I, MARGARET T. SHEAFFER, of 14 Paddock Lane, Camp
Hill, Pennsylvania, being of sound mind, memory and
understanding, do hereby make, publish and declare this
to be my Last Will and Testament, hereby revoking any and
all Wills by me heretofore made.
FIRST: I direct payment of the expenses of my last
illness, funeral and burial costs from my residuary
Estate, as an expense of my Estate, as soon after my
death as conveniently may be done. All Federal, State
and other death taxes payable because of my death, with
respect to the property forming my gross Estate for tax
purposes, whether or not passing under this Will,
incll1ding any interest 0:( penalty imposed in connection
with such tax, shall be considered a part of the
administration of my Estate and shall be paid from my
residuary Estate without apportionment or right to
reimbursement.
SECOND: I give and bequeath my automobiles,
furniture, household goods, and personal effects, if any,
and other tangible personalty of like nature, not
including cash or securities, together with any existing
insurance to two of my children: PATRICIA JANE HETRICK
and RONALD LEE SHEAFFER, in equal shares, share and share
alike.
THIRD: All the rest, residue and remainder of my
estate, whether real, personal or mixed, of which I shall
die seized and possessed, and to which I may be entitled
at the time of my decease, and wheresoever the same may
be situate, I give, devise and bequeath to two of my
children: PATRICIA JANE HETRICK and RONALD LEE SHEAFFER,
in equal shares, share and share alike.
In the event Patricia Jane Hetrick fails to survive
me, I give, devise, and bequeath her share to her issue,
per stirpes.

me, I give and bequeath my entire estate to Patricia Jane
Hetrick.
I add here as way of clarification that the
ommission of any reference in this will to my third child
is not the result of any oversight.
FOURTH: In addition to all powers granted by law,
I give my Co-Executors, hereunder, the following powers,

and to invest in all forms of real and personal property;
to compromise claims and to abandon any property which is
of little or no value, if deemed appropriate to my
Co-Executors; to sell at public or private sale, to
exchange, or to lease for any period of time, any real or
personal property, or interest therein, and to give
option for sales or leases, and to give a good deed of
conveyance or bill of sale for the transfer thereof; to
allocate any property received or charge incurred to
principal or income or partly to each, without being
obliged to apply the usual rules of Trust accounting; to
distribute in cash or in kind (according to the fair
market value prevailing at the time of distribution) or
partly in each.
FIFTH: I nominate, constitute and appoint PATRICIA
JANE HETRICK and RONALD LEE SHEAFFER as Co-Executors of
this my Last Will and Testament and my Estate. In the
event one is unable or unwilling to serve, then I
nominate, constitute and appoint the other to serve
solely.
SIXTH: I direct that no Executor (trix) acting
under this Will shall be required to enter bond for the
faithful performance of duties, in any jurisdiction.

STIPULATION
AND NOW, comes the Petitioner, Patricia J. Hetrick, by and through her attorney, Francis
A. Zulli, and the Respondent, Ronald L. Sheaffer, who stipulate and agree as follows:
1. On or about January 29,2002 the Petitioner, Patricia J. Hetrick, filed a Petition requesting
payment of the family exemption to her.
2. On or about February 7,2002 the Honorable George E. Hoffer, President Judge, entered a
Rule to Show Cause why payment of the family exemption should not be made to the Petitioner.
3. On or about February 25,2002 the Respondent, Ronald L. Sheaffer, filed an Answer to
the Petition requesting the payment of the family exemption.
4. Petitioner and Respondent have agreed that payment of the family exemption shall be
made to Patricia J. Hetrick.
5. Petitioner and Respondent, as Co-Executors of the Estate of Margaret T. Sheaffer, have
issued a check to the Petitioner in payment of the family exemption.

PETITION FOR ORDER DIRECTING PAYMENT
OF FAMILY EXEMPTION
TO THE HONORABLE JUDGES OF THE SAID COURT:
The Petition of Patricia Jane Hetrick, by and through her attorney, Francis A. Zulli,
Esquire, respectfully states as follows:
1. The decedent, Margaret T. Sheaffer, died on August 28,2001 a resident of 14
Paddock Lane, Camp Hill, East Pennsboro Township, Cumberland County, Pennsylvania
17011.
2. Your Petitioner, Patricia Jane Hetrick, who resides at 14 Paddock Lane, Camp
Hill, East Pennsboro Township, Cumberland County, Pennsylvania is the daughter of the
decedent and formed a part of the decedent's household at the date of the decedent's death.
3. The decedent left a Will, duly probated in the Office of the Register of Wills of
Cumberland County. Letters Testamentary were granted to Patricia Jane Hetrick and
Ronald Lee Sheaffer, daughter and son of the decedent.
4. The names, relationships and addresses of those individuals named as
beneficiaries and next of kin of the decedent are as follows:
(a) Patricia Jane Hetrick, 14 Paddock Lane, Camp Hill, PA 17011;
(b) Ronald Lee Sheaffer, 1605 North Front Street, Harrisburg, PA 17102.
5. The decedent, in her Last Will and Testament, in Item Third provided that all the
rest, residue and remainder of her estate would be equally distributed to her daughter,
Patricia Jane Hetrick, and her son, Ronald Lee Sheaffer.
6. Your Petitioner avers that at the time of decedent's death, she was the owner of
various items of tangible personal property, an automobile and approximately $89,000.00 in
bank accounts.
7. Your Petitioner avers that the debts of the decedent at the time of her death were
less than $8,000.00.
8. Your Petitioner has claimed the family exemption of$3,500.00 in writing by
providing a claim for family exemption dated January 3,2002, a copy of which is attached
hereto as Exhibit "A", to Ronald Lee Sheaffer and Patricia Jane Hetrick, Co-Executors of
the Estate of Margaret T. Sheaffer.
9. Petitioner's counsel, Francis A. Zulli, Esquire, had previously forwarded a letter
dated January 4,2002 to Ronald Lee Sheaffer, Co-Executor, requesting payment of the
family exemption to his sister, Patricia Jane Hetrick. See copy of letter dated January 4,
2002 attached hereto as Exhibit "B".

10. Your Petitioner avers that Ronald Lee Sheaffer, Co-Executor, has refused to pay
the family exemption to his sister, your Petitioner, Patricia Jane Hetrick.
WHEREFORE, your Petitioner respectfully requests the issuance of a citation
directed to Ronald Lee Sheaffer, Co-Executor, to show cause why he should not be ordered
to make immediate payment to Patricia Jane Hetrick of the family exemption of$3,500.00
payable in cash, as provided in Section 3121 of the Probate, Estates and Fiduciaries Code.

11. The above answers to the paragraph 1-10 are incorporated as set forth in their
entirety .
12. I, Ronald L. Sheaffer, and Patricia J. Hetrick, are Co-Executors of the Decedent's
Estate.
13. As a Co-Executor of my Mother's Last Will and Testament, it is my duty to follow
the language of her Will.
14. I aver that our Mother, Margaret T. Sheaffer, in July of 1997, while she resided
with your Petitioner, Patricia 1. Hetrick, under undue pressure by the Petitioner, changed
her Will, eliminating her eldest son, George Sheaffer.
15. I aver that your Petitioner, Patricia J. Hetrick, is now trying to undermine my
authority as co-executor, to benefit herseH: as she did as stated in the previous statement.
16. I aver that as far back as August, 2001, your Petitioner, Patricia 1. Hetrick, was
advised by our Mother's Attorney, Walter L. Cressler Jr., of Newport, Perry County,
Pennsylvania, that your Petitioner as Power of Attorney was required to complete an
accurate inventory of all tangible items, she removed from Mother's residence of 51 0
Grant Drive, Camp Hill, PA 17011.
17. I aver that on Friday August 24,2001, (4) days prior to our Mother's passing, your
Petitioner removed tangible assets from Mother's residence of510 Grant Drive, including
a bedroom suite that she will not include in Mother's Estate.
18. I aver that after August 28,2001, your Petitioner, entered Mother's residence of
510 Grant Drive and removed all of Mother's clothing, artwork, jewelry, and other misc.
tangible assets and refuses to include these items as part of Mother's Estate.
19. I aver that an estimate of all tangible items that your Petitioner has not included in
Mother's Estate exceeds $8,000.00.
20. I aver that the care of our Mother was a shared duty between your Petitioner and
myself.
21. I aver the dates of my care-giving were as follows: Immediately after the release of
Margaret T. Sheaffer, from the hospital, Tuesday April 17, 2001 until Wednesday May 2,
2001, then Friday May 18,2001 to Wednesday June 6, 2001, then Thursday June 28,
2001 until Monday July 9, 2001.
22. I aver that the dates of your Petitioner's care-giving were as follows: Wednesday
May 2,2001 until Friday May 18, 2001, then Wednesday June 6, 2001 until Thursday
June 28, 2001, and Monday July 9, 2001 until the passing of our Mother, August 28,
2001.
23. I aver that after the return from a vacation with Mother, on July 9, 2001, that it
was agreed between your Petitioner, myself: and for the well-being of Mother, that she
stay at your Petitioner's home of 14 Paddock Lane, Camp Hill, P A, so as not to confuse
and inconvenience the care-givers of Hospice and the Visiting Nurses.
24. I aver the Paragraph's 20-23, show that responsibilities of care-giving were equally
shared.
25. I aver that due to the above Paragraph's 20-24, the Family Exemption is not
payable to just one Co-Executor.
26. I aver your Petitioner has not justified the relief desired.
27. I aver that in my research in matters concerning Family Exemption, it is my
understanding that the claim cannot be made in cash and in excess tangible assets at an
estimated value of $8,000.00; it is either one or the other when applied.
28. I aver that when the Exemption is claimed in cash, then all tangible assets must be
appraised.
29. As of this date, I do not have a complete inventory or appraisal of tangible assets
that your Petitioner has removed from our Mother's residence of 51 0 Grant Dr.
30. As to this date, Mother's automobile in your Petitioner's possession, has not been
advertised for sale or sold.
31. As of this date, according to your letter of December 20, 2001, with your
Petitioner agreeing to return the gifts of sentimental value, that I gave to my Mother
during her lifetime, have still not been returned, and, hopefully, are still in your Petitioner's
possession, (Paragraph 1, Exhibit B).
32. According to your letter of January 4, 2002, Paragraph 4 (your Exhibit B), and my
acknowledgement of said letter of January 10, 2002, Paragraph 2 (Exhibit A), we both
concur concerning such an appraisal. To this date, your Petitioner has not co-operated.
33. I aver our Mother never legally changed her legal mailing address of510 Grant
Drive, Camp Hill, P A. 17011.
34. I aver that as of Thursday February 14, 2002, our Mother's address was never
changed from 510 Grant Drive, Camp Hill, P A. 17011.
35. I aver that as of Friday February 15, 2002, the U.S. Postal Service, Camp Hill
Branch advised me, Ronald L. Sheaffer, to change our Mother's address to a responsible
person in charge of her affairs. Thus, our Mother's forwarding address is 1605 North
Front Street, Harrisburg, PA. 17102, Apt.# 4, c/o Ronald L. Sheaffer.
36. I aver that the Family Exemption, is a law of good merit, when it is deserved, (not
just because the Decedent died in your Petitioner's residence).
WHEREFORE, as Co-Executor, I deny the request of payment in cash for Family
Exemption, to your Petitioner, Patricia J. Hetrick, Co-Executor, for the reason that our
Mother was never a resident of 14 Paddock Lane, Camp Hill, P A. 17011, and we were
both equal care-givers to our late Mother, and both of us have a responsibility and duty, as
Co-Executor's, to honor and fulfill our Mother's wishes as set forth in her last Will and
Testament. For neither one of us, had the right to change this. Therefore, I, Ronald L.
Sheaffer, request that the Petition for Family Exemption by Petitioner, Patricia J. Hetrick,
be dismissed.

This is an acknowledgement of your letter of January 4, 2002.
It is my understanding that the Provisions of Section 3121 of the Pennsylvania Probate
Code, "Family Exemption", require a justification for paYment, and must be approved.
Therefore it seems unjustifiable for me to designate the "Family Exemption" by signing a
check at this time.
I agree with you that all items in the possession of either my sister or myself should be
appraised. I have had the tangible assets in my possession, appraised by qualified
appraisers. I would also expect the same from my sister, since according to paragraph #4
of your letter, Patricia is not a qualified appraiser.
The inventory prepared by Patricia is still incomplete of all of my Mother's tangible
assets in her possession. According to Mother's Will, all assets are to be divided equally
between my sister and myself. If there is no written designation of such gifts, I am bound
by Mother's Will.
According to your letter of December 20,2001, you had instructed Patricia to make
my gifted jewelry available at your office Thursday December 27, or Friday December 28,
2001. To the present, this issue has not been addressed.

The other day I had an opportunity to speak with your sister regarding the
settlement of your mother's estate. I have advised your sister that she is entitled to claim
a family exemption in accordance with Section 3121 of the Pennsylvania Probate Code. I
am enclosing a copy of the relevant portions of the code for your review. She has agreed
to return the rings that you hav€: requested and I have instructed her to drop off those
rings at my office as soon as possible. My office will be closed Monday and Tuesday of
next week, therefore I anticipate that your sister will have the rings available on Thursday
or Friday of next week.
She would like to retain the automobile, therefore she has agreed to pay you one
half of the value of that automobile which had a private party value sale of$2,375.00.
Each party would retain all tangible personal items of your mother's estate now in the
respective parties possession. An inheritance tax return would be prepared, filed \vith th(~
court and payment would be lllade on the inheritance taxes that are due on the ::l~sets in
the estate. I would be more than happy to meet with you to prepare this inheritance tax
return. I would suggest that any additional expenses that have been incurred by either
party relative to this estate should be provided to me.
Upon preparation of the inheritance taxes, the balance remaining in the estate
account after payment of the family exemption, e~penses, and inheritance taxes \vi11 be
divided equally between the two of you. Please advise me if you are in agreement with
this settlement proposal.

I, MARGARET T. SHEAFFER, of 14 Paddock Lane, Camp
Hill, Pennsylvania, being of sound mind, memory and
understanding, do hereby make, publish and declare this
to be my Last Will and Testament, hereby revoking any and
all Wills by me heretofore made.
FIRST: I direct payment of the expenses of my last
illness, funeral and burial costs from my residuary
Estate, as an expense of my Estate, as soon after my
death as conveniently may be done. All Federal, State
and other death taxes payable because of my death, with
respect to the property forming my gross Estate for tax
purposes, whether or not passing under this Will,
including any interest 0:1: penalty imposed in connection
with such tax, shall be considered ~ part of the
administration of my Estate and shall be paid from my
residuary Estate without apportionment or right to
reimbursement.
SECOND: I give and bequeath my automobiles,
