STIPULATION AGAINST LIENS
THIS AGREEMENT made the ~1}'day of June, 2005, by and
between R.J. POTTEIGER CONSTRUCTION SERVICES, INC., of P.O. Box
164, New Kingstown, Pennsylvania 17072, hereinafter referred to
as Contractor, AND RODNEY J. POTTEIGER and STACEY R. POTTEIGER,
husband and wife, of 20 Deer Lane, Carlisle, Pennsylvania 17013,
hereinafter referred to as Owner, whereby the former undertook
and agreed to erect and construct a single family residence on
that certain lot of ground situate on 20 Deer Lane, in Silver
Spring Township, Cumberland County, Pennsylvania. Being the same
premises which Waypoint Bank, a Federal Savings Bank, by Deed
dated March 3, 2004 and recorded March 10, 2004 in the Cumberland
County Recorder of Deeds Office in Deed Book 262, Page 68,
granted and conveyed unto Rodney J. Potteiger and Stacey R.
Potteiger, husband and wife.
NOW THEREFORE, THIS AGREEMENT WITNESSETH: That the said
Contractor, for and in consideration of the sum of One ($1.00)
Dollar to Contractor in hand paid by Owner, the receipt whereof
is hereby acknowledged, and the further consideration mentioned
in the agreement aforesaid, for themselves and their
subcontractors, and all parties acting through or under them,
covenant and agree that no mechanic'S liens or claims shall be
filed or maintained by them or any of them against the said
buildings and the lot of ground appurtenant thereto for or on

On this, the:;;l:}-l-day of June, 2005, before me, the
undersigned officer, personally appeared Rodney J. potteiger and
Stacey R. Potteiger known to me (or satisfactorily proven) to be
the persons whose names are subscribed to the within instrument
and acknowledged that they executed the same for the purposes
therein contained.

Public, personally appeared Rodney J. Potteiger known to me to be
the person whose name is subscribed as President, and who
acknowledges himself to be the said officer of R.J. potteiger
Construction Services, Inc., a corporation, and that he as such
officer, being authorized to do so, executed the foregoing
statement for the purposes therein contained by signing the name
of the corporation by himself as said officer.

account of any work done or materials furnished by them or any of
them under said contract or otherwise, for, towards, in, or about
the erection and construction of the said buildings on the lot
above described, and the said Contractor, for themselves, their
subcontractors and others under them hereby expressly waive and
relinquish the right to have, file, and maintain any mechanic's
liens or claims against the said buildings or any of them and
agree that this instrument, waiving the right of lien, shall be
an independent covenant.
WITNESS our hands and seals, or if a corporation, it has
caused these presents to be signed by its proper corporate
officers and its corporate seal to be affixed hereto, the day and
year above written.
