Dear Lady and Gentlemen:
Please be advised that we represent Holy Spirit Hospital. On behalf of my client, a
Petition was filed with the Cumberland County Orphans' Court to declare Cynthia Stoltzfus an
incapacitated person and to appoint the Pennsylvania Guardianship Association, Inc. as the
guardian of her person and her property. This will allow the Hospital to transfer her to a facility
that is appropriate for her care.
Enclosed is a copy of the Petition that has been filed as well as a Preliminary Decree
scheduling a hearing for October 30, 2002 at 11 :00 a.m. in Cumberland County Court; a
proposed Final Decree; and a copy of the Citation that has been served on Cynthia Stoltzfus.
I am required by law to provide you with notice of this hearing and the opportunity to
come to the Court and present your position, if any. This is not a subpoena. While I am
available to discuss this matter with you, if you have any legal questions, I recommend that you

TO THE HONORABLE, THE JUDGES OF SAID COURT:
The Petition of Holy Spirit Hospital respectfully represents that:
1. Your Petitioner, Holy Spirit Hospital of the Sisters of Christian Charity ("Holy Spirit Hospital")
is an acute care hospital located at 503 North 21st Street, Camp Hill, Cumberland County, Pennsylvania
17011-2288.
2. Cynthia Stoltzfus is a 46 year old incapacitated female, born on March 26, 1956. She has
never been married and has no children. Her current residence address is 409 B Street, PO Box 311,
Carlisle, Pennsylvania 17013.
3. Cynthia Stoltzfus was transferred to Holy Spirit Hospital from Carlisle Hospital on August 6,
2002 with a chief complaint of myopathy. She initially came into Carlisle Hospital with delirium and was
transferred to Holy Spirit Hospital because of neurological concerns.
4. According to her treating physician, Victoriya K. Abramova, MD., an internal medicine
specialist with Internists of Central Pennsylvania, the patient suffered from lower extremity paralysis, severe
encephalopathy (brain tissue swelling) and severe cognitive disfunction.
5. During her admission to Holy Spirit Hospital, her treating physician has provided an opinion
that she lacks the capacity to make medical and financial decisions for herself and is in need of a guardian.

6. Cynthia Stoltzfus' treating physician has recommended that she be placed in a supervised
setting with 24-hour care, and will need assistance in handling her daily affairs of living and cannot be left
alone.
7. In order to transfer Cynthia Stoltzfus to a 24-hour care facility to meet her needs of daily
living, a responsible person must be appointed by the Court to handle her affairs.
8. Cynthia Stoltzfus is an incapacitated adult person who needs a court appointed guardian for
her person and her property.
9. Prior to her admission to Carlisle Hospital, Cynthia Stoltzfus was residing with her boyfriend in
an apartment in Carlisle. It is believed that she does not have current employment except with the United
States Army Reserves.
10. It is believed that Cynthia Stoltzfus has a no income except from the United States Army
Reserves, owns no real property, and has a bank account with approximately $1,000.00. It is unknown
whether she has any other assets.
11. Cynthia Stoltzfus' mother is Donna Grahm who resides at 14 Kelso Street, Harrisburg,
Dauphin County, Pennsylvania. Her father is Earl Stoltzfus who resides at 5 Fortuna Lane, Enola,
Cumberland County, Pennsylvania. Both have declined to act as her legal guardian.
12. Your Petitioner, Holy Spirit Hospital, is a creditor of Cynthia Stoltzfus, and has standing to
bring this action.
13. Holy Spirit Hospital has contacted the Pennsylvania Guardianship Association, Inc., a
Pennsyivania corporation, which routinely provides guardianship services, including to citizens of
Cumberland County, and it has agreed to act as guardian over the person and property of Cynthia Stoltzfus.

WHEREFORE, your Petitioner prays that a Citation be issued upon Cynthia Stoltzfus to show cause
why she should not be adjudged to be incapacitated and plenary guardians for her estate and person be
appointed, and that the Court schedule a hearing on this Petition.

CITATION WITH NOTICE
A petition has been filed with the Court to have you declared an Incapacitated Person. If the
Court finds you to be an Incapacitated Person, your rights will be affected, including our right to manage
money and property and to make decisions. A copy of the petition which has been filed by DAVID W
DELUCE is attached.
You are hereby ordered to appear at a hearing to be held in Court Room No. ;l, Cumberland
County Courthouse, Carlisle, Pennsylvania, on OCTOBER 30 , 2002, at II :00 A.M. to tell the
Court why is should not find you to be an incapacitated Person and appoint a Guardian to act on your
behalf.
To be an incapacitated Person means that you are not able to receive and
effectively evaluate information and communicate decisions and that you are unable to
manage your money and/or other property, or to make necessary decisions about where
you will live, what medical care you will get, or how your money will be spent.
At the hearing, you have the right to appear, to be represented by an attorney, and
to request a jury trial. If you do not have an attorney, you have the right to request the
Court to appoint an attorney to represent you and to have the attorney's fees paid for you
if you cannot afford to pay them yourself. You also have the right to request that the
Court order that an independent evaluation as to your alleged incapacity.
If the Court decides that you are an Incapacitated person, the Court may appoint a
Guardian for you, based on the nature of any condition or disability and your capacity to
make and communicate decisions. The Guardian will be of your person and/or your
money and other property and will have either limited of full powers to act for you.
If the court finds you are totally incapacitated, your legal rights will be affected
and you will not be able to make a contract or gift of your money to other property. If the
court finds that you are partially incapacitated, your legal rights will also be limited as
directed by the Court.
If you do not appear at the hearing (either in person or by an attorney representing you)
the court will still hold the hearing in your absence and may appoint the Guardian requested.

AND NOW, this 8th day of April, 2003, comes the Petitioner, Earl Stoltzfus, Sr., by his
attorneys, Irwin, McKnight & Hughes, and makes the following Petition to Vacate Guardianship:
1.
The petitioner is Earl Stoltzfus, Sr., an adult individual residing at 5 Fortuna Lane, Enola,
Pennsylvania 17025.
2.
The respondent is Cynthia Stoltzfus, who is currently residing at the Stardust Motel
located at 1502 Holly Pike, Carlisle, Cumberland County, Pennsylvania 17013.

The petitioner was appointed plenary guardian of her person and her property by Order of
Court dated October 30, 2002, and is marked as Exhibit "A" and made a part of this Petition.
4.
On March 26, 2003, Cynthia Stoltzfus, left herself out of the nursing home located at
Beverly Healthcare, 741 Chambersburg Road, Gettysburg, Pennsylvania 17325.

On March 18,2003, Jeffrey A. Nolt, M.D., declared Cynthia Stoltzfus to be competent.
A copy of said note is attached hereto and marked as Exhibit "B" and made a part of this
Petition.

The guardian, Earl Stoltzfus, Sr., is authorized to pay reasonable legal fees in the amount
of Three Hundred Fifty and no/IOO ($350.00) Dollars to Irwin, McKnight & Hughes.
WHEREFORE, Petitioner respectfully requests that this Honorable Court enter an Order
of Court vacating the guardianship of the person and the property of Cynthia Stoltzfus and that
the sum of Three Hundred Fifty and noli 0 ($350.00) Dollars be paid to the firm of Irwin,
McKnight and Hughes for the costs and reasonable legal fees.
