JAN SUSAN NILSEN 1804 Silver Pine Circle Mechanicsburg, P A 17050 NO. 05 -.3/1.j1..f c.1<.>~~ Defendant CIVIL ACTION COMPLAINT Plaintiff, Citizens Bank of Pennsylvania, ("Citizens") by its attorneys, Silverman Bernheim & Vogel, files the instant complaint and represents as follows: 1. Citizens is an authorized state bank with a place of business located at 801 Market Street, Philadelphia, P A 19106. 2. Defendant, Jan Susan Nilsen, is an adult individual residing who is believed to be residing at 1804 Silver Pine Circle, Mechanicsburg, P A 17050. COUNT I - BREACH OF CONTRACT 3. Plaintiff incorporates by reference paragraphs I through 2 inclusive as if set forth in their entirety. F:\WPC T\DOCS\31664\Nilsen-549\Complaint.061505.wpd 4. On December 14, 1994, Mellon Bank, N .A., assignee to Citizens granted a loan unto Jan Susan Nilsen, in the original principal amount of$IO,OOO.OO (the "Loan"). The Loan to the Defendant is evidenced by a Personal Credit Line Agreement, (the "Agreement") dated December 14, 1994. A true and correct copy of the Agreement is attached hereto as Exhibit "A." 5. The Agreement provides that Defendant authorized Citizens to take payments out of a certain checking account on or after the 15th day of each month. See Exhibit "A", ~ Repayment Options p. I of 4. 6. On or about July 15,2003, Defendant failed to make a monthly payment of principal and interest when due. 7. Under the terms of the Agreement, a default occurs when "I do not make a payment on time." See Exhibit "A", ~ Repayment Options p. I of 4. 8. Upon Defendant's default, Citizens demanded complete payment and performance of all of the Defendant's obligations. A true and correct copy of the demand is attached hereto as Exhibit "8." 9. As Defendant has defaulted under the terms of the Agreement by failing to make payments when due, the following amounts have become immediately due and payable to Citizens, which pursuant to the Agreement includes reasonable attorneys fees and costs: Principal Accrued Interest (through 6/15/05) Accrued Late Charges Attorneys Fees and Costs TOTAL $12,802.37 1,116.47 190.82 2,783.77 $ 16,893.43 Interest continues to accrue at the per diem rate of$1.65. Accordingly, as Defendant has failed to comply with the terms and conditions of the Agreement by failing to make monthly payments as they became due, defendant is in breach of the Agreement. 11. As a result of Defendant's breach, Plaintiff has been damaged in the amount of $14,040.36. WHEREFORE, Plaintiff, Citizens Bank of Pennsylvania, demands Judgment in its favor and against Defendant, Jan Susan Nilsen, in the amount of$16,893.43, plus continuing interest from June 15,2005, at the per diem rate of$1.65, plus costs of suit. COUNT 11- UNJUST ENRICHMENT 12. Plaintiff incorporates by reference paragraphs 1 through 11 inclusive as if set forth in their entirety. 13. Defendant has been unjustly enriched in that he has had use of the monies he drew from his Line of Credit Agreement which were utilized for the benefit of Defendant and for which the Defendants have wrongfully and without justification or cause refused to pay despite demand. WHEREFORE, Plaintiff, Citizens Bank of Pennsylvania, demands Judgment in its favor and against Defendant, Jan Susan Nilsen, in the amount of$16,893.43, plus continuing interest from June 15,2005 at the per diem rate of$1.65, plus costs of suit. Citizens is an authorized state bank with a place of business located at 801 Market Street, Philadelphia, P A 19106. 2. Defendant, Jan Susan Nilsen, is an adult individual residing who is believed to be residing at 1804 Silver Pine Circle, Mechanicsburg, P A 17050. COUNT I - BREACH OF CONTRACT 3. On December 14,1994, Mellon Bank, N.A., assignee to Citizens granted a loan unto Jan Susan Nilsen, in the original principal amount of $1 0,000.00 (the "Loan"). The Loan to the Defendant is evidenced by a Personal Credit Line Agreement, (the "Agreement") dated December 14,1994. A true and correct copy of the Agreement is attached hereto as Exhibit "A." 5. The Agreement provides that Defendant authorized Citizens to take payments out of a certain checking account on or after the 15th day of each month. See Exhibit "A", ~ Repayment Options p. 1 of 4. 6. On or about July 15,2003, Defendant failed to make a monthly payment of principal and interest when due. 7. Under the terms of the Agreement, a default occurs when "I do not make a payment on time." See Exhibit "A", ~ Repayment Options p. 1 of 4. 8. Upon Defendant's default, Citizens demanded complete payment and performance of all of the Defendant's obligations. A true and correct copy of the demand is attached hereto as Exhibit "B." 9. As Defendant has defaulted under the terms of the Agreement by failing to make payments when due, the following amounts have become immediately due and payable to Citizens, which pursuant to the Agreement includes reasonable attorneys fees and costs: Principal Accrued Interest (through 6/15/05) Accrued Late Charges Attorneys Fees and Costs TOTAL $12,802.37 1,116.47 190.82 2.783.77 $ 16,893.43 Interest continues to accrue at the per diem rate of $1.65.
