I, ANNIE LEE TICHY, domiciled and resident of Mount Holly Springs Borough,
County of Cumberland, Commonwealth of Pennsylvania, declare that this document is
my Will and revoke all my previous Wills and Codicils.
I.
IDENTIFICATIONS AND DEFINITIONS
I am a widow. I have two living children, Theodora P. Wright and Jenny Lee
Shue, they are referred to in the Will as "my children".
II.
PAYMENT OF EXPENSES, DEBTS, AND TAXES
I direct my Executor to pay medical, funeral, and administrative expenses and all
taxes payable by reason of my death, before any division of my estate. My Executor shall
not attempt to have any part of such taxes apportioned among the recipients of property
includible in determining the amount of such taxes. Proceeds on insurance on my life up
to the maximum allowable as an exemption from Pennsylvania Inheritance Tax and
distributions from pension and profit sharing plans exempt from federal estate tax, all of
which are payable to my Trustee or any beneficiary (other than my estate), shall not be
used to pay debts, taxes, expenses of administration or other charges against my estates.
III.
SPECIFIC REQUESTS
I give ten thousand dollars ($10,000.00) each to my
grandchildren, Leslie Greer and Earl Gammons, both of Long view
Texas.
IV.
DIVISION OF PROPERTY
I dispose of the balance of my property as follows:
I give all my property, real, personal or mixed which I own
or over which I have testamentary power or appointment, to
my living children, Theodora P. Wright and Jenny Lee Shue,
in equal shares, share and share alike.
If either of my said living children, Theodora P. Wright and
Jenny Lee Shue, should predecease me, then I give her share
of such property to the issue of such deceased child then
surviving me, if any there be, per stirpes.

FIDUCIARIES
Executor: I nominate and appoint my daughters, Jenny Lee Shue and Theodora P.
Wright, as Co-Executor of this Will to serve without bond. If either does not survive me,
declines to act, or having qualified, resigns, dies, or is removed, I nominate the other to
serve without bond.
Powers: I give my fiduciaries, including successor fiduciaries, all the powers
contained in Chapter 71 of the Pennsylvania Probate, Estates and Fiduciaries Code at the
time of the execution ofthis Will, and those powers are incorporated by reference.
In testimony of which I now sign this Will, in the presence of witnesses whose
names will appear below, and request that they witness my signature and attest to the
execution of this Will, this 11th day of August, 2000 at 1237 Holly Pike, Carlisle,
Cumberland County, Pennsylvania.

[72 PS. 99116 (a) (1.1) (i)].
For dates of death on or after January 1, 1995, the tax rate imposed on the net value of transfers to or for the use of the surviving spouse is 0% [72 P.S. 99116 (a) (1.1) (ii)].
The statute does not exemot a transfer to a surviving spouse from tax, and the statutory requirements for disclosure of assets and filing a tax return are still applicable even if
the surviving spouse is the only beneficiary.
For dates at death on or after July 1, 2000:
The tax rate imposed on the net value of transfers from a deceased child twenty-one years of age or younger at death to or for the use of a natural parent, an adoptive parent,
or a stepparent of the child is 0% [72 P.S. 99116(a)(1.2)].
The tax rate imposed on the net value of transfers to or for the use of the decedent's lineal beneficiaries is 4.5%, exoept as noted in 72 P.S. 99116(1.2) [72 P.S. 99116(a)(1)].
The tax rate imposed on the net value of transfers to or for the use at the decedent's Siblings is 12% [72 P.S. 99116(a)(1.3)]. A sibling is defined, under Section 9102, as an

The 15% tax amnesty non-participation penalty is computed on the total of the tax and interest assessed, and not
paid before January 18, 1996, the first day after the end of the tax amnesty period. This non-participation
penalty is appealable in the same manner and in the the same time period as you would appeal the tax and interest
that has been assessed as indicated on this notice.

FAMILY AGREEMENT
This Agreement entered into this 16 th day of April, 2003, by and between
JENNY LEE SHUE and THEODORA P. WRIGHT in their capacity as executrices under
the will dated August 11, 2000 of ANNIE LEE TICHY, Deceased, and JENNY LEE
SHUE and THEODORA P. WRIGHT, residuary legatees of the estate. For purposes of
this agreement, when they are referred to in their fiduciary capacity, the term
"executrices" will be used and, when they are referred to in their individual capacity, they
will be referred to by their respective names.
BACKGROUND
1. ANNIE LEE TICHY, ("Decedent") died on December 21, 2001, a resident of
Mount Holly Springs Borough, leaving a will dated August 11, 2001.
2. Decedent's will was admitted to probate by the Register of Wills of
Cumberland County on December 28, 2001, and letters testamentary were issued to
JENNY LEE SHUE and THEODORA P. WRIGHT as executrices (Cumberland County
Register of Wills File No. 2001-01175).
3. In her will, Decedent named her two children, JENNY LEE SHUE and
THEODORA P. WRIGHT, as the sole residuary legatees.
4. The executrices advertised the grant of letters Testamentary, prepared and filed
an Inventory and Appraisement of Decedent's property and prepared and filed a
Pennsylvania Inheritance Tax Return and federal and state income tax returns and paid
the appropriate taxes thereon.
5. The executrices have paid the only two general legatees and received releases
therefrom, and have paid all the taxes, debts and expenses of the estate known to her, and
they has no knowledge of any unpaid claims, absolute or contingent, which may be
asserted against the estate nor do they have any reason to believe there are any such
claims.
6. The executrices have distributed the net assets of the estate to JENNY LEE
SHUE and THEODORA P. WRIGHT, the residuary legatees named in the will.
7. A statement reflecting all estate receipts, disbursements and distributions are
annexed here to as Exhibit A.
8. Both JENNY LEE SHUE and THEODORA P. WRIGHT desire that this
Family Agreement make unnecessary the filing an accounting in the Orphans' Court
Division of the Court of Common Pleas of Cumberland County.
NOW THEREFORE, intending to be legally bound, the parties do hereby:
1. Waive the filing of an account of the administration of the estate in any court;
2. Declare that the undersigned have examined the attached informal account
(and statement/schedule of distribution) of the executress; finds it to be true and correct in
all particulars; accept and approve it with the same force and effect as if it had been
prepared and filed with, audited, adjudicated and confirmed absolutely by a court of
competent jurisdiction; and as if the balance of principal and income had been awarded
by the Court in accordance with the statement/schedule of distribution;
3. Warrant that the beneficiaries named in the informal account and
statement/schedule of distribution are the sole remaining parties in interest in the estate
and entitled to receive the entire distribution thereof in accordance with the informal
account and Statement/Schedule of Distribution;
4. Warrant that the undersigned know of no outstanding and unsatisfied claims
against the estate;
5. Approve the distribution of the balance of principal and income shown in the
informal account and statement/schedule of distribution to the persons set forth therein;
6. Absolutely and irrevocably release and discharge the executrices, and their
heirs, personal representatives, successors and assigns of and from any and all actions,
liabilities, claims and demands relating in any way to their administration of the estate
and distribution in accordance with the informal account and statement/schedule of
distribution and without a court accounting and adjudication;
7. Agree to refund to the executrices any amount of the undersigned's distribution
which exceeds the amount to which the undersigned are entitled as the executrices shall
determine;
8. Agree to indemnify and hold harmless, the executrices, and their heirs,
personal representatives, successors and assigns, from and against any claims, liabilities,
loss or expense (including costs and counsel fees) arising from any cause whatsoever,
which the executress may incur as a result of the administration of the estate and its
distribution in accordance with this agreement including, but not limited to, any liability
for any federal estate taxes, Pennsylvania Inheritance tax or any other death taxes, and
2
any federal or Pennsylvania income taxes, and Pennsylvania personal property taxes,
together with any interest and costs incidental thereto, relating in any way to the estate
and also including, but not limited to, any assets received or paYments or distributions
made by reason of any negligence or mistake of law or fact.

of the tax paid is allowed.
PENALTY:
The l5~ tax aanesty non-participation penalty is coaputed on the total of the tax and interest assessed, and not

INTEREST:

Purpose of the Account: Annie Lee Tichy died December 21, 2001, at the age of
ninety-six (96), at The Chapel Pointe Retirement Community in Carlisle. She had lived
for more than sixty years in Mount Holly Springs. She died a widow, leaving specific
bequests to two of her grandchildren and leaving the residue of her estate to her two
children, as equal beneficiaries. The estate consisted of stocks and bonds managed by
Legg Mason and a Bank account with PNC Bank all totaling slightly over $500,000.00.
The testator named her two children, Jenny Lee Shue and Theodora P. Wright
co-executrices of the Will. The executrices liquidated the Legg Mason stock and bond
funds, paid all the debts, taxes of the testator and all the costs and taxes associated with
the administration of the estate. There was no personal property, the testator having over
the past many years having distributed the same to her children and grandchildren during
her life-time. The Testator had specifically bequeathed the sum of $10,000.00 to two of
her grandchildren: Earl Gammons and Leslie Greer. These specific bequests were paid to
the grandchildren and releases were received by the executrices and filed with the
Register of Wills. The balance of the estate was distributed equally to the Testators
children.
All creditors have been paid and no further creditors are anticipated. A copy of the
Inheritance Tax Statement of Account from the Pennsylvania Department of Revenue
evidencing the taxes have been paid and no taxes are due is attached.
It is important that the account be carefully examined. Requests for additional
