Sanders, Esquire, makes the following Complaint in Civil Action -- Contract: 1. The Plaintiff, Comcast Spotlight, Inc., is a corporation and maintains an office for the tTansaction of business at 1700 Paoli Pike, POBox 4002, Ma1vern, Pennsylvania, 19355. 2. The Defendant, Kokomo's, has a place of business at 3721 Market Street, Camp Hill PA 17011. 3. On or about SeptembeT 4, 2003, the Plaintiff and the Defendant enteTed into a Commercial Advertising Contract (hereinafter referred to as Contract) wherein the Plaintiff would televise advertising for the Defendant on the dates and times set forth in the said Contract. A copy of the Contract is attached hereto, made a part hereof, and marked Exhibit A. 4. Pursuant to the said Contract, Plaintiff satisfactorily performed its duties under the said Contract by televising the ads on the dates and times set forth in the said Contract. 5. As a consequence of the televising the advertisement as set forth in the said Contract, the Defendant incurred charges in the amount of $11,727.00. A copy of the invoice statement reflecting such charges is attached hereto, made a part hereof, and marked Exhibit B. 6. Despite repeated demands fOT payment, the Defendant has failed and refused to pay the balance due of $11,727.00 OT any part theTeof. 7. Pursuant to the additional teTms of the said ContTact, Plaintiff is entitled to interest on the unpaid balance at the rate of 18 %, and Plaintiff is also entitled to be reimbursed for its expenses, such as reasonable attorney fees and court costs. WHEREFORE, Plaintiff demands judgment against the Defendant in the amount of $11,727.00 with interest from May 25,2004 at the contractual rate of 18% and reasonable attorney fees and costs upon the foregoing Complaint in Civil Action -- Contract.
