()S - ,;z9;Z~ fYlW 1ER..n-t WHEREAS, Shaun Ellis, an adult individual of 3607 Rosemont Avenue, Camp Hill, Pennsylvania, is about to execute contemporaneously herewith, a contract, with Miller & Norford, Inc. of 700 Ayers Avenue, Lemoyne, Pennsylvania, for renovations to the building and premises known as Lot 5 Century Drive, Mechanicsburg, Cumberland County, Pennsylvania, as set forth in the deed dated December 22, 2004 and recorded December 27, 2004 in Deed/Record Book 266 Page 4395, in the Recorder's Office for Cumberland County, Pennsylvania, as more specifically described in Exhibit "A" which is incorporated herein and attached hereto. NOW, vL1 Wf !2- '7 , 2005, at the time of and immediately before the execution of the principal contract, and before any authority has been given by the said Owner to the said Contractor to commence work on the said building, or purchase materials for the same in consideration of the making of the said contract with Contractor and the further consideration of One Dollar ($1. 00), to Contractor paid by Owner, it is agreed that no lien shall be filed against the building by the Contractor, or any subcontractor, nor by any of the materialmen or workmen or any other person for any labor, or materials purchased, or extra labor or materials purchased for the erection of said building, the right to file such liens being expressly waived. Walker, P,E. dated 7/31/80 and recorded in Cumberland County Pllm Book 39 Page 5, as follows to wit: BEGINNING at a point on the North line of Century Drive between Tract No.4 and Tract No.5 on aforesaid Plan; thence along the easterly line of Tract No.4 North 42 degrees 16 minutes 43 seconds West a distance of366.04 feet to a point at line of lands now or formerly of Methodist Home; thence along same North 54 degrees 44 minutes 11 seconds East 310.85 feet to a point between Tract No.5 and Tract NO.6 on aforesaid Plan; thence along the westerly line of Tract No.6 South 53 degrees 45 minutes 00 seconds East 350.15 feet to a point thence continuing along same South 47 degrees 43 minutes 17 seconds West a distance of 45.0 feet to a point; thence continuing along same South 42 degrees 16 minutes 43 seconds East a distance of 91.83 feet to a point on the North line of Century Drive; thence along same South 67 degrees 23 minutes 17 seconds West a distance of 260.27 feet to a point; thence along same by a curve to the left having a radius 0055 feet, a lineal distance of 90.42 feet to a point, the place ofBEGINNING.
