COMPLAINT IN EJECTMENT
Plaintiff, Community Banks, by the firm of Saidis, Shuff, Flower & Lindsay, P.C., in the
person of Matthew J. Eshelman, Esquire, brings the following Action in Ejectment pursuant to
Pa. R.C.P. No. 1051 et seq., and in support thereof, avers in the following Complaint:
COUNT I-EJECTMENT
1. Plaintiff, Community Banks, is the owner of record of a parcel of real estate having
erected thereon a residential dwelling known and numbered as 245 North 25th Street, Camp Hill,
Pennsylvania 17011 (the "Property"), as more particularly described in the Legal Description and
the Abstract of Title attached hereto as Exhibit "A" and incorporated herein by reference, having
purchased the same at a Sheriffs Sale on March 2, 2005, pursuant to Writ No. 2003-2950 Civil
Term, the deed for which has been recorded on or about May 25,2005, at Deed Book 269, Page
40, in the Office of the Recorder of Deeds in and for Cumberland County, a copy of which is
attached hereto as Exhibit "B" and incorporated herein by reference.
2. Defendants Gordon K. Banzhoff, Jr., and Nancy S. Banzhoff are adult individuals.
3. Defendant Gordon K. Banzhoff, Jr., is believed to be residing at and in possession of
the Property. It is believed that Defendant Nancy S. Banzhoff is no longer residing at the
Property.
4. Written notice to vacate the premises and demand for rental for the home was sent
addressed to the Property on or about April 7, 2005, a true and correct copy of which is attached
hereto as Exhibit "C" and which is incorporated herein by reference.
5. Defendants have failed and refused to vacate the Property as ofthis date.
WHEREFORE, Plaintiff requests that this Court enter judgment in favor of Plaintiff and
against Defendants Gordon K. Banzhoff, Jr., and Nancy S. Banzhoff for possession of the
Property known and numbered as 245 North 25th Street, Camp Hill, Pennsylvania 17011, and such
other relief as the Court may deem appropriate.
COUNT 11- LOSS OF RENTAL INCOME
6. Paragraphs 1-5 inclusive are incorporated herein by reference as though here set forth
at length.
7. Plaintiff claims unliquidated damages in an amount equal to the fair market rental
value of the Property from March 2, 2005, through and including the date of ejectment/vacation
of the Property for the use and occupancy of the Property.
8. The monthly fair market rental value of the Property is $800.00.
WHEREFORE, Plaintiff requests that this Court enter judgment in favor of Plaintiff and
against Defendant Gordon K. Banzhoff, Jr., in the amount of $800.00 per month from March 2,
2005, through and including the date of ejectment ofthe Property, which amount is less than that
requiring referral to arbitration by local rule, plus costs and interest on the judgment, and such
other relief as the Court may deem appropriate.

DESCRIPTION
The land referred to in this Commitment is described as follows:
ALL THAT CERTAIN lot or parcel ofland situate in the Borough of Camp Hill, County of Cumberland and State
of Pennsylvania, more particularly bounded and described as follows, to wit:
BEGINNING at a point, the intersection of the easterly line of North TwentyMFifth Street, formerly Locust Avenue,
with the southerly line of Lincoln Street; thence north 79 degrees 30 minutes east along the southerly line of Lincoln
Street, a distance afone hundred forty (140) feet to a point on St. John's Alley; thence south 10 degrees 30 minutes east
along the westerly line of St. John's Alley, a distance of eighty (80) feet to a point; thence south 79 degrees 30 minutes
west along the northerly line of Lot No, 42, Section "E" on the hereinafter mentioned Plan of Lots, a distance of one
hundred forty (140) feet to a point on the easterly line of North Twenty-Fifth Street, formerly Locust Avenue; thence
north 10 degrees 30 minutes west, along-the easterly line of North Twenty~Fifth Street, formerly Locust Avenue, a dis-
tance of eighty (80) feet to a poin~ the place of BEGINNING.
HAVING thereon erected a two-story brick dwelling house, No. 245 North Twenty.Fifth Stree~ Camp Hill,
Pennsylvania,
BEING Lots Nos. 38, 39, 40 and 41, Section "E" on a Plan of Lots laid out by Arthur B. Rupley and Celeb S.
Brinton, and known as Plan No, 2, First Addition to the Borough of Camp Hill. Said Plan being recorded in the
Recorder's Office in and for Cumberland County, in Plan Book No.1, Page 5,
BEING the same as surveyed by William B. Whitlock, R.P.E., dated August 13, 1962.
BEING the same premises which Ernest D, Latham and Dorothy H. Latham, his wife, by Deed dated August 15,
1962 and recorded in the Office of the Re-corder of Deeds in and for Cumberland County, Pennsyl-vania, in Deed
Book 20-P, page 573, granted and conveyed unto Mary L. Banzhoff and Gordon K. Banzhoff, her husband.

On March 2,2005 Community Banks purchased the property in which you live at a
Sheriff's Sale conducted at the Cumberland County Court House. As you know, the Bank:
was the executing party of that sale. You must vacate the property no laterthan April 24,
2005 or the Bank will have to initiate eviction proceedings. As you currently continue to
reside in the premises, please send to my attention rental for the home in the amount of
$800 to cover the month of April.
Please notifY me immediately upon vacating the home so it can be properly secured and
cleaned. Please call me to discuss this in greater detail should you have any questions.
