Irwin, III, Esquire, and prese~ts this petition to amend the irth record of Nilta Miriam Chacon Olivarria and for the issuance of a new birth certifica e, representing as follows: 1. Petition r is Milta Miriam Chacon Olivarria, now by marriage" Milta Miriam Toro, an adult individ al residing at 1101 Oak Lane, New Cumberland, Cumberland County, Pennsylvania 17070. 2. Petition r was born on November 15, 1959, in Arecibo, Puerto Rico. The name of her father is ablo Chacon and the name of her mother is Angelica Olavarria. The birthplace of both of her parents was also Arecibo, Puerto Rico. A copy of petitioner's birth certi cate, issued November 17, 1959, and a copy of an l'lbstract of the records filed in the D mographic Registry of Puerto Rico, issued July 11, 2002, are incorporated herein b reference and attached hereto as Exhibits "A" and "B", respectively. 3. AT the t me of the inscription of petitioner's name on her birth certificate, the scrivener erroneo sly wrote petitioner's first name as "Nilta" instead of the correct name, "Milta". 4. Petition r has always known her first name to be "Milta" and ~as always used "Milta" as her fi t name, as evidenced by the following documents, cppies of which are incorporate herein and attached hereto as Exhibits: A. P titioner's Marriage Certificate (Exhibit "C"); B. P titioner's PSECU Bank Account (Exhibit "0"); C. P titioner's Social Security Statement (Exhibit "E"); D. P titioner's Tax Return (Exhibit "F"); and E. P titioner's W-2 Form (Exhibit "G"). 5. Petition rwas married to Gerardo Toro on June 28,1980, in' Harrisburg, Dauphin County, Pen sylvania, and thereafter assumed the name Milta Miriam Toro. 6. Petition r and her husband have been residents of Cumberlclmd County, Pennsylvania for mor than six months. 7. Petition r was not aware of the error on her birth certificate 4ntil recently when she applied for copy of her birth record so that she could obtain a passport for travel to the Caribbea this Winter. She was unable to obtain a passport ~ecause the name on her birth rec rd is incorrect and does not conform to her name as identified on all of her other official records and documentation. , 8. Petition r does not wish to change her name, but only to cOl1rect the spelling of her name n her original birth certificate and to have a new birth certificate issued in the correct ame so that the records accurately reflect her actual name and so that she can then obt in a valid U.S. passport. 9. r has attempted to do so informally by written reqUElst through her counsel; however, 0 September 4, 2002, the Demographic Registry of ~uerto Rico advised petitioner's unsel that it would not correct the official records without an Order of Court. A copy of sa d notice is incorporated herein and attached hereto as Exhibit "H".
