NO. ?S- 311Pq ROBERT HIGH, Ud/b/a MAIL DOCK, DEFENDANT CIVIL ACTION - LAW COMPLAINT Plaintiff, Phillips Facilities Management Group, Inc., by its attorneys, Brigid 0. Alford, Esquire, G. Edward Schweikert, IV, Esquire and Boswell, Tintner, Piccola & Alford, and presents its complaint against Defendant, Robert High, t/d/b/a Mail Dock, as follows: 1. Plaintiff, Phillips Facilities Management Group, Inc., is a Pennsylvania corporation, with its principal place of business located at 501 Fulling Mill Road, Middletown, Dauphin County, Pennsylvania 17055. 2. Defendant, Robert High, t/d/b/a Mail Dock, is an adult individual, with the last-known business address at 1548 Spring Road, Carlisle, Cumberland County, Pennsylvania 17013. COUNTI BREACH OF CONTRACT 3. On or about March 14, 2003, Defendant assumed a Rental Agreement with Plaintiff, for the rental of a Minolta CF-1901 Color Digital Delivery System. The term of the Rental Agreement was for 60 months, beginning September 24, 2002 through September 24, 2007. The monthly rental amount was $291.50. A copy of the of the Rental Agreement and Assumption of Lease is attached hereto and identified as Exhibit "A". 4. To date, Defendant is currently 17 months in arrears under the terms of the Rental Agreement. 5. Plaintiff billed Defendant on a monthly basis for the monthly rental fee of the equipment. 6. The last payment made by Defendant was on June 22, 2004, in the amount of $531.00, on the rental agreement account. 7. Under the terms of the Rental Agreement, Plaintiff can terminate the agreement and declare the total balance due under the rental agreement immediately due and owing. 8. The current outstanding balance due is $5,729.53, which includes the unpaid lease amounts in arrears. 9. Under the terms of the rental agreement, Plaintiff is entitled to accelerate the total balance due under the terms of the rental agreement, which totals $7,700.00 and collect reasonable attorneys fees of $1,432.25. 10, Despite Plaintiff's numerous attempts to collect this amount, Defendant has continuously refused to make payment to Plaintiff for the balance due. WHEREFORE, Plaintiff demands judgment in an amount not in excess of $35,000.00, which amount requires submission of this matter to compulsory arbitration, plus interest and costs of suit. COUNT II UNJUST ENRICHMENT 11. Paragraphs 1 through 10 are hereby incorporated herein by reference as if set forth at length. 12. Plaintiff provided Defendant equipment and accessories totaling $12,555.03; having done so to the benefit of Defendant, Defendant became liable to Plaintiff for the just and reasonable amount of the equipment. 13. Defendant has been unjustly enriched by accepting the equipment and accessories provided by Plaintiff and not paying for same. 14. Plaintiff has demanded that Defendant pay the amount due and owing, but Defendant has failed to do so. WHEREFORE, Plaintiff demands judgment in an amount not in excess of $35,000.00, which amount requires submission of this matter to compulsory arbitration, plus interest and costs of suit.
