STIPULATION AGAINST LIENS

THIS AGREEMENT made this day of May, 20~, by and
between ROBERT COLDSMITH, hereinafter referred to as Contractor,
AND
JOHN M. HOWARD AND MELINDA A. HOWARD, husband and wife, hereinafter
referred to as Owner, whereby the contractor undertook and agreed
to erected and construct a dwelling on the certain lot of ground
situate in Dickinson Township, Cumberland County, Commonwealth of
Pennsyl vania, and more fully described in Exhibit "A" which is
attached hereto and made a part hereof known as 15 West Yellow
Breeches Road, Carlisle, Cumberland County, PA.
NOW THEREFORE, THIS AGREEMENT WITNESSETH: That the said
Contractor, for an in consideration of the sum of ($1.00) Dollar to
Contractor in hand paid by Owner, the receipt whereof is hereby
acknowledged, and the further consideration mentioned in the
agreement aforesaid, for itself, himself or themselves and its, his
or their subcontractors, and all parties acting through or under
them, covenant and agree that no mechanic's liens or claims shall
be filed or maintained by them or any of them against the said
buildings and the lot of ground appurtenant thereto for or on
account of any work done or materials furnished by them or any of
them under said contract or otherwise, for, towards, in, or about
the erection and construction of the said buildings on the lot
above described, and the said Contractor, for itself, himself or
themselves, its, his or their subcontractors and others under them,
hereby expressly waive and relinquish the right to have, file, and
maintain any mechanic's liens or claims against the said buildings
or any of them, and agree that this instrument, waiving the right
of lien, shall be an independent covenant.

ALL that certain tract of land situate in Township of Dickinson, County of Cumberland
and Commonwealth of Pennsylvania, bounded and described in accordance with a Plan
prepared by Larry V. Neidliuger, R.S. dated November 21, 1994 and recorded in the Office
of the Recorder of Deeds for Cumberland County in Plan Book 69, Page 75, hereinafter
descrihed as follows:
BEGINNING at a nail in centerline of West Yellow Breeches Creek Road at other lands of
Harold Raudahaugh; thence along lands of Harold Raudabaugh North 36 degrees 15
minutes 49 seconds West 225.01 feet to an iron pin set; thence along other lands of Harold
Raudabaugh North 54 degrees 29 minutes 00 seconds East 200.00 feet to an iron pin and
block; thence along Lot No.2 of Harold Raudabaugh Plan as shown on Plan Book 59, Page
129 South 36 degrees 15 minutes 16 seconds East 225.03 feet to a point in centerline of West
Yellow Breeches Creek Road; thence along centerline of West Yellow Breeches Road South
53 degrees 17 minutes 40 seconds West 69.01 feet to a point; thence still along same South
54 degrees 20 minutes 48 seconds West 67.64 feet to a point; thence along same South 55
degrees 56 minntes 42 seconds West 63.35 feet to a nail, the place of BEGINNING.
BEING Lot NO.3 on the abovementioned Plan of Lots.
