STIPULATION WAIVER OF RIGHT TO FILE LIEN
WHEREAS, Natgun Corporation (hereinafter "CONTRACTOR"), having an office at
11 Teal Road, Wakefield, MA 01880-1292, has entered into a contract dated Cju-IU.... J 7{ JOo5'
with Pennsylvania-American Water Company (hereinafter "OWNER"), having an office at 800
West Hershey Park Drive, Hershey, PAl 7033, to provide materials and equipment and to
perform labor necessary for the construction ofthe Project entitled "HAMPDEN WATER
TANK" situated in Hampden Township, Cumberland County, Pennsylvania, and located on
lands owned by Gary Kurtz on the west side of Lambs Gap Road approximately one mile north
ofWertzville Road in Hampden Township.
NOW, THEREFORE it is hereby stipulated and agreed by and between the said parties,
as part of the said contract and for the consideration therein set forth, that neither the undersigned
CONTRACTOR, any subcontractor or material-man, nor any other person furnishing labor or
materials to the said CONTRACTOR under this contract shall file a lien, commonly called a
mechanic's lien, for work done or materials and equipment furnished to the said Project or any
part thereof.
This stipulation is made and intended to be filed with the Cumberland County
Prothonotary within ten days after the date hereof, in accordance with the requirements of Act of
Assembly of Pennsylvania, in such case provided.
