Your petitioner is 18 years of age or older and the Executrix named in the last will of the above
decedent, dated August 31, 1998 and codicil(s) dated [none].
Decedent was domiciled at death in Cumberland County, Pennsylvania, with her last family or
principal residence at Thornwald Home, 442 Walnut Bottom Road, Carlisle Borough.
Decedent, then 83 years of age, died September 11,2001, at Thornwald Home, 442 Walnut

Except as follows, decedent did not marry, was not divorced and did not have a child born or

LAST WILL AND TESTAMENT
I, BETTY J. FRITZ, of the Borough of Carlisle, Cumberland County, Pennsylvania, being
of sound and disposing mind and memory, do hereby make, publish and declare this to be my Last
Will and Testament, hereby revoking any and all former Wills or Codicils by me made.
1.
I direct that all my legally enforceable debts, funeral expenses, testamentary expenses and all
inheritance taxes (whether such taxes may be payable by my estate or by any recipient of any
property) shall be paid from my residuary estate as soon as practicable after my decease and as part
of the administration of my estate. My personal representative shall have no duty or obligation to
obtain reimbursement for any such tax so paid, even though on proceeds of insurance or other
property not passing under this Will.
2.
I give the sum of$l,OOO.OO to ROSE ANN FRITZ.
3.
I give all of my household furnishings, furniture, jewelry and other personal belongings to my
sister, JEANNETTE G. BURGETT, absolutely.
4.
All of the rest, residue and remainder of my estate, of whatever nature, I give, devise and
bequeath as follows:
a. One-half (1/2) thereof unto my sister, JEANNETTE G. BURGETT, absolutely.
b. The remaining one-half (1/2) thereof shall be divided equally among MARK ALLEN
WISE, TRACY WISE KOVACEVIC and RYAN M. KOVACEVIC, absolutely.
5.
In the event the said JEANNETTE G. BURGETT shall predecease me or fail to survive me
by more than thirty (30) days, then her share shall be distributed equally to MARK ALLEN WISE,
TRACY WISE KOV ACEVIC and RYAN M. KOV ACEVIC. In the event any of said last mentioned
beneficiaries shall predecease me, his or her share shall pass to the surviving beneficiaries in Paragraph

6.
I nominate, constitute and appoint my sister, JEANNETTE G. BURGETT as Executrix of
my estate. In the event JEANNETTE G. BURGETT shall be unable or unwilling to serve in such
capacity, then I appoint ROBERT SHRAWDER and F. WILLIAM GREGORY to act in such
capacity.
7.
I nominate, constitute and appoint TRACY WISE KOVACEVIC as Guardian of the estate
ofRYANM. KOVACEVIC.
8.
I direct that my personal representative( s) shall not be required to file a bond to secure the
faithful performance of their duties in any jurisdiction.
9.
I authorize and empower my personal representative( s), in their sole and absolute discretion,
to purchase or otherwise acquire and retain any investments of which I die seized or any real or
personal property of any nature; to sell, lease, pledge, mortgage, transfer, exchange, dispose of or
grant options in regard to any or all property of any kind forming a part of my estate for such terms
and such prices as they may deem advisable; to borrow money for any purposes connected with the
protection and preservation of my estate; to mortgage or pledge any real or personal property forming
a part of my estate or to join in or secure the partition of same; to compromise any claims or demands
of my estate against others or of others against my estate; to make distribution in kind and to cause
any share to be composed of cash, property or undivided fractional shares in property different in kind
from any other share; to employ agents, attorneys and proxies and to delegate to them such power
as my personal representative(s) consider desirable and to pay reasonable compensation for such
services as may be rendered by such agents, attorneys and proxies; and to execute and deliver such
instruments as may be necessary to carry out any of these powers. In addition, I direct that my
personal representative( s) shall have the power to conduct an inventory of any safe deposit box
necessary to the administration of my estate.

I, BETIY J. FRITZ, of the Borough of Carlisle, Cumberland County, Pennsylvania, being
of sound and disposing mind and memory, do hereby make, publish and declare this to be my Last
Will and Testament, hereby revoking any and all former Wills or Codicils by me made.
1.
LAST WILL AND TESTAMENT
I direct that all my legally enforceable debts, funeral expenses, testamentary expenses and all
inheritance taxes (whether such taxes may be payable by my estate or by any recipient of any
property) shall be paid from my residuary estate as soon as practicable after my decease and as part
of the administration of my estate. My personal representative shall have no duty or obligation to
obtain reimbursement for any such tax so paid, even though on proceeds of insurance or other
property not passing under this Will.
2.
I give the sum of$I,OOO.OO to ROSE ANN FRITZ.
3.
I give all of my household furnishings, furniture, jewelry and other personal belongings to my
sister, JEANNETTE G. BURGETT, absolutely.
4.
All of the rest, residue and remainder of my estate, of whatever nature, I give, devise and
bequeath as follows:
a. One-half (] /2) thereof unto my sister, JEANNETTE G. BURGETT, absolutely.
b. The remaining one-half (1/2) thereof shall be divided equally among MARK ALLEN
WISE, TRACY WISE KOVACEVIC and RYAN M. KOY ACEVIC, absolutely.
5.
In the event the said JEANNETTE G. BURGETT shall predecease me or fail to survive me
by more than thirty (30) days, then her share shall be distributed equally to MARK ALLEN WISE,
TRACY WISE KOY ACEVIC and RYAN M. KOY ACEVIC. In the event any of said last mentioned
beneficiaries shall predecease me, his or her share shall pass to the surviving beneficiaries in Paragraph

I nominate, constitute and appoint my sister, JEANNETTE G. BURGETT as Executrix of
my estate. In the event JEANNETTE G. BURGETT shall be unable or unwilling to serve in such
capacity, then I appoint ROBERT SHRAWDER and F. WILLIAM GREGORY to act in such
capacity.
7.
I nominate, constitute and appoint TRACY WISE KOVACEVIC as Guardian of the estate
of RYAN M. KOVACEVIC.
8.
I direct that my personal representative(s) shall not be required to file a bond to secure the
faithful performance of their duties in any jurisdiction.
9.
I authorize and empower my personal representative(s), in their sole and absolute discretion,
to purchase or otherwise acquire and retain any investments of which I die seized or any real or
personal property of any nature; to sell, lease, pledge, mortgage, transfer, exchange, dispose of or
grant options in regard to any or all property of any kind forming a part of my estate for such terms
and such prices as they may deem advisable; to borrow money for any purposes connected with the
protection and preservation of my estate; to mortgage or pledge any real or personal property forming
a part of my estate or to join in or secure the partition of same; to compromise any claims or demands
of my estate against others or of others against my estate; to make distribution in kind and to cause
any share to be composed of cash, property or undivided fractional shares in property different in kind
from any other share~ to employ agents, attorneys and proxies and to delegate to them such power
as my personal representative(s) consider desirable and to pay reasonable compensation for such
services as may be rendered by such agents, attorneys and proxies; and to execute and deliver such
instruments as may be necessary to carry out any of these powers. In addition, I direct that my
personal representative( s) shall have the power to conduct an inventory of any safe deposit box
necessary to the administration of my estate.

ALL that certain lot of ground situate in the Borough of Carlisle, County of
Cumberland and State of Pennsylvania, the same being bounded and described as
follows, to-wit:
BEGINNING at a point on West Louther Street, on line oflot now or formerly of
Mrs. Ellen Kistler; thence Eastward along said Louther Street, 23 feet, more or less,
to a point on the line running through the center of the division wall or partition
separating the Western dwelling house from the Eastern dwelling house of a double
house erected on the plot of ground of which the part herein conveyed was a part;
thence along the center of said division wall or partition by lands formerly belonging
to John Y. Bucher, deceased, now or formerly of Robert L. Bay, in a straight line
Northward, 107 feet 9 inches to a twelve foot alley; thence along said alley Westward
23 feet, more or less, to the line of lot now OT formerly of Mrs. Ellen Kistler; thence
along the line of said lot now or formerly of Mrs. Ellen Kistler, Southward 107 feet
9 inches to a point on said West Louther Street, the place of BEGINNING.
IT BEING the same lot of ground which Betty 1. Fritz and George W. Fritz, her
husband, by their deed bearing date the 27th day of January, 1944, said deed being
entered of record in the Office of the Recorder of Deeds in and for Cumberland
County, Pennsylvania, in Deed Book "U', Volume 12, Page 8, granted and conveyed

apply to the afore-described tract ofland, recorded or unrecorded.
THIS DEED IS A CONVEYANCE FROM SISTER TO SISTER AND IS

I, BErrY J. FRITZ, of the Borough of Carlisle, Cumberland County, Pennsylvania, being
of sound and disposing mind and memory, do hereby make, publish and declare this to be my Last
Will and Testament, hereby revoking any and all former Wills or Codicils by me made.
1.
I direct that all my legally enforceable debts, funeral expenses, testamentary expenses and aU
inheritance taxes (whether such taxes may be payable by my estate or by any recipient of any
property) shall be paid from my residuary estate as soon as practicable after my decease and as part
of the administration of my estate. My personal representative shall have no duty or obligation to
obtain reimbursement for any such tax so paid, even though on proceeds of insurance or other
property not passing under this Will.
2.
I give the sum of$l,OOO.OO to ROSE ANN FRITZ.
3.
I give all of my household furnishings, furniture, jewelry and other personal belongings to my
sister, JEANNETTE G. BURGETT, absolutely.
4.
All of the rest, residue and remainder of my estate, of whatever nature, I give, devise and
bequeath as follows:
a. One-half (112) thereof unto my sister, JEANNETTE G. BURGETT, absolutely.
b. The remaining one-half(l/2) thereof shall be divided equally among MARK ALLEN
WISE, TRACY WISE KOVACEVIC and RYAN M. KOVACEVIC, absolutely.
5.
In the event the said JEANNETTE G. BURGETT shall predecease me or fail to survive me
by more than thirty (30) days, then her share shall be distributed equally to MARK ALLEN WISE,
TRACY WISE KOVACEVIC and RYAN M. KOVACEVIC. In the event any of said last mentioned
beneficiaries shall predecease me, his or her share shall pass to the surviving beneficiaries in Paragraph

6.
I nominate, constitute and appoint my sister, JEANNETTE G. BURGETT as Executrix of
my estate. In the event JEANNETTE G. BURGETT shall be unable or unwilling to serve in such
capacity, then I appoint ROBERT SHRAWDER and F. WILLIAM GREGORY to act in such
capacity.
7.
I nominate, constitute and appoint TRACY WISE KOVACEVIC as Guardian of the estate
of RYAN M. KOVACEVIC.
8.
I direct that my personal representative(s) shall not be required to file a bond to secure the
faithful performance of their duties in any jurisdiction.
9.
I authorize and empower my personal representative(s), in their sole and absolute discretion,
to purchase or otherwise acquire and retain any investments of which I die seized or any real or
personal property of any nature; to sell, lease, pledge, mortgage, transfer, exchange, dispose of or
grant options in regard to any or all property of any kind forming a part of my estate for such terms
and such prices as they may deem advisable; to borrow money for any purposes connected with the
protection and preservation of my estate; to mortgage or pledge any real or personal property forming
a part of my estate or to join in or secure the partition of same; to compromise any claims or demands
of my estate against others or of others against my estate; to make distribution in kind and to cause
any share to be composed of cash, property or undivided fractional shares in property different in kind
from any other share; to employ agents, attorneys and proxies and to delegate to them such power
as my personal representative(s) consider desirable and to pay reasonable compensation for such
services as may be rendered by such agents, attorneys and proxies; and to execute and deliver such
instruments as may be necessary to carry out any of these powers. In addition, I direct that my
personal representative( s) shall have the power to conduct an inventory of any safe deposit box
necessary to the administration of my estate.
