' 21-01-1077 LAST WILL AND TESTAMENT I, MAURICE HECKLER, a resident of Greene Township, Franklin County, Pennsylvania, being of sound mind and memory, do make, publish and declare this my last will and testament, hereby revoking any and all wills by me heretofore made. ITEM I. I direct my executor, hereinafter named, to pay my funeral expenses as soon after my decease as may be found convenient, and also to pay all estate, inheritance, succession and other death transfer taxes, of whatever nature and by whatever jurisdiction imposed and interest and penalties in respect thereto, assessed against my estate or payable by reason of my death, with respect to any and all property, life insurance and other interests comprising my estate for death tax purposes, whether or not such property or interests pass under this will or any codicil thereto, without reimbursement as if such taxes were administration expenses. ITEM II. I give, devise and bequeath all my estate, real, personal and mixed, of whatever nature and wheresoever situate, which I may own or have the right to dispose of at the time of my decease, to my wife, MARJORIE M. HECKLER, if she is living at the time of my decease. ITEM III. In the event my wife, MaIjorie M. Heckler, is not living at the time of my decease, then I give, devise and bequeath all my estate, real, personal and mixed, of whatever nature and wheresoever situate, which I may own or have the right to dispose of at the time of my decease, as follows:- (A) I give and bequeath certain items of personal property as more fully set forth on a list which I have placed with my will, and I direct my executor hereinafter named to make dis- tribution of those items in accordance with said list. (B) All the rest, residue and remainder of my estate, real personal and mixed, of whatever nature and wheresoever situate, which I may own or have the right to dispose of at the time of my decease, as follows:- /2 <<' /7 / ", ~/. HECKLER, or his issue, per stirpes. (2) A fifteen percent (15%) share to my son, DAVID M. HECKLER, or his issue, per stirpes. (3) A twenty percent (20%) share to my grandson, STEVEN 1. HECKLER, or his issue, per stirpes, said gift being a special thank you from me for his advice and guidance. (4) A ten percent (10%) share in equal shares to my grandchildren, THOMAS L. HECKLER, WILLIAM D. HECKLER, KAREN A. STATHAS and JAMES R. HECKLER, JR., or their issue, per stirpes. (5) A ten percent (10%) share to my grandson, STEVEN 1. HECKLER, of Cham- bersburg, Pennsylvania, IN TRUST NEVERTHELESS, for the benefit of my daughter, A. LOUISE HECKLER, for the following uses and purposes, and under the following conditions:- (a) My trustee shall consider all other sources of income or benefits for my daughter and any individual assets of my daughter or income and services provided from any and all government, state or other programs which may benefit my daughter. (b) My trustee may accumulate income and/or principal and/or may dis- tribute accumulated income and/or principal in its absolute discretion for the benefit of my daughter. As my daughter likely will never be able to function independently and/or handle funds, I direct that such funds not be given to her directly, but shall be paid to and for the services directed in this trust. Distribution of income and/or principal is to be made only to supplement and not to supplant otherwise available state or federal benefits, and only if other resources of the beneficiary, including those stated above are insuffi- cient for the level of support to which my daughter has been accustomed in the past. (c) I authorize my trustee to make the aforesaid payments to the person having custody of my daughter, or such institution, educational or other- wise, as may be providing designated items or services in the above paragraph to my daughter, and are entitled to payment for the same. The amount of payments, the time of payments and the person to whom pay- ments are made shall be determined absolutely in the discretion of my trustee from time to time. (d) Upon the death of my daughter, A. Louise Heckler, the trustee shall pay the funeral expenses of my daughter, if not previously paid, and there- after retain in further trust the balance of the trust estate and all accumula- tion of income under the same terms and conditions for the benefit of my granddaughter, BETHANY E. HECKLER. Upon the death of my grand- daughter, Bethany E. Heckler, the trustee shall pay the funeral expenses of my granddaughter, if not previously paid, and thereafter distribute the balance of the trust estate and all accumulations of income, free and clear of the trust, to Bethany's sister, JENNIFER MARIE HECKLER, or her issue, per stirpes. (6) The interest of my daughter, A. Louise Heckler and my granddaughter, Bethany E. Heckler, shall not be subject to anticipation or to voluntary and involuntary alienation until distribution is actually made. ITEM I. I direct my executor, hereinafter named, to pay my funeral expenses as soon after my decease as may be found convenient, and also to pay all estate, inheritance, succession and other death transfer taxes, of whatever nature and by whatever jurisdiction imposed and interest and penalties in respect thereto, assessed against my estate or payable by reason of my death, with respect to any and all property, life insurance and other interests comprising my estate for death tax purposes, whether or not such property or interests pass under this will or any codicil thereto, without reimbursement as if such taxes were administration expenses. I give, devise and bequeath all my estate, real, personal and mixed, of whatever nature and wheresoever situate, which I may own or have the right to dispose of at the time of my decease, to my wife, MARJORIE M. HECKLER, ifshe is living at the time of my decease. ITEM III. In the event my wife, Marjorie M. HeckIer, is not living at the time of my decease, then I give, devise and bequeath all my estate, real, personal and mixed, of whatever nature and wheresoever situate, which I may own or have the right to dispose of at the time of my decease, as follows:- (A) I give and bequeath certain items of personal property as more fully set forth on a list which I have placed with my will, and I direct my executor hereinafter named to make dis- tribution of those items in accordance with said list. HECKLER, or his issue, per stirpes, said gift being a special thank you from me for his advice and guidance. (4) A ten percent (10%) share in equal shares to my grandchildren, THOMAS L. HECKLER, WILLIAM D. HECKLER, KAREN A STATHAS and JAMES R. HECKLER, JR., or their issue, per stirpes. (5) A ten percent (10%) share to my grandson, STEVEN 1. HECKLER, of Cham- bersburg, Pennsylvania, IN TRUST NEVERTHELESS, for the benefit of my daughter, A. LOUISE HECKLER, for the following uses and purposes, and under the following conditions:- (a) My trustee shall consider all other sources of income or benefits for my daughter and any individual assets of my daughter or income and services provided from any and all government, state or other programs which may benefit my daughter. Law Offices (b) My trustee may accumulate income and/or principal and/or may dis- tribute accumulated income and/or principal in its absolute discretion for the benefit of my daughter. As my daughter likely will never be able to function independently and/or handle funds, I direct that such funds not be given to her directly, but shall be paid to and for the services directed in this trust. Distribution of income and/or principal is to be made only to supplement and not to supplant otherwise available state or federal benefits, and only if other resources of the beneficiary, including those stated above are insuffi- cient for the level of support to which my daughter has been accustomed in the past. ( c) I authorize my trustee to make the aforesaid payments to the person having custody of my daughter, or such institution, educational or other- wise, as may be providing designated items or services in the above paragraph to my daughter, and are entitled to payment for the same. The amount of payments, the time of payments and the person to whom pay- ments are made shall be determined absolutely in the discretion of my trustee from time to time. (d) Upon the death of my daughter, A. Louise Heckler, the trustee shall pay the funeral expenses of my daughter, if not previously paid, and there- after retain in further trust the balance of the trust estate and all accumula- tion of income under the same terms and conditions for the benefit of my granddaughter, BETHANY E. HECKLER. Upon the death of my grand- daughter, Bethany E. Heckler, the trustee shall pay the funeral expenses of my granddaughter, if not previously paid, and thereafter distribute the balance of the trust estate and all accumulations of income, free and clear of the trust, to Bethany's sister, JENNIFER MARIE HECKLER, or her issue, per stirpes. Heckler, shall not be subject to anticipation or to voluntary and involuntary alienation until distribution is actually made.
