STIPULATION AGAINST LIENS
WHEREAS, Richard Zumkhawala-Cook and Ami Zumkhawala-Cook, of
Pennsylvania, is about to execute contemporaneously herewith, a contract with Ionni Properties, Ltd.
of Cumberland County, Pennsylvania, for the erection of a dwelling upon a lot of land situate as
follows:
ALL THAT CERTAIN lot or piece of ground situate in "Beverly Park", Borough
of Camp Hill, County of Cumberland, Commonwealth of Penn sylvania, being Lot No. 11, Block "S"
on the Plan of Lots known as "Beverly Park", which Plan is recorded in the Office of the Recorder
of Deeds of Cumberland County in Plan Book 3, Page 19 and more fully bounded and described, in
accordance with a survey performed by Michael C. D' Angelo, PLS, dated June 4, 2004 as follows,
to wit:
BEGINNING at an iron pipe on thewestem line ofNorth 29th Street, said point being
located on the dividing line between Lot No. 10 and Lot No. 11 in Block "S" of the Plan of Lots
known as "Beverly Park", as referenced aforesaid; thence along the western line of North 29th Street,
South 03 degrees 30 minutes 00 seconds East, a distance of 62.50 feet to an iron pin set on the
dividing line between Lot No. 11 and Lot No. 12 as set forth on the above mentioned Plan of Lots;
thence along said dividing line South 86 degrees, 30 minutes 00 seconds West, a distance of 120 feet
to an iron pin located on the dividing line between Lot No.9 and Lot No.1 I as set forth on the above
mentioned Plan of Lots; thence along said dividing line, North 03 degrees 30 minutes OOseconds
West, a distance of62.50 feet to an iron pin seton the dividing line between Lot No. 10 and Lot No.
1 I as set forth on the above mentioned Plan of Lots; thence along said dividing line North 86 degrees
30 minutes 00 seconds East, a distance of 120 feet to an iron pipe located on the western line of
North 29th Street, said point being the Place of BEGINNING.
UNDER AND SUBJECT nevertheless to the exceptions, reservations, restrictions
and conditions as contained in prior deeds of conveyance.
BEING THE SAME premises which Barbara Lee Peterlin, a single person, by her
deed dated April 27, 2005 and recorded May 5,2005 in the Office ofthe Recorder of Deeds in and
for Cumberland County, Pennsylvania in Deed Book 268, Page 3770, granted and conveyed unto
Richard Zumkhawala-Cook and Ami Zumkhawala-Cook, husband and wife.
NOW, the 'La ~ day of June, 2005, at the time of and immediately before the
execution of the principal contract, and before any authority has been given by the said Richard
Zumkhawala-Cook and Ami Zumkhawala-Cook to the said Ionni Properties, Ltd. to commence work
on the said building, or purchase materials for the same in consideration of the making ofthe said
contract with Ionni Properties, Ltd. and the further consideration of One Dollar, to Ionni Properties,
Ltd. paid by Richard Zumkhawala-Cook and Ami Zumkhawala-Cook it is agreed that no lien shall
be filed against the building by the contractor, or any sub-contractor, nor by any of the material men
or workmen or any other person for any labor, or materials purchased, or extra labor or materials
purchased for the erection of said building, the right to file such liens being expressly waived.
WITNESS, our hand and seals the day and year aforesaid.
