AND NOW, this 13th day of June, 2005, upon consideration of (a) the pro se
Petition To Place All Assets of the Mildred J. Gerber Estate and Trust in Escrow and Not
Distribute Them to the Executor, Frederick E. Gerber, II and Beneficiaries until All of the
Accounting Hearings withPNC Bank and Frederick E. Gerber, II Are Settled, (b) the
Answer and New Matter of PNC Bank, N.A., to Petition To Place All Assets of the
Mildred J. Gerber Estate and Trust in Escrow, and (c) the pro se Reply to New Matter of
PNC Matter, N.A., to Petition To Place All Assets of the Mildred J. Gerber Estate and
Trust in Escrow and New Matter by Marilyn Gerber to PNC Bank, filed by Marilyn
Gerber, and this court having been divested of jurisdiction by an appeal by petitioner at
No. 21-01-92 from confirmation of the account, the petition will not be granted at No. 21-
01-92 and is otherwise denied.
