEMENT WITNESSETH; that the said
Contractor, for and in consideration of the sum of One ($1.00) Dollar to the Contractor,
in hand paid by Owner, the receipt whereof is hereby acknowledged, and the further

consideration mentioned in this Agreement aforesaid for themselves and their
subcontractors, and all parties acting through or under them, covenant and agree that
no mechanic's liens or claims shall be filed or maintained by them or any of them
against the said buildings and the lot of ground appurtenant thereto for or on account of
any work done or materials furnished by them or any of them under said contract or
otherwise, for, towards, in or about the erection and construction of the said buildings on
the lot above described, and the said Contractor, for themselves, their subcontractors
and others under them hereby expressly waive and relinquish the right to have, file and
maintain any mechanic's lien or claims against the said buildings or any of them, and
agree that this instrument, waiving the right of lien, shall be an independent covenant.

All that certain tract or parcel of ground, with the improvements thereon erected,
situate in the Township of West Pennsboro, County of Cumberland and State of
Pennsylvania, bounded and described pursuant to the Subdivision Plan for Ben
Elton and Jennifer Morgan Chamberlin, as prepared by Larry V. Neidlinger,
P.L.S., dated June 1, 2001, and recorded December 28, 2001, in the Office of
the Recorder of Deeds in and for Cumberland County, Pennsylvania, in Plan
Book 84, page 84, as follows, to wit:
BEGINNING at a concrete monument on the westernmost side of the
dedicated right of way line of Goodyear Road, (T-440) at the northeast corner of
Lot No. 25 on the aforesaid Plan; thence by said Lot No. 25, South 52 degrees
19 minutes 46 seconds West, 405.50 feet to a point; thence by same, North 37
degrees 40 minutes 14 seconds West, 292.95 feet to a point on line of lands now
or formerly of Larry L. Zinn; thence by said lands now or formerly of Larry L. Zinn,
North 48 degrees 06 minutes 12 seconds East, 403.14 feet to a concrete
monument on the westernmost side of the dedicated right of way line of
Goodyear Road (T-440); thence by said westernmost side of the dedicated right
of way lone of Goodyear Road (T-440), South 37 degrees 58 minutes 11
seconds East, 168.94 feet to a point thereon; thence by same, South 38 degrees
37 minutes 49 seconds East, 153.74 feet to a concrete monument, the place of
BEGINNING.
BEING all of Lot No. 25-A of the aforementioned Subdivision Plan.
