COMPLAINT
AND NOW, comes Plaintiff, Dickinson College, by and through its attorneys, MARTSON
DEARDORFF WILLIAMS & OTTO, and hereby avers as follows:
1. Plaintiff Dickinson College (hereinafter "Dickinson") is a Pennsylvania educational
institution with its principal offices located in Carlisle, Cumberland County, Pennsylvania.
2. Defendant Erin M. Ungvarsky (hereinafter "Student") is an adult individual whose
last known address is 1700 Weaver Street, North Versailles, Allegheny County, Pennsylvania 15137.
COUNTI
BREACH OF CONTRACT
3. Paragraphs 1 through 2 are incorporated herein by reference as if set forth in full
below.
4. Student is currently or was recently enrolled at Dickinson.
5. Student opened a Student Receivables Account (hereinafter "Account") with
Dickinson to pay tuition, dining service fees and other educational expenses provided and rendered
to Student by Dickinson. A true and correct copy of that Account is incorporated by reference and
attached as Exhibit "A."
6. Student, by opening the Account and using the goods and services provided by
Dickinson, agreed to pay Dickinson for all charges made to the Account.
7. Student received and accepted all goods and services provided by Dickinson and
thereby agreed to payment for said goods and services.
8. The terms of repayment required Student to pay all balances 14 (fourteen) days before
the beginning of each semester.
9. Student defaulted on the repayment of the Account by not paying the balance when
due.
10. Notices were forwarded to Student informing her of her default and right to cure such
default.
11. Student failed to cure such defaults.
12. The total amount which is immediately due and payable to Dickinson by Student on
the Account is Seventeen Thousand Six Hundred Eighty-Six Dollars and Sixty-Five Cents
($17,686.65)
WHEREFORE, Plaintiff Dickinson College demands judgment against Defendant Erin M.
Ungvarsky in the sum of Seventeen Thousand Six Hundred Eighty-Six Dollars and Sixty-Five Cents
($17,686.65), plus late fees, costs of suit, attorneys' fees and collection costs, and interest from date
of judgment.
COUNT II
INQUANTUMMERUIT
In the alternative, if this Honorable Court should determine that an express contract between
Dickinson and Erin M. Ungvarsky does not exist, which is denied, Dickinson pleads the following:
13. Paragraphs 1 through 12 are incorporated herein by reference as if set forth in full.
14. Because Dickinson loaned money to Student, to the benefit of Student, Student
became liable to Dickinson for said money.
15. Student was unjustly enriched by accepting said money without paying Dickinson
reasonable compensation therefor.
16. The total amount by which Student has become enriched is Seventeen Thousand Six
Hundred Eighty-Six Dollars and Sixty-Five Cents ($17,686.65).
17. Dickinson demanded payment of the above sums but Student failed and refused to
do so.
WHEREFORE, Plaintiff Dickinson College demands judgment against Defendant Erin M.
Ungvarsky in the sum of Seventeen Thousand Six Hundred Eighty-Six Dollars and Sixty-Five Cents
($17,686.65), until Erin M. Ungvarsky obligation is paid in full, plus late fees, costs of suit,
attorneys' fees and collection costs, and interest from date of judgment.

PETITION TO REINSTATE UNDER PAM-C.P. 230.2(d)
AND NOW comes Plaintiff, Dickinson College, by and through its counsel, MARTSON
DEARDORFF WILLIAMS OTTO GILROY & FALLER, and files this Petition to Reinstate and in
support thereof avers as follows:
1. On or about June 17, 2005, Dickinson College ("Plaintiff') filed a complaint against
Erin M. Ungvarsky ("Defendant").
2. On or about July 8, 2005, the aforementioned Complaint was served on Defendant.
3. On or about November 3, 2008, Plaintiff filed a Praecipe for Default Judgment in the
amount of $17,686.65. Such Default Judgment was accepted by the Prothonotary's Office and was
recorded on the Docket.
4. On January 28, 2009, Plaintiff attempted to transfer the aforementioned Default
Judgment to Allegheny County. A true and correct copy of such letter is attached hereto as Exhibit
«A
5. By letter dated January 29, 2009, the Cumberland County Prothonotary's Office
refused to exemplify the record of Default Judgment as requested by Plaintiff, claiming that the case
had been purged on October 29, 2008. A true and correct copy of said letter along with the Order of
Termination and Docket Summary is attached hereto as Exhibit "B."
6. The Order of Termination states that Notice of Intention to Proceed was mailed to the
parties pursuant to Pa.R.C.P. 230.2.
7. As of the date of this filing, the undersigned counsel of record, Martson Law Offices,
has not received any such Notice of Intention to Proceed.
8. The aforementioned letter was the first time that Plaintiff received notice of the Order
of Termination.
Request to Strike Order of Termination
9. Paragraphs 1 through 8 are incorporated by reference as though fully set froth herein.
10. Due to the absence of the required notice, the Order of Termination was wrongfully
entered, and as such, should be stricken.
Request to Reinstate
11. Paragraphs 1 through 10 are incorporated byreference as though fully set forth herein.
12. Due to the absence of the required notice, Plaintiff was not aware that the present
action was purged on October 29, 2008, and was obviously unable to file a petition to reinstate
within the thirty (30) days specified by Pa.R.C.P. 230.2(d)(2).
13. Plaintiff first became aware of the termination on or about January 30, 2009, after
attempting to obtain an exemplified record.
14. Further, and notwithstanding the Order of Termination dated October 29, 2008, the
Cumberland County Prothonotary's Office accepted and filed the Default Judgment on November
3, 2008.
15. Pursuant to Pa.R.C.P. 230.2(d)(3), Plaintiff avers that the Prothonotary's failure to
send the undersigned counsel the required Notice of Intent to Proceed constitutes a "reasonable
explanation or legitimate excuse" as required for reinstatement more than thirty (30) days after the
entry of the Order of Termination and that this Petition is timely filed based upon the fact that
Plaintiff only first become aware of the termination on or about January 30, 2009.
WHEREFORE, Plaintiff respectfully requests that this Honorable Court strike the Order of
Termination entered on October 29, 2008, and reinstate this action.
