Gerber Estate and objects to the Statement of Additional Receipts and Disbursements of PNC Bank , filed with the Orphans' Court of the Court of Common Pleas of Cumberland County, or or about May 18,2005, for the following reasons: 1. The Objector, Marilyn Gerber is the first child of Mildred J. Gerber and a beneficiary of the Mildred J. Gerber estate. 2. Mildred J. Gerber was deceased on January 14,2003. 3. PNC Bank was appointed Guardian of Estate on March 21,2001 by Judge Bayley. 4. The Account fails to explain with specificity the remaining loan balance and interest accrued on the loan which PNC Bank granted to Jane Heflin for the purchase of Mildred J. Gerber's automobile which was taken out of Pennsylvania with PNC Bank's knowledge or permission. 5. The Account fails to explain with specificity the terms of the sale of the residence at 623 Hilltop Drive, New Cumberland, and what the $167,000 represents including all the expenses incurred for the sale of such property. PNC . . , Bank fails to explain where these moneys went, whether they are accruing interest or income as they are charged to produce as Guardians of Estate. 6. The Account fails to explain why they have not accounted for all of the personal tangible property of Mildred J. Gerber that was a her residence, 623 Hilltop Drive, New Cumberland. PNC Bank has failed to declare that their is a substantial amount of personal property that belongs to Marilyn Gerber which they are declaring as the property of Mildred J. Gerber. 7. PNC Bank has failed to list personal property that Frederick E. Gerber and Jane Heflin have removed from the estate of Mildred J. Gerber and thereby not declared this as personal property and owned by the estate of Mildred J. Gerber. 8. PNC Bank fails to explain what the cash amount is from, its origins, and how it has been invested. 9. PNC Bank fails to explain with specificity what the $600.00 termination fee is for as well as what the administration fees are for from October 03 to April 05 and to what investment product these fees were generated from. 10. PNC Bank fails to explain the large payment of $1 ,197 was paid to an SES Insurance Services, Inc. company. 11. PNC Bank fails to explain with specificity the investment value by shares amounts, value of shares and from what asset origins the income was generated from the Blackrock Money Market and Blackrock Liquidity Funds Tempfund and where the income earned was placed or payout to and to whom. 12. PNC Bank fails to explain the holding of reserve moneys for legal fees of $2,500 and if this money is currently being invested and in what . . .. investment product. 13. PNC Bank fails to explain the $1,000 filing fee to Orphans' Court. 14. PNC Bank fails to explain why moneys taken by Frederick E. Gerber,1I after their appointment as Guardian of Estate have not been returned nor has PNC Bank attempted to recoup these moneys as this is income wasting of the Estate. 15. The Petitioner OBJECTS that PNC Bank transfer all remaining moneys to Frederick E. Gerber,11 as his position as Executor of the Mildred J. Gerber Estate is now being challenged in Orphans' Court. 16. The Petitioner reserves the right to raise further objections that may arise from time to time. 17. PNC Bank failed to produce and generate income for this Estate but instead wasted the majority of the Estate Assets and FAILED to marshall all of the assets of this Estate and claims that a substantial amount of tangible personal property actually belongs to Marilyn Gerber and not Mildred J. Gerber as Marilyn Gerber lived at the residence of Mildred J. Gerber. 18. PNC Bank has conspired with Frederick E. Gerber,1I and Jane Heflin to defraud her of the assets and her inheritance from this Estate. WHEREFORE, Marilyn Gerber, Pro Se, as beneficiary and child of Mildred J. Gerber respectfully requests that this Court: (a) deny the request of the Accountant, PNC Bank to confirm their Accounting.
