The Petitioner is the Area Agency on Aging, in and for Cumberland County, with its office located at 16 West High Street, Carlisle, Cumberland County, Pennsylvania. 2. The alleged incapacitated person is Geraldine Reighard, single woman, age 80, who resides at 215 West Main Street, Mechanicsburg, Cumberland County, Pennsylvania and has resided there for approximately twenty (20) years. 3. There are no known relatives ofthe alleged incapacitated person. 4. Geraldine Reighard has, for at least three (3) months, been incapable of managing and caring for herself and her financial affairs. 5. Wesley Oler to Cumberland County Office of Aging. Ms. Reighard at that time was residing at Forest Park Health Center where she continues to live. Her admission date to Forest Park was on September 28, 2002. At the time of her admission to Forest Park, Ms. Reighard was diagnosed with senile dementia, non organic psychosis and depressive disorder. Her present medical conditions also include ambulatory dysfunction, dysphasia and history of fractured left hip and left wrist. Ms. Reighard's medical condition appears to be stable but slowly declining. The only medications she is on is Tylenol as needed and a stool softener. Ms. Reighard continues to require maximum assistance with all her activities of daily living and transfers. Ms. Reighard is incontinent of bowel and bladder. She is checked every 2 hours for changing and although her skin is fragile, she has had no skin breakdown. She has a pressure relief mattress and a chair cushion for her wheelchair. She is non ambulatory and is unable to propel self in her wheelchair. She is non-verbal although sometimes she will mumble something that is non-coherent and occasionally giggle. She is on small portion diet of soft foods and eats 95-100%. She is a passive participate at activities and likes the Protestant worship service, music programs, bible study and social activities. She sits in her chair and listens and watches what is going on. Her appearance is good and she doe not seem to be in any discomfort. Ms. Reighard enjoys watching TV with her roommate and they continue to get along. Ms. Reighard is visited by the care manager who also attends the care plan meetings. In addition to visiting her, the care manager reviews the medical record and discusses Ms. Reighard's condition with the nursing staff. The nursing home staff updates the care manager whenever there are concerns or medical problems. It is the request of the Cumberland County Office of Aging that the Agency retains Guardianship of Person and Estate for Geraldine Reighard. Forest Park Health Center has demonstrated an adequate quality of care for client by managing her daily needs and continuously monitoring her medical conditions. Cross Secretary Terry L Barley November, 29, 210 Director Report from Guardian of Estate Cumberland County Office of Aging Priscilla Whitman, Aging Care Manager III On October 25, 2002 Judge J. Wesley Oler appointed the Cumberland County Office of Aging permanent Plenary Guardian of Estate for Geraldine Reighard. Subsequently, the Office of Aging became Ms. Reighard's Representative Payee for her social security. At the time of the guardianship, the Office of Aging closed Mrs. Reighard's personal checking account and opened a guardian checking account at M&T Bank. When the account was opened her balance was $1043.54. Her current balance is $3352.99. Her income during 2010 was $519.00 from Social Security. That is her only income. The payments made to the Forest Park Health Center have been $374.00. In addition, the Cumberland County Office of Aging began receiving $100.00 a month Guardianship Fee for services rendered having received the necessary court order from Judge Oler on May 22, 2008. Attached is a financial summary of Geraldine Reighard's income and expenses. Geraldine Reighard's mental incapacity prevents her from managing and caring for the affairs of her person and estate. 7. The residence at 215 West Main Street, Mechanicsburg, Pennsylvania was formerly Kraley's Boarding Home and the alleged incapacitated person was placed there after her parents' deaths because there were no other family members and she was unable to care for herself and needed supervision. 8. Mrs. Kraley, who was appointed as Attorney-in-Fact for Geraldine Reighard, is now 86 years of age and is in declining health causing her to be unable to continue as her Power of Attorney. 9. Mrs. Kraley's husband and daughter, Arlene Neumeyer are both involved in the care of Mrs. Kraley and are unable to care for Geraldine Reighard. 10. Arlene Neumeyer attempts to visit Geraldine Reighard on a weekly basis but is unable to provide her with the necessary assistance that she needs. 11. Mr. Kraley and Arlene Neumeyer have observed a marked decline in the physical and mental conditions of Geraldine Reighard. 12. A representative of the Petitioner has visited her residence on several occasions and has made the following observations: a. House was not clean and was in need of repairs; b. Her bedroom had a few clothing items in the closet, all of which were dirty; c. There were no personal items around and dresser drawers were essentially bare; d. Kitchen showed no evidence of being used even though dishes, pots etc were available; e. Part of the kitchen ceiling was in bad shape due to water damage; f. Refrigerator had little food and pantry had boxes of macaroni and cat food; spoiled food was thrown out on June 27, 2002; and g. Bathroom did not appear to be functional. 13. During the day, Geraldine Reighard attends the Mechanicsburg Senior Center on a regular basis but the Director and staff are very concerned because they have seen a decline in her cognitive abilities and her wandering has also become a great concern. 14. The Director of the Mechanicsburg Senior Center has also made the following observations: a. Her behavior is very child like; b. She is unable to make informed decisions, and requires verbal prompts in the ladies room of what to do; c. She has become very agitated and fixated on certain things; and d. She no longer appears to be appropriate to participate at the Senior Center because she accuses other people of stealing her purse, is not able to converse appropriately, only talks at people and has inappropriate responses. 15. The operator of the Mechanicsburg Senior Center van looks for her almost daily because she forgets the time and place where she is to be picked up by the van and transported to the Senior Center. 16. The Mechanicsburg Police Department are being contacted and the police as well as others are concerned because: a. She has been seen wandering all over Mechanicsburg; b. She has been observed crossing the street without looking; c. She has been found walking down the middle of a busy road in traffic and wandering a distance from her home; and d. She has been going into different businesses for no apparent reason and has been begging for food at the local restaurant. 17. On April 24, 2002, Geraldine Reighard was evaluated at HealthSouth Rehabilitation Center ofWormleysburg for a Geriatric Assessment and the team recommended that she should have twenty-four (24) hour supervision due to impaired problem solving, judgment and safety. A copy ofthe Assessment is attached hereto, marked as Exhibit "A", and incorporated herein by reference. 18. As part of the Geriatric Assessment, Geraldine Reighard was examined by Lawrence B. Zimmerman, M.D. who concluded that her impairment seems to be such that she would be unable to make decisions concerning her well-being, both financial as well as physical and that a Guardianship would be recommended. A copy of his report is attached hereto, marked as Exhibit "B", and incorporated herein by reference. 19. Amy Kucirka, Psy. D., Clinical Neuropsychologist, as part ofthe Geriatric Assessment recommended that she be placed in a supervised living situation where she has twenty-four (24) hour supervision and that she is not appropriate for independent living given her cognitive deficits. A copy of her report is attached hereto, marked as Exhibit "C", and incorporated herein by reference. 20. The Petitioner believes and, therefore, avers that allowing Geraldine Reighard to continue living in the house and wandering the streets of Mechanicsburg would place her in imminent danger of death or serious bodily harm. 21. Petitioner believes and, therefore, avers that Geraldine Reighard should be placed in a nursing home facility. 22. Less restrictive alternatives are not available because there is no one able to care for her. 23. The Area Agency on Aging, in and for Cumberland County, Pennsylvania, is willing to accept the appointment of Emergency Plenary Guardian of the Person and Estate of Geraldine Reighard. 24. No other Court has ever assumed jurisdiction in any proceeding to determine the incapacity of Geraldine Reighard. 25. The failure to appoint the Area Agency on Aging, in and for Cumberland County, Pennsylvania as Emergency Plenary Guardian of the Person and Estate of Geraldine Reighard will result in irreparable harm to the person and estate of Geraldine Reighard. BACKGROUND INFORMATION: The patient Is an BO-year-old white female who currently resides in Mechanicsburg in a boarding home that has now been closed. The patient attends a senior center in Mechanicsburg on a daily basis where evidently she is fed. The patient's case manager states that the patient resides alone in an older home without supervision at the current time. Evidently, the patient has no family in the area. The patient reports that she resided with her parents in Altoona until their deaths. The patient was a very poor historian and could not relate with reliability much of her history. During the interview, the patient was focused on the fact that she had broken her bottom dentures. She was very distractible, tangential, and showed loosening of associations. The patient reported that she was not used to "sitting around" and that she wanted to return home. During the interview, the patient was alert and InteractIve. The patient was oriented only to person. She stated her age as 78 (her actual age is 80). The patient was unable to name the facility. She stated she was in Mechanicsburg. The HealthSouth facility is located in Wormleysburg. The patient's temporal orientation was also impaired. When asked the year, the patient repeated "March" and then "April". When questioned repeatedly regarding the year, she finally responded "1998" and then "1992", The patient was able to state the month as April. She was correct for the day of the week, Wednesday, and correct for time of day. The patient's auditory attention and short-term recall for number sequences was within the mild to moderate impaired range for her age. The patient was able only to repeat four digits immediately after presentation. She showed markedly impaired attention and concentration as evidenced by distractibility, attentiveness to extraneous activity outside of the office and noises. In the area of basic language processing, the patient showed variable abilities. Receptively, she showed moderate Impairments in her ability to follow commands of increasing complexity. The patient was able to only reliably follow one step commands. Expressively, the patient showed severe impairments in her repetition skills. The patient was able to repeat sentences of increasing iength and complexity. The patient's confrontation naming skills were mildly impaired on this cognitive screening measure. In the area of visual spacial functioning, the patient showed verbal memory deficits. She also showed severe Impairments in a visual constructional task that required her to copy a complex line drawing. The patient was able to only represent the overall shape of the design. She was unable to place any of the details accurately on the design and gave up very easily. When asked to draw a clock, the patient drew a circle and was unable to accurately number the clock. DIAGNOSTIC IMPRESSION: The test data, taken in consideration with the known history provided by the case manager at the Office of Aging, indicates that the patient has moderate to severe cognitive deficits in most areas of cognitive functioning. At that time, the patient was attending a senior center in Mechanicsburg on a daily basis, where it was apparent she was being fed. Ms. Reighard's case manager, Priscilla Whitman, now reports that Ms. Reighard is not attending the senior center on a regular basis. They report that she misses the van and is not making her way to the senior center as she had been previously. Ms. Whitman also reported tljat Ms. Reighard's room in the closed boarding home has next to no food, clothing, or basic necessities such as soap. Evidently, Ms. Reighard 'had been bathing at the senior center when she was attending more regularly. Ms. Reighard reports that she has no family. She stated her parents died when she was young and she had two brothers, who are now deceased. She stated she had a niece and nephew but she is unaware of their location. Ms. Reighard was noted to be a very poor historian and was also noted to confabulate. She siated she resides with a number of women and staff who are there during the daytime and evenings. This is not accurate information. During the interview, Mr. Reighard continued to reiterate "I never complain. I'm in good health every day". She stated she did fall in the past and she spent some time at Holy Spirit Hospital, but could not tell me when it happened. She reports she gets a check from her "social worker every third month". According to Ms. Reighard's social worker, her power of attorney and guardian is also in her 80's and suffers from Alzheimer's, and is the party who receives the patient's checks. It is unclear how much money she is given, but her social worker estimated it is approximately 20 to 30 dollars per month. When questioned as to how she eats, she reports that she eats at "Col1ins". Evidently, this is a restaurant that occasionally feeds her out of concern and apparently without payment. FINDINGS The patient was in the PRISM offices for the evaluation. She was alerted to the purpose of the interview in order to see how well she is thinking. Orientation was impaired. Ms. Reighard was able to state her name, and stated her age as 78 (her actual age is 80). She was unable to name where she was. Temporal orientation was also noted to be impaired. When asked the year, she replied "1998" She reported the month as February and then corrected it to "April"; She was unaware of the day ofthe month and day of the week. She showed markedly impaired attention and concentration as evidenced by distractibility, and attentiveness to noises outside the office. In the area of basic language processing, the patient showed impairments as wel1. Receptively, she showed an inability to follow even one step commands reliably. Expressively, she had difficulty on a picture description task and was noted to telegraphically describe the picture without elaboration. She showed severe impairment in her sentence repetition skills as evidenced by her inability to repeat sentences that were read by the examiner. Her confrontation naming skills were noted to be Mildly to Moderately Impaired and she was noted to make literal and semantic errors in her attempts to name objects. The patient showed severe deficits in the areas of visual-spatial functioning, as evidenced by her inability to copy block designs from a template. She was unable to copy block designs that were concretely demonstrated by the examiner as well. She was eventually able to copy a two block design with encouragement, but was unable to accurately complete a third block design. She was asked to draw a circle and to number its face like a clock. She was noted to place numbers on a clock in a somewhat random fashion, up until number 17. On a list learning task, her ability to learn and recall a list of four words over a lO-minute delay was Severely Impaired. Ms. Reighard needed the list repeated approximately six or seven times before she could repeat the list. After a lO-minute delay, she could not recall any of the four words using a free recall strategy. She identified one offour using a recognition cue. However, this is likely to be due to chance. The patient's verbal abstract reasoning skills were in the Severely Impaired range. She was unable to make abstract connections on verbal analogy items. When asked how a rose and a tulip are alike, she replied "some red and some green". She was unable to answer any more difficult abstract analogy questions. The patient's responses to questions to assess judgment were also noted to be in the Severely Impaired range. For example, when asked what she would do if she were at home and saw smoke and flames, she replied "I'd tell 'em I wouldn't let that go." When asked who she would tell, she replied "Tell the lady, or the policeman, or something". When pressed to tell me what number she would call, she was unable to answer. Ms. Reighard was also unable to mentally solve a simple addition problem and was not helped with the benefit of paper and pencil. The patient's affect was noted to be somewhat constricted. She was noted to be physically anxious and restless. She evidenced agitation and frequently complained about why she was being asked to do things. She was noted to be significantly perseverative in her objections. She was able to be redirected at times, but continued to voice the same complaints. DIAGNOSTIC IMPRESSION Data from this evaluation and neuropsychological screening, taking into consideration the known history provided by the case manager and Office of Aging, indicate rather severe cognitive difficulties for Ms. Reighard in most areas of cognitive functioning. She shows severe impairments in the areas of memory, orientation, visual-spatial skills, praxis skills, and executive processing skills. She shows significant impairment in her judgment and reasoning skills. She shows better preserved ability in the area of expressive language skills, however, she shows significant impairments in her ability to communicate effectively secondary to perseverative tendencies, loosening of associations, and disorganized thinking. She was also noted to confabulate information. Despite her deficits, Ms. Reighard gives the appearance of being fiercely independent and insistent in her ability to manage, however, much of what she relates is not corroborated by her case manager and she is an extremely unreliable informant. Ms. Reighard's deficits are consistent with a primary dementia. RECOMMENDATIONS I. It is recommended that Ms. Reighard be in a supervised living situation, nursing home is appropriate, where she would have 24 hour supervision. There are rights and obligations for both the service provider and the client. Impaired clients need to have a responsible caregiver center staff may have easy access to. This responsible party attends to the client's physical and medical needs, arranges and fulfills the attendance schedule, participates in care planning, and communicates any changes or concerns with the center's staff. This person also assures the client's safe transportation to and from the center as well as getting safely in and out of the center and the home. If your client has been determined by various professionals to require twenty-four hour supervision, supports need to be in place continually. Ms. Reighard suffers from pnmary dementia, probably due to Alzheimer's Disease. , 4. This condition has existed for several years and has recently become significantly symptomatic. 5. As a consequence of the illness, Ms. Reighard's ability to receive and evaluate information effectively and communicate decisions in any way is impaired to such a significant extent that she is totally unable to manage her financial resources and totally unable to meet essential requirements for her physical health and safety. 6. There is no indication at the present time that Ms. Reighard's condition will improve. 7. Ms. Reighard's income is about $500.00 per month and she does not appear to have resources in the form of assets, family or friends available to meet her needs. 8. Ms. Reighard's symptoms have advanced to the point that she misplaces her belongings and suspects others of stealing them, can not keep appointments, often becomes lost after leaving her residence, is in danger of being hit by traffic as a pedestrian, and has become the subject of the attention and assistance of strangers and Mechanicsburg Borough police on a frequent basis. 9. Ms. Reighard's symptoms have unfortunately reached the point that, given the absence of supportive resources, (a) she is in need of a plenary guardian of her person and estate and (b) a failure to appoint such a guardian will result in irreparable harm to her person and estate. 10. The durations of the necessary guardianships of the person and estate shall be as long as permitted by law, but, because the guardianships have been requested on an emergency basis, by statute the emergency guardianship of the person may not extend beyond 72 hours in the absence of further order of court (and in no event may continue for more than 20 days thereafter), and the emergency guardianship of the estate may not extend beyond 30 days.' \ See Act of June 30, J 972, P.L. 508, 92, as amended, 20 Pa. C.S. 95513 (Supp. 2002). 2 , 11. The foregoing findings of fact are made on the basis of clear and convincing evidence. DISCUSSION Under Pennsylvania law, an emergency guardian of the person and/or estate may be appointed in the case of a person alleged to be incapacitated "when it appears that the person lacks capacity, [the person] is in need ofa guardian[,] and a failure to make such appointment will result in irreparable harm to the person or estate of the alleged incapacitated person." Act ofJune 30, 1972, P.L. 508, 92, as amended, 20 Pa. C.S. 95513 (Supp. 2002). An "incapacitated person" means an adult whose ability to receive and evaluate information effectively and communicate decisions in any way is impaired to such a significant extent that he is partially or totally unable to manage his financial resources or to meet essential requirements for his physical health and safety. Id. 95501. Proof in such a case must be by clear and convincing evidence. Jd. 995511(a),5513. In the present case, Petitioner has demonstrated by clear and convincing evidence that an emergency adjudication of incapacity and appointment of a plenary guardian of the person and estate are appropriate. The Petitioner is the Area Agency on Aging, in and for Cumberland County, with its office located at 16 West High Street, Carlisle, Cumberland County, Pennsylvania. 2. The alleged incapacitated person is Geraldine Reighard, single woman, age 80, who currently resides at Forest Park Health Center 700 Walnut Bottom Road, Carlisle, Cumberland County, Pennsylvania. 3. On or about August 2, 2002, the Petitioner filed a Petition for Appointment of Emergency Plenary Guardian of the Person and Estate of Geraldine Reighard to No. 21- 02-694 of the Orphans' Court Division ofthe Court of Common Pleas, in and for Cumberland County, Pennsylvania. 4. The contents of the Petition for Appointment of Emergency Plenary Guardian of the Person and Estate of Geraldine Reighard are incorporated herein by reference as though set forth in full. 5. Testimony was presented at Hearings on August 7, 2002 and again on September 25,2002 on the Petition resulting in an Order being entered on September 27,2002 wherein Geraldine Reighard was adjudicated an incapacitated person on an Emergency basis and the Area Agency on Aging, in and for Cumberland County, Pennsylvania was appointed Emergency Plenary Guardians of the Person and Estate of Geraldine Reighard, which Order was in effect for seventy-two (72) hours. 6. On or about September 30, 2002, Petitioner filed a Petition to Extend Emergency Guardianship and, by Order dated September 30, 2002, the appointment of the Area Agency on Aging, in and for Cumberland County, Pennsylvania, as Emergency Plenary Guardians of the Person and Estate of Geraldine Reighard was extended for twenty (20) days from the expiration of the initial Emergency Order and a Hearing is scheduled for October 23,2002 to determine whether Permanent Plenary Guardians of the Person and Estate of Geraldine Reighard should be appointed. 7. There are no known relatives of the alleged incapacitated person. 8. The Petitioner believes and, therefore, avers that allowing Geraldine Reighard to continue living in the house and wandering the streets of Mechanicsburg would place her in imminent danger of death or serious bodily harm. 9. Petitioner believes and, therefore, avers that Geraldine Reighard should be placed in a nursing home facility. 10. Less restrictive alternatives are not available because there is no one able to care for her. II. The Area Agency on Aging, in and for Cumberland County, Pennsylvania, is willing to accept the appointment of Permanent Plenary Guardians ofthe Person and Estate of Geraldine Reighard. 12. No other Court has ever assumed jurisdiction in any proceeding to determine the incapacity of Geraldine Reighard. 13. The failure to appoint the Area Agency on Aging, in and for Cumberland County, Pennsylvania as Permanent Plenary Guardians of the Person and Estate of Geraldine Reighard will result in irreparable harm to the person and estate of Geraldine Reighard. WHEREFORE, Petitioner prays that this Honorable Court appoint the Area Agency on Aging, in and for Cumberland County, Pennsylvania as Permanent Plenary Guardians of the Person and Estate of Geraldine Reighard. A hearing was held in this matter on October 23, 2002.' The allegedly incapacitated person was present and represented by her court-appointed counsel, Mark F. Bayley, Esq. FINDINGS OF FACT I. The allegedly incapacitated person is Geraldine Reighard, a domiciliary of Cumberland County, Pennsylvania, born March 14, 1922. 2. Until very recently, Ms. Reighard resided at 215 West Main Street, Mechanicsburg, Cumberland County, Pennsylvania. 3. Since September 28,2002, Ms. Reighard has resided at the Forest Park Nursing Home, 700 Walnut Bottom Road, Carlisle, Cumberland County, Pennsylvania. I Pursuant to an agreement of counsel, the record from a hearing held on August 7, 2002, and September 25, 2002, was incorporated into the record of the hearing on October 23,2002. 4. Petitioner is the Area Agency on Aging in and for Cumberland County, Pennsylvania, with offices located at 16 West High Street, Carlisle, Cumberland County, Pennsylvania. 5. Following a hearing on August 7, 2002, and September 25, 2002, Ms. Reighard was adjudicated an incapacitated person on an emergency basis by this court, by order dated September 27, 2002, and Petitioner was appointed emergency plenary guardian of her person and estate. 6. By order of court dated September 30, 2002, the emergency guardianship of the person and estate was extended for 20 days. 7. Ms. Reighard suffers from primary dementia, probably due to Alzheimer's Disease. 8. This condition has existed for several years and has become significantly symptomatic. 9. As a consequence of the illness, Ms. Reighard's ability to receive and evaluate information effectively and communicate decisions in any way is impaired to such a significant extent that she is totally unable to manage her financial resources and totally unable to meet essential requirements for her physical health and safety. 10. There is no indication at the present time that Ms. Reighard's condition will significantly improve. 11. Ms. Reighard's income is about $500.00 per month, and she does not appear to have resources in the form of assets, family or friends available to meet her needs. 12. Manifestations of Ms. Reighard's condition include the misplacement of her belongings and suspicion that others have stolen them, inability to keep appointments, loss of bearings outside her residences, endangerment from traffic as a pedestrian, and need for frequent assistance from local police and strangers. 2 13. Ms. Reighard's symptoms have unfortunately reached the point that, given the absence of supportive resources, she is in need of a plenary guardian of her person and estate. 14. The duration of the necessary guardianship of the person and estate must be considered indefinite at this point, because of the absence of a more favorable prognosis. IS. Petitioner, m its capacity as emergency guardian of Ms. Reighard's person and estate, has explored possibilities of residency other than a nursing home in accordance with the order of September 27, 2002, without success, and has secured a residence for her at a nursing home where she seems to be happy and is physically well cared for. 16. The foregoing findings are made on the basis of clear and convincing evidence. DISCUSSION The provisions respecting an adjudication of incapacity are contained in 20 Pa. C.S. 995501-5537. On October 25,2002, Permanent Guardianship of Person and Estate for 1',)1 Geraldine Reighard was granted by Judge J. Wesley Oler to Cumberland County Office of Aging. Ms. Reighard at that time was residing at Forest Park Health Center where she continues to live. Her admission date to Forest Park was on September 28,2002. At the time of her admission to Forest Park, Ms. Reighard was diagnosed with senile dementia, non organic psychosis and depressive disorder. Her present medical conditions also include gastro esophageal reflux disorder, ambulatory dysfunction, dysphasia and history of fractured left hip and left I wrist. Her present medications are; Trazadone, Risperdal, Depakote, Prilosec,i Lexapro, Miralax powder, Xenaderm ointment and Tylenol. Her nutrition is good, her weight is stable and she eats 75% or more of her meals. Ms. Reighard continues to require maximum assistance with all her activities of daily living and transfers. The majority of the time Ms. Reighard is very , cooperative with her care. Although since her fall which resulted in fractured: hip and wrist she yells out at times while care is being done. She requires I supervision while eating and is on a pureed diet of small portions. Nursing staff provide weekly skin and pain assessment. Ms. Reighard is prone to skin: breakdown and experiences pain in her shoulders. She has a pressure relief I mattress and a chair cushion for her wheelchair. She receives hot packs to \r her shoulders three times a day. Ms. Reighard has limited range of motion in her neck, right arm and both her feet. Staff provides passive range of motion to both upper and lower extremities daily. She is non ambulatory and is unable to propel self in her wheelchair. She is incontinent of bowel and bladder. Cognitively, she is alert and oriented to self. Her short and long term memory is severely impaired and she is unable to make decisions. Ms. Reighard displays much confusion and her verbalization is not coherent , the majority of the time. She is pleasant with other residents and the staff. Geraldine continues to attend different activities as one who observes rather ' than participates. She usually has a smile, has her silly moods and likes to laugh. Ms. Reighard enjoys watching TV with her room mate. She has become more lethargic and at times it is difficult to wake her. Ms. Reighard is visited every 30 -60 days by the care manager. In addition to visiting her, the care manager reviews the medical record and discusses Ms. Reighard's condition with the nursing staff. The nursing home staff updates the care manager whenever there are concerns or medical problems. It is the request of the Cumberland County Office of Aging that the Agency retains Guardianship of Person and Estate for Geraldine Reighard. Forest Park Health Center has demonstrated an adequate quality of care for client b~ managing her daily needs and continuously monitoring her medical conditions. She is scheduled to receive her flu shot by the end of the month. Her nutrition is good, her weight is stable at 115 pounds and she eats 80% of her meals. Wesley Oler appointed the Cumberland County Office of Aging permanent Plenary Guardian of Estate for Geraldine Reighard. Subsequently, the Office of Aging became Ms. Reighard's Representative Payee for her social security. At the time of the guardianship, the Office of Aging closed Mrs. Reighard's personal checking account and opened a guardian checking account at M&T Bank. When the account was opened her balance was $1043.54. Her current balance is $3022.99. Her income during 2008 was $491.00 from Social Security. The payments made to the Forest Park Health Center were between $360 and $435 depending on the number of days in the month. In addition, the Cumberland County Office of Aging began receiving $100.00 a month Guardianship Fee for services rendered having received the necessary court order from Judge Oler on May 22, 2008. Attached is a financial summary of Geraldine Reighard's income and expenses. Wesley Oler to Cumberland County Office of Aging. Ms. Reighard at that time was residing at Forest Park Health Center where she continues to live. Her admission date to Forest Park was on September 28, 2002. At the time of her admission to Forest Park, Ms. Reighard was diagnosed with senile dementia, non organic psychosis and depressive disorder. Her present medical conditions also include ambulatory dysfunction, dysphasia and history of fractured left hip and left wrist. During this past year it was discovered that a mas was found on Geraldine's right breast. A mammogram was taken and it showed two cancerous nodules. Based on her present physical and mental conditions it was decided that we would not pursue aggressive treatment but rather comfort measures. Geraldine does not appear to be in pain at this point and is unaware of her condition due to her lack of understanding. Her present medications are; Risperdal, Depakote, Celexa, Miralax powder, Xenaderm ointment and Tylenol. Ms. Reighard's weight has slowly declined and her current weight is 99 pounds. Ms. Reighard continues to require maximum assistance with all her activities of daily living and transfers. The majority of the time Ms. Reighard is very cooperative with her care. Nursing staff provide weekly skin and pain assessment. Ms. Reighard is prone to skin breakdown and experiences pain in her shoulders. She has a pressure relief mattress and a chair cushion for her wheelchair. She is non ambulatory and is unable to propel self in her wheelchair. She is incontinent of bowel and bladder. Her short and long term memory is severely impaired and she is unable to make decisions. Ms. Reighard displays much confusion and her verbalization is not coherent and very limited with no complete thought. Ms. Reighard may mumble a few words that have no meaning to others. She is pleasant with other residents and the staff. Geraldine continues to attend different activities as one who observes rather than participates. She attends bowling, sing along, movies, bingo and church. She usually has a smile, has her silly moods and likes to laugh. Her present medical conditions also include ambulatory dysfunction, dysphasia and history of fractured left hip and left wrist. Ms. Reighard's medical condition appears to be slowly declining. The only medications she is on is Tylenol as needed and a stool softener. There has been little change during this year. Ms. Reighard continues to require maximum assistance with all her activities of daily living and transfers. Ms. Reighard is incontinent of bowel and bladder. She is checked every 2 hours for changing and although her skin is fragile, she has had no skin breakdown. She has a pressure relief mattress and a chair cushion for her wheelchair. She is non- ambulatory and is unable to propel self in her wheelchair. She is non-verbal although sometimes she will mumble something that is incoherent and occasionally giggles. There was a consultation with an orthopedic surgeon and it was decided she should wear braces on her legs two times a day for 2 hours each time for contracture prevention. The braces are very soft and she shows no sign of discomfort or distress. The staff does range of motion exercises with Ms. Reighard in the morning and evening Every day staff takes her to activities that she can listen to. She seldom opens her eyes. She seems to like the Protestant worship service, music programs, bible study and social activities. Ms. Reighard is on a pureed diet. She had been on a protein supplement but that was stopped because she had a 9°lo weight gain. Numerous Christmas presents were donated by Home Instead's Secret Santa project. She received these at the Home's Christmas party. Wesley Oler to Cumberland County Office of Aging. Ms. Reighard at that time was residing at Forest Park Health Center where she continues to live. At the time of her admission to Forest Park, Ms. Reighard was diagnosed with senile dementia, non- organic psychosis and depressive disorder. Her present medical conditions also include ambulatory dysfunction, dysphasia and history of fractured left hip and left wrist. Ms. Reighard's medical condition appears to be slowly declining. She had only been on Tylenol as needed and a stool softener until she was recently started on amulti-vitamin with minerals. There has been little change during this year. Ms. Reighard continues to require maximum assistance with all her activities of daily living and transfers. Ms. Reighard is incontinent of bowel and bladder. She is checked every 2 hours for changing and her skin is fragile. There was one episode of skin breakdown with a small blister on her buttock but the home successfully treated it. She has a pressure relief mattress and a chair cushion for her wheelchair. She is non- ambulatory and is unable to propel self in her wheelchair. She is non-verbal although sometimes she will mumble something that is incoherent and occasionally giggles. There was a consultation with an orthopedic surgeon and it was decided she should wear braces on her legs two times a day for 2 hours each time for contracture prevention. The braces are very soft and she shows no sign of discomfort or distress. The staff does range of motion exercises with Ms. Reighard in the morning and evening Every day staff takes her to activities that she can listen to. She seldom opens her eyes. Ms. Reighard is on a pureed diet. She also receives supplements in a special ice cream twice a day. Ms. Reighard is visited every 30-60 days by Aging staff who also attend the care plan meetings. The medical record is reviewed and Ms.Reighard's condition is discussed with the nursing staff. The nursing home staff updates Aging whenever there are F.h1AII. Numerous Christmas presents were donated by Home Instead's Secret Santa project. She received these at the Home's Christmas party. It is the request of the Cumberland County Office of Aging and Community Services that the Agency retain Guardianship of Person and Estate for Geraldine Reighard. Forest Park Health Center has demonstrated an adequate quality of care for client by managing her daily needs and continuously monitoring her medical conditions. Therefore, we believe that Ms. Reighard should continue to reside at Forest Park Health Center. ESTATE At the time of the guardianship, the Office of Aging closed Mrs. Reighard's personal checking account and opened a guardianship checking account at M&T Bank. Her only income is Social Security which was $519 during 2011 and increased to $538.00 in 2012. The payments made to the Forest Park Health Center are currently $$393.00. In addition, the Cumberland County Aging began receiving $100.00 a month Guardianship Fee for services rendered having received the necessary court order from Judge Oler on May 22, 2008. Her medical conditions also included ambulatory dysfunction, dysphasia and history of fractured left hip and left wrist. Ms. Reighard's medical condition slowly declined over the past year. She continued to require maximum assistance with all her activities of daily living and transfers. Ms. Reighard had been incontinent of bowel and bladder. She spent most of her time sleeping and was repositioned every two hours. Her arm was splinted and wore Geri sleeves due to her contractures. She had a pressure relief mattress and a chair cushion for her wheelchair. She was non- ambulatory and unable to propel self in her wheelchair. She was non-verbal. On March 5, 2013 she was placed on oxygen due to low oxygen level in her blood. On March 14, we were advised that she had C-Dill and her white blood count was elevated which indicated an infection. Two Aging staff members took her balloons to celebrate her birthday. She did open her eyes during the visit. We were advised that she passed away the next day. Death was due to complications from advanced Alzheimer's disease. She was 91. ESTATE At the time of the guardianship, the Office of Aging closed Mrs. Reighard's personal checking account and opened a guardianship checking account at M&T Bank. Her only income was Social Security which was $547 at the time of her death. The monthly payments made were to Forest Park Health Center for $411. In addition, the Cumberland County Aging received $100.00 a month Guardianship Fee for services rendered having received the necessary court order from Judge Oler on May 22, 2008. The balance in her account at the time of her death was $5573.89. The Department of Public Welfare's Estate Recovery Division was notified of her death and the account balance.
