STIPULATION AGAINST LIENS
THIS AGREEMENT made this &
between Neidlinger Construction, a
referred to as Contractor,
day of March, 2005, by and
sole proprietor, hereinafter
AND
Larry V. Neidlinger and Mary Jo Neidlinger, hUSband and wife,
hereinafter referred to as Owners, whereby the contractor undertook
and agreed to erected and construct a dwelling on the certain lot
of ground situate in West Pennsboro Township, ClUIIberland County,
Corrunonweal th of PennsYlvania, and more fully described in Exhibit
"A" which is attached hereto and made a part hereof known as Lot
#22 Stonecrest Acres, NeWVille, PA 17241.
NOW THEREFORE, THIS AGREEMENT WITNESSETH: That the said
Contractor, for an in consideration of the sum of ($1.00) Dollar to
Contractor in hand paid by Owner, the receipt whereof is hereby
acknowledged, and the further consideration mentioned in the
agreement aforesaid, for itself, himself or themselves and its, his
or their sUbcontractors, and all parties acting through or under
them, covenant and agree that no mechanic's liens or claims shall
be filed or maintained by them or any of them against the said
buildings and the lot of ground appurtenant thereto for or on
aCCOunt of any Work done or materials fUrnished by them or any of
them under said contract or otherwise, for, towards, in, or about
the erection and construction of the said bUildings on the lot
above described, and the said Contractor, for itself, himself or
themselves, its, his or their subcontractors and others under them,
hereby expressly waive and relinquish the right to have, file, and
maintain any mechanic's liens or claims against the said buildings
or any of them, and agree that this instrument, waiving the right
of lien, shall be an independent covenant.

purposes therein contained.

Exhibit "A"
ALL THAT CERTAIN lot of land situate in West Pennsboro Township,
Cumberland County, Pennsylvania, more particularly bounded and
described as follows:
BEGINNING at a P. K. Nail set on the centerline of T-438 (also known as
Crossroad School Road) at the dividing line of Lot No. 22 herein cOnveyed
and Lot No, 23 as shown on the hereinafter mentioned Subdivision Plan;
thence along said centerline South 51 degrees 09 minutes 40 seconds
East, a distance of 200.00 feet to a p.k nail set at the dividing line of Lot 21;
thence along Lot 21 South 38 degrees 50 minutes 20 seconds West passing
through an iron pin 24.39 feet from beginning point, a distance or 463.00
feet to an iron pin on the dividing line of Lot 24; thence along Lot 24 North
51 degrees 09 minutes 40 seconds West, a distance of 200.00 feet to an
iron pin at the southwestern corner of Lot 23 aforesaid; thence along Lot
23 North 38 degrees 50 minutes 20 seconds East a distance of 463.00 feet
passing through an iron pin 23.20 feet from end point, the place of
BEGINNING.
CONTAINING a total area of 2.02324 acres and being Lot 22 on a Land
Subdivision for Stonecrest Acres recorded in Cumberland County Plan
Book 81, Page 124.
Lot 22 herein conveyed is subject to a drainage easement area described
as follows:
BEGINNING at an iron pin on the existing edge of road of T-438 also
known as (Crossroad School Road) at the dividing line of Lot 22 and Lot
23; thence along said existing edge of road South 50 degrees 47 minutes
18 seconds East a distance of 62.60 feet to a point; thence through Lot 22;
South 38 degrees 50 minutes 20 seconds West a distance of 47,55 feet to a
point; thence South 89 degrees 07 minutes 58 seconds West, a distance of
20,19 feet to a point; thence South 38 degrees 50 minutes 20 seconds
West a distance of 125.16 feet to a point; thence South 56 degrees 37
minutes 10 seconds West, a distance of 154.41 feet to a point on the
dividing line of Lot 23; thence along said line North 38 degrees 50 minutes
20 seconds East a distance of 332.80 feet to a point, the place of
BEGINNING.
