: STIPULATION AGAINST LIENS
THIS AGREEMENT made and concluded this !J. 7 day of June, 2005,
between Michael J. McCoy and Marianne McCoy, of 498 Petersburg Road, Carlisle,
Cumberland County, Pennsylvania, 17013 party of the first part (hereinafter called
Owner), and Michael Ludt Construction, LLC, of 139 Bonnybrook Road, Carlisle,
Cumberland county, Pennsylvania, party of the second part (hereinafter callcd
Contractor).
WEHREAS, the said parties have by a duly executed Agreement under seal, dated
June 20, 2005 entered into a written contract for the construction and completion of a
single-family dwelling located at Lot No.9, 625 Lindsey Road, South Middleton
Township, Carlisle, Pennsylvania.
NOW THIS AGREEMENT WITNESSETH, at the time of and immediately
before the execution of the principal contract, and before any authority has been given by
the said Owner to the said Contractor to commence work on the said building, or
purchase materials for the same in consideration of the making of the said contract with
Contractor and the further consideration of One Dollar, to Contractor paid by Owner, it is
agreed that no lien shaH be filed against the building by the Contractor, or any sub-
contractor, nor by any of the material men or workmen or any other person for any labor,
or materials purchased, or extra labor or materials purchased for the erection of said
building, the right to file such liens being expressly waived.
WITNESS, our hands and seals the day and year aforesaid.
