I direct my executor to pay all funeral and burial expenses in Birdsboro, Pennsylvania, at the Cemetery of Immaculate Conception Catholic Church, where my g-ravemarker is in place. ITEM II. NO. 21-O1-1130 BELLINI ATTORNEY ID NO 45112 PETITION TO REMOVE EXECUTORS IN ACCORDANCE WITH 20 Pa Cons Stat ~ 3182 FOR FAILURE TO FILE INVENTORY COMES NOW, the Right Reverend Nevin Klinger, Pastor of Immaculate Conception Catholic Church, who files this Petition to Remove Executor of the Estate of Madeline M. Bellini, and in support thereof says: 1. Madeline M. Bellini, "Decedent," died September 2, 2001, testate, a resident of Dauphin County, Pennsylvania. 2. The Decedent executed a will on or about July 27, 1998 (see attached Exhibit "A"). 3. On June 5, 1999, the Decedent executed a codicil to the will (see attached Exhibit "A"). 4. Letters Testamentary on her Estate were granted by the Register of Wills of Cumberland County, Pennsylvania, to her executors, James M. Bucci, Esquire and Daniel J. DiNardo, on or about December 13, 2001. 5. Petitioner is a party in interest in the Estate of the Decedent, being a beneficiary listed in the Decedent's will. 6. More than three months have expired since the death of Ms. Bellini. 7. No bond has been posted by either executor for the administration of the Estate. 8. Upon review of the file with the Register of Wills, no inventory has been filed by the executors of the Estate of Madeline M. Bellini, Deceased. 9. Mr. DiNardo has a limited interest in the Estate in that he is named a beneficiary in the amount of $500.00. 10. James M. Bucci, the other executor of the Estate, has no financial interest in the administration of the Estate. 11. The petitioner believes that the administration of the Estate may result in significant legal and administrative costs to the Estate. 12. Because an inventory has not been filed, the beneficiary is not aware as to whether or not that the Estate can afford any expenses for the administration of the Estate. 13. The Right Reverend Nevin Klinger, pastor of the Immaculate Conception Catholic Church, the remainderman, is willing to act as executor and administer the Estate at no cost to the Estate for his services. 14. The remainderman believes and therefore avers that it is in the best interest of the beneficiaries if the current executors are removed as the executors of the Estate. WHEREFORE, for all of the above reasons, the remainderman/petitioner respectfully prays this Honorable Court to remove the executors and to authorize the Register of Wills to grant new Letters Testamentary to the Right Reverend Nevin Klinger. COUNT II 15. The Petitioner herein incorporated the provisions of paragraphs 1-14 above as if set out in detail herein. 16. Petitioner believes and therefor avers that because an inventory has been filed more than five months after the death of the deceased, that certain assets may be converted by the executor and an inventory is required to identify the Decedent's assets. 17. The executors, the movant believes and therefor avers, have no interest in the administration of the Estate. 18. The remaindermen of the Estate are Immaculate Conception Catholic Church and Our Lady of Blessed Sacrament Catholic Church, 2121 North 3rd Street, Harrisburg, Dauphin County, Pennsylvania 17110 (hereinafter referred to as Msgr. Klinger). 19. The Right Reverend Monsignor Nevin Klinger, pastor of Immaculate Conception Catholic Church has agreed to serve as executor of the Estate. 20. The Estate will benefit as a result of Msgr. Klinger's being appointed as executor of the Estate because this will reduce the costs and expenses for the administration of the Estate. 21. Mr. Bucci, the current executor, is not a named beneficiary of the Estate. 22. The other remainder beneficiaries of the Estate is Our Lady of Blessed Sacrament Catholic Church. 23. Our Lady of Blessed Sacrament Catholic Church has consented to Msgr. Klinger being named the executor of the Estate. WHEREFORE, Petitioner requests that this Court issue a citation, directed to James M. Bucci, Esquire and Daniel J. DiNardo, Executors of the Estate of Madeline M. Bellini, Deceased, to show cause why they should not be removed as Executors because of their refusal to file an inventory of the assets of the Estate of Madeline M. Daniel DiNardo is a Certified Public Accountant with over twenty-five (25) years of professional experience. He enjoys the trust and respect of his clients and professional peers. 4. Joseph T. Bambrick, Jr., counsel for the Petitioner has neither the experience nor the professional integrity to serve as counsel to the Executors of the Estate. 5. The Petition fails to allege sufficient basis to require the removal of the Executors, because the Petition was filed prematurely and the Petitioner lacks standing. The Petition is frivolous. 6. The frivolous Petition has caused the Executors to expend unnecessary time and effort to defend the Petition and therefore it will cause the Estate to incur unnecessary legal expenses. 7. When certain communities cannot be erected as a parish or quasi- parish, the diocesan bishop is to provide for their pastoral care in another manner. Can. 517 - §1. When circumstances require it, the pastoral care of a parish or of several parishes together can be entrusted to a team of several priests in solidum with the requirement, however, that one of them should be the moderator in exercising pastoral care, that is, he should direct their combined activity and answer for it to the bishop. §2. If the diocesan bishop should decide that due to a dearth of priests a participation in the exercise of the pastoral care of a parish is to be entrusted to a deacon or to some other person who is not a priest or to a community of persons, he is to appoint some priest endowed with the powers and faculties of a pastor to supervise the pastoral care. Can. 518 - As a general rule a parish is to be territorial, that is it embra- ces all the Christian faithful within a certain territory; whenever it is judged useful, however, personal parishes are to be established based upon rite, language, the nationality of the Christian faithful within some territory or even upon some other determining factor.
