COMPLAINT
1. Plaintiffs Christopher J. Kambic and Joanne M. Kambic are husband and
wife and reside at 625 Davis Drive, New Cumberland, Pennsylvania 17070.
2. Defendant Linda A. Buckwalter is believed to be residing at 6 Crescent
Court, New Cumberland, Pennsylvania 17070.
3. On November 4,2003 at approximately 3:00 p.m., Plaintiff Christopher 1.
Kambic was operating his motor vehicle lawfully traveling south on Allen Street, approaching its
intersection with Park Avenue, in the Borough of New Cumberland, Pennsylvania.
4. At approximately the same time, Defendant Buckwalter was operating her
motor vehicle west on Park A venue, approaching its intersection with Allen Street.
5. The intersection of Park Avenue and Allen Street consists of a two-way
stop for travelers on Park A venue and is posted with stop signs. Allen Street is a through street
with no stop signs.
6. At the aforementioned time and place, as PlaintiffKambic's vehicle
entered the intersection of Park Avenue and Allen Street, the vehicle operated by Defendant
Buckwalter entered the intersection without completing a lawful stop and violently collided with
the vehicle being operated by Plaintiff Kambic.
7. The resultant collision caused Plaintiff Christopher 1. Kambic to suffer
serious personal i~uries which include, but are not limited to a herniation of the cervical disc at
C5-6 and a herniation of the cervical disc at C6-7, as well as suffering pain in the neck, left arm,
fingers ofthe left hand, numbness in the left hand and fingers, as well as general pain and
emotional distress.
8. As a result of the injuries sustained by Plaintiff Christopher J. Kambic,
Plaintiff was required to undergo an anterior cervical discectomy and fusion of C5-6, C6-7 with
allograft bone and plate.
9. At the aforementioned time of the accident, Plaintiffs Christopher J.
Kambic and Joanne M. Kambic were covered by a policy of motor vehicle insurance in which
they had elected the full-tort option.

10. Paragraphs I through 9 are incorporated herein by reference as if fully set
forth herein.

II. The injuries sustained by Plaintiffs were solely caused by the negligence,
recklessness and wanton actions of Linda A. Buckwalter which include, but are not limited to,
the following acts and omissions:
a. violation of the Pennsylvania Motor Vehicle Code, 75 Pa. C.S.A. Section
3323(b );
b. failing to come to an complete stop at an intersection controlled by a stop
SIgn;
c. ignoring a traffic control sign (stop sign) and thereupon failing to stop;
d. failing to properly yield to traffic;
e. failing to observe and yield to traffic lawfully entering an intersection;
f. recklessly and wantonly ignoring traffic lawfully entering the intersection and
failing to yield thereby;
g. failing to observe Plaintiff's vehicle lawfully entering the intersection; and
h. violently striking Plaintiff's lawfully operated motor vehicle after failing to
lawfully stop at the aforementioned intersection.
12. As a result of the aforementioned negligence, recklessness and wanton
behavior of Defendant, Plaintiffs continue to suffer injuries, pain and suffering and emotional
distress.
WHEREFORE, Plaintiff Christopher J. Kambic and Joanne M. Kambic
request this Honorable Court to enter judgment in their favor and against Defendant Linda A.
Buckwalter.

13. Paragraphs 1 through 12 are incorporated herein by reference as if fully set
forth herein.
14. As a result of the negligence, recklessness and wanton actions and/or
omissions of Defendant Linda A. Buckwalter, Plaintiff Joanne M. Kambic has suffered a loss of
consortium, companionship, society, and general life's pleasures.
WHEREFORE, Plaintiffs Christopher J. Kambic and Joanne M. Kambic request
this Honorable Court to enter judgment in their favor and against Defendant Linda A.
Buckwalter.
