THIS AGREEMENT made this - day of C --. ~ 2005, by and between Hoffman's Custom Contracting, Inc., of 35 Chelsea Lane, Cumberland County, Carlisle, Pennsylvania, hereinafter referred to as Contractor, AND KENNETH K. DOMAN AND BRENDA M. DOMAN, husband and wife, hereinafter referred to as Owners. Whereby the contractor undertook and agreed to erected and construct a dwelling on the certain lot of ground situate in Dickinson Township, Cumberland County, Commonwealth of Pennsylvania, and more fully described in Exhibit "A" which is attached hereto and made a part hereof known as Lot #37, 24 Chelsea Lane, Cumberland County, PA. NOW THEREFORE, THIS AGREEMENT WITNESSETH: That the said Contractor, for an in consideration of the sum of ($1.00) Dollar to Contractor in hand paid by Owner, the receipt whereof 'is. hereby acknowledged, and the further consideration mentioned lp the agreement aforesaid, for itself, himself or themselves and its, his or their subcontractors, and all parties acting through or under them, covenant and agree that no mechanic's liens or claims shall be filed or maintained by them or any of them against the said buildings and the lot of ground appurtenant thereto for or on account of any work done or materials furnished by them or any of them under said contract or otherwise, for, towards, in, or about the erection and construction of the said buildings on the lot above described, and the said Contractor, for itself, himself or themselves, its, his or their subcontractors and others under them, hereby expressly waive and relinquish the right to have, file, and maintain any mechanic's liens or claims against the said buildings or any of them, and agree that this instrument, waiving the right of lien, shall be an independent covenant. Exhibit A ALL that certain lot of land situate iu Dickinson Township, Cumberland County, Pennsylvania, bounded and described in accordance with Final Subdivision Plan of Kings Gap Estates recorded on April 10, 1992, in the hereinafter named Recorder's Office in Plan Book 64, Page 48, etc., as follows: BEGINNING at a point on the northern line of 60 feet wide Chelsea Lane at the dividing line between Lots Nos. 36 and 37; thence along said northern line of 60 feet wide Chelsea Lane by a curve to the right having a radius of 200.00 feet an arc distance of201.01 feet to a point on the eastern line of said 60 feet wide Chelsea Lane; thence along the eastern line of said 60 feet wide Chelsea Lane, North 08 degrees 36 minutes 27 seconds West a distance of 165.85 feet to a point at the dividing line between Lots Nos. 37 and 38; thence along said dividing line between said Lots Nos. 37 and 38, and continuing along a small portion of the dividing line between Lots 37 and 39, North 83 degrees 29 minutes 38 seconds East a distance of 174.14 feet to a point at the dividing line between Lots Nos. 36 and 37; thence along said dividing line between said Lots Nos. 36 and 37, Soutb 03 degrees 34 minutes 36 seconds West a distance of 324.10 feet to a point on the northern line of 60 feet wide Chelsea Lane at the Place of BEGINNING.
