This instrument is executed this ~ 0 day of June, 2005, by Robert B. Wickard
("Contractor") (or "Subcontractor"') in favor of Mark R. Wickard and Natalie A. Wickard
("Owners"). Whereas, Owners are about to execute contemporaneously herewith, a contract with
Contractor for the erection of a principle residence upon a lot ofland situate in Dickinson Township,
Cumberland County, Pennsylvania, being known as 26 Montsera Road, more fully described as
follows:
ALL THAT CERTAIN tract of unimproved land situate in Dickinson Township, Cumberland
County, Pennsylvania, more particularly bounded and described as follows:
BEGINNING at a point on the westerly line of Legislative Route No. 21009, at corner oflands now
or formerly of Glenn S. Thrush and wife; thence by said lands now or formerly of Glenn S. Thrush
and wife, in a westerly direction, 469 feet to a point; thence by the same in a southerly direction, 260
feet 08 inches to a stake, being the northwest corner of lands of Paul M. Hoch and wife; thence by
said lands now or formerly of Paul M. Hoch and wife, in an eastwardly direction, 543 feet to a point
on the western line of the said Legislative Route 21009; thence by the western line of the said
Legislative Route 21009, in a northwardly direction, 281 feet to a point, the Place of BEGINNING.
BEING the same premises which Robert B. Wickard and Sara K. Wickard, husband and wife, by
their Deed dated May 12, 2005, and recorded in Cumberland County, Pennsylvania, Deed Book 268,
Page 4252, granted and conveyed unto Mark R. Wickard and Natalie A. Wickard, husband and wife.
Now, June _, 2005, at the time of and immediately before the execution of the construction
contract aforesaid, and before any authority has been given by the said Owners to the said Contractor
to commence work on the said building, or purchase materials for the same, in consideration of the
Owners making of the said contract with Contractor, and intending to be legally bound hereby, it
is agreed that no lien shall be filed against the building by Contractor, or any sub-contractor, nor by
any of the materialmen or workmen or any other person for any labor, or materials purchased, or
extra labor or materials purchased for the erection of said building, the right to file such liens being
expressly waived.
